HomeMy Public PortalAbout020-1989- APPROPRIATE FROM THE CUMMULATIVE CAPITAL IMPROVEMENT FUNDAPPROPRIATION ORDINANCE NO. 20-1989 AN ORDINANCE TO APPROPRIATE FROM THE CUMULATIVE CAPITAL IMPROVEMENT FUND. WHEREAS, certain extraordinary emergencies have developed since the adoption of the existing annual budget so that it is now necessary to appropriate more money for the various functions of the City Government than was appropriated in the annual budget. NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond, Indiana: SECTION 1. That for the expenses of the City Government and its institutions for the year ending December 31, 1989, the following amount of money is hereby appropriated and set apart out of the fund named and for the purpose specified. Said sum being subject to the law governing the same. Such amount appropriated shall be held to include all expenditures to be made during the year unless expressly stipulated by law. SECTION 2. That for the said fiscal period there is hereby appropriated from the Cumulative Capital Improvement Fund the following specified amount to meet the extraordinary emergency hereby declared to exist: AMOUNT AMOUNT REQUESTED APPROPRIATED CUMULATIVE CAPITAL IMPROVEMENT FUND $69,205.31 $69,205.31 These funds are to be used for tho following: 3000-Other Services & Charges SECTION 3. This Ordinance shall be in full force and effect from and after its passage and approval by the Mayor and is subject to the laws of the State of Indiana governing emergency appropriations. Absent: None The following business was had to -wit: (OTHER BUSINESS HAD) The Clerk presented Proof of Publication of Notice to Taxpayers printed in the Richmond Palladium Item, a newspaper of general circulation in the City of Richmond, Indiana, on the date of April 7, 1989. Said notice stated that a public hearing would be held an the 17th day of April 1989, by the Common Council to consider additional appropriations In excess of the budget for the year 1989 within the City of Richmond, Indiana. The Proof of Publication was examined and found to be in order. Counc€Imember Morris moved the Proof of Publication be received and filed, seconded by Councilmember Elstro and on unanimous voice vote the motion was carried. The Clerk read on second reading Ordinance No. 20-1989. President Hutton announced Ordinance No. 20-1989 was on public hearing. After hearing all persons present, Ordinance No. 20-1989 was placed on final passage or rejection and on a call of the roll the following was recorded: Ayes: Elstro, Lundy, Brookbank, Hankinson, McBride, Morris. Parker, Paust and Hutton Nays: None The vote being 9 to 0 in favor of the passage of Ordinance No. 20-1989. The agreement was entered into with the Indiana Department of Highways for the proposed improvement of Industries Road. At the time of this agreement, Chrysler Corp. was considering the City of Richmond, and that particular location as a possible building site. After that agreement was entered into, Chrysler Corp. decided to locate elsewhere, and at this time there is no other potential plans for that location. After consulting with the City Attorney, Controller and former City Engineer, it is my recommendation that the Board of Public Works vote to discontinue the advancement of this project and repay any federal funds which have been expended for engineering fees to this point. To continue with this project would be extremely costly to the City with little or no benefit at this point in time. If you have any questins, please contact me. One of the provisions of the federal aid highway funding program is to advance all projects toward construction in a reasonable time period. Each project is to advance into the right-of-way acquisition phase within five (5) years from the start of preliminary engineering. our records do not indicate that acquisition of rigbt-of-way has started on this project. If a project cannot be expected to proceed to either right-of-way or construction within a reasonable length of time, it should be withdrawn and Federal Highway Administration (FHWA) be reimbursed those funds you have received. Attached is a computer schedule of the progress of this project to date. Activities completed are indicated by a "C" to the right of the completed date. Activities which have not been completed have a projected date for the completion of that activity. This information is in accordance with our records. Since this project has exceeded the time period of 5 (five) years in advancing to the acquisition of right-of-way, a realistic schedule of time periods must be projected in which the project is expected to advance to right-of-way acquisition and/or construction. Please use the enclosed computer schedule and write in red projected dates for completing all the activities which are not indicated by a "C" at the right side. Using your projected daces the computer schedule will be revised and submitted to FHWA for an extension in the time period of advancing a project. The revised dates must be reasonable or FHWA will not approve such an extension. If this would be your selection, any federal funds expended on the project would have to be repaid. A bill would be sent to you from our Accounting and Control Division for this repayment. Currently your estimated.repayment would be $68,975.29. If you intend to advance this 'project to right-of-way and/or f construction, the attached computer schedule with revised dates and a letter stating your intentions of advancing the project must be returned to our !• office no later than January 31, 1989. If the revised computer schedule and letter is not received by this date, the project will be deobligated with FHWA and a bill will be sent subsequently for repayment of all federal funds expended on the project including incidental engineering and audit costs incurred by the staff of the IDOH.
