AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE,
BEING ORDINANCE NO.2325-1968, COMMONLY KNOWN AS THE ZONING
ORDINANCE OF THE CITY OF RICHMOND, INDIANA, PROVIDING FOR THE
REZONING OF THE PROPERTY LOCATED AT 215 INDUSTRIAL PARKWAY
FROM M-2 GENERAL INDUSTRIAL DISTRICT TO M-1 SU GENERAL
INDUSTRIAL SPECIAL USE DISTRICT AND AUTHORIZING THE SPECIAL USE
OF SAID PROPERTY FOR AN ADVERTISING AGENCY.
WHEREAS, the Zoning Map which is a part of Ordinance No. 2325-
1968, designates and describes as M-2 General Industrral
District the property located at 215 Industrial Parkway; and,
WHEREAS, it is the intent and purpose hereof to change the zoning
classification of said property from M-2 General Industrial
District to M-2 SU General Industrial Special Use District, and
to authorize the Special Use of said property for an advertising
agency; and,
WHEREAS, a study of this Ordinance was conducted by the Richmond
City Plan Commission then gu day of i*?aL • 1989, at which time
remonstrances were heard from all parties interested in or
affected by this Ordinance; and,
WHEREAS, the vote of the Richmond City Plan Commission was _to
in favor of/' recommending the passage of
Ordinance No. 13-1989.
NOW THEREFORE BE IT ORDAINED by the Common Council of the City of
Richmond, Indiana, as follows:
SECTION 1. That the zoning classification of the property described
below, and the same is hereby changed toM-2 General
Industrial Special Use District, and that said property be
regulated in accordance with the Zoning Ordinance of the
City of Richmond, Indiana and all amendments thereto:
Being a part of the Southeast Quarter of Section 36,
Township 14 North, Range I West, and part of the
Northeast quarter of section 1, Township 13 North, Range
1 West, all in the Wayne County, Wayne township
Indiana, and being more particularly described as
follows:
Beginning at the point of intersection of the centerline of
Old United States Highway 40, formerly the Wayne
County Turnpike, with the west line of the Southeast
Quarter of Section 36, said point of intersection being
142.46 feet north of the southwest corner of the
Southeast Quarter of said Section 36, running thence,
from said beginning point, south 73 degrees and 59
minutes east, along the centerline of said Old United

States Highway 40, a distance of 291.66 feet; thence
south 14 degrees and 58 minutes east, along the chord of
a curve to the right and parallel to the centerline of the
Pennsylvania Railroad, a chord distance of 522.01 feet;
thence north 74 degrees and 45 minutes west, a distance
of 293,85 feet; thence north, 271.50 feet; thence west ,
131.73 feet to a point in the west line of the Northeast
Quarter of Section 1; thence north along the west line of
the Northeast Quarter of Section 1; and along the west
line of the Southeast Quarter of Section 36, a distance of
236.31 feet to the place of beginning, containing a total
area of 298 acres, more or less, there being 0.75 acres,
more or less, in the Southeast Quarter of said Section 36,
and 2.23 acres, more or less, in the Northeast Quarter of
said Section 1.
ALSO, the following described real estate: Being a part of
the Northeast Quarter of Section 1, Township 13 North,
Range 1 West, in Wayne Township, Wayne County,
Indiana, and being more particularly described as
follows: Beginning at a point 83.85 feet south of the
southwest corner of the southeast quarter of Secion 36,
Township 14, North, Range 1 West, Wayne Township,
Wayne County, Indiana said southwest corner being
308.22 feet north 73 degrees and 59 minutes west and
152.46 feet south of the intersection of the center line of
the Wayne County Turnpike (formerly Old United States
Highway 40) with the westwardly right-of-way- of the
Pennsylvania Railroad and running thence from said
beginning point, east 131.73 feet; thence south 271.50
feet to the centerline of a cree; thence west along said
centerline 131.73 feet; thence north 271.50 feet to the
place of beginning, containing an area of 0.82 acres, more
or less,
AND ALSO, an easement for ingress and egress to the
above described tract described as follows: Beginning at
the southwest corner of the above tract, and running
thence from said beginning point west 30 feet; thence
north parallel to the west line of the above described
tract 516.4 feet to a point in the centerline of said Wayne
County Turnpike; thence south 73 degrees and 59
minutes east, along said centerline 31.21 feet; thence
south 507.81 feet to the place of beginning, and the end
of this description.
SECTION 2. That as provided in Articles 35 and 48 of Chapter 154 of
the Code of Ordiances, the following described use of the
above described property is allowed for an advertising
agency.

SECTION 3. That as a condition of being granted the Special Use and
as an additional restriction on said use, the following
requirements shall hereafter and at all time be met by
the owner of said real estate.
a. The Special Use site plan and narrative submitted in the
Special Use petition shall be marked Exhibit "A" and
made a part of this Ordinance.
This Ordinance shall be in full force and effect from and after its passage
and approval as by law required.
PASSED AND ADOPTED by the Common Council of the City of Richmond,
