HomeMy Public PortalAbout019-1989- ZONING - EASTSIDE OF GREENBRIER DR AND 300 BLKORDINANCE NO. 19-1989 AN ORDINANCE GRANTING PRELIMINARY APPROVAL TO A RESIDENTIAL DEVELOPMENT UNIT PROJECT IN A R-4 MULTI -FAMILY RESIDENCE DISTRICT ON PROPERTY LOCATED ON THE EAST SIDE OF GREENBRIER DRIVE IN THE 300 BLOCK, PURSUANT TO ARTICLES 45 AND 48 OF CHAPTER 154 OF THE CODE OF ORDINANCE, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA. WHEREAS, the Zoning Map which is a part of Ordinance No. 2325-1968 designates and describes as R-4 Multi -Family Residence District the property located on the east side of Greenbrier Drive in the 300 block; and, WHEREAS, it is the intent and purpose thereof, pursuant to Articles 45 and 48 of the Zoning Ordinance, to grant preliminary approval of a Residential Development Unit Project on the above said property; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the a day of,1989, at which time remonstrances were heard from all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Plan Commission was--Lto_ O in favor of4iR==appasitien t recommending the passage of Amended Ordinance No, 19-1989. NOW THEREFORE BE IT ORDAINED BY the Common Council of the City of Richmond, Indiana as follows: SECTION 1. That pursuant to Article 45 and 48 of the Zoning Ordinance, preliminary approval for a Residential Developement Project on the property described below is hereby granted. Beginning at an iron pipe in the south line of the said Jaffe tract said pipe being located Due South 836.15 feet, thence Due East 200 feet, and thence North 45 degrees 6 minutes East a distance of 495 feet from the northwest corner of the southwest quarter of said Seciton 35; thence from said iron pipe, North 29 degrees 24 minutes 32 seconds West for 111.51 feet to an iron pipe; thence South 62 degrees 45 minutes 58 seconds West for 161.96 feet to a point in the south line of Country Club Lane as shown in Plat Book 10, page 182 of the Wayne County Plat Records; thence with the south line of Country Club Lane on a curve to the left for an are distance of 30.36 feet, said curve having a radius of 999.92 feet, a central angle 1 degree 44 minutes 22 seconds, and whose long chord bears North 37 degrees 25 minutes 32 seconds East; thence continuing with the south line of Country Club Lane, North 36 degrees 17 minutes 00 seconds East for Ordinance No. 19-1989 Page 2 9.78 feet to the east line of Greenbrier Drive; thence with the east line of Greenbrier Drive, Due North for 360.60 feet to the southwest corner of Country Club Hills, Fourth Addition as recorded in Plat 10, page 310 of the Wayne County Plat Records; thence with the south line of said Country Club Hills, Fourth Addition, South 89 degrees 35 minutes 20 seconds East for 480.00 feet to an iron pipe at the southeast corner of said Country Club Hills, Fourth Addition; thence South 0 degrees 39 minutes 45 seconds West for 110.21 feet; thence South 45 degrees 12 minutes 35 seconds West for 428.62 feet to the point of beginning; containing 3.258 acres and subject to all easements and restrictions of record. SECTION 2. This Ordinance shall be in full force and effect from and after its passage and approval as by law aquired. SECTION 3. That as a condition of being granted preliminary approval the owner shall at all times comply with the following conditions: A: The Special Use site plan and petition shall be marked exhibit A and made a part of this Ordinance. B. Modifications of the develpment Unit Project requirements and standards setforth in Article 45 of the Zoning Ordinance shall be allowed only in conformance with the approval Special Use site plan. April 27, 1989 Mrs. Sally Hutton, President Members of Common Council Ms. Mary Merchanthouse, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance No. 19-1989 Plan Commission Case PC-89-7 Dear Mrs. Hutton, Members of Common Council, and Ms. Merchanthouse: The Richmond City Plan Commission conducted a public hearing on Tuesday, April 25, 1989, on the petition of Phillip and Judith Stewart, Owners, Kent Klinge, Agent, requesting a rezoning from R-4 Multi -Family Residence District to C-3 Central Business District on property located at 115 South 9th Street. Seven (7) notices of public hearing were sent to surrounding residents. One (1) notice of public hering was returned to the Plan Department in favor of the petition. During the public hearing no one spoke in opposition to the petition. The property in question is presently being used as a cosmetology school and is a legally established non -conforming use. The owners are seeking a change in zoning to place the present use in an appropriate commercial zoning district. Upon the rezoning, the owners intend to construct a new building. The Plan commission voted seven (7) to zero (0) to recommend that Ordinance No. 19-1989 be adopted. Respectfully sued, S. Daniel S.
