AN ORDINANCE TO APPROPRIATE WITHIN THE LAW ENFORCEMENT CONTINUING
EDUCATION/TRAINING FUND.
WHEREAS, it has been determined that it is now necessary to appropriate more money than wa
appropriated in the annual budget:
NOW THEREFORE BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF RICHMOND
WAYNE COUNTY, INDIANA:
SECTION 1. That for the expenses of said municipal corporaion the following additional sum
of money are hereby appropriated.

SECTION 2. That for the expenses of said municipal corporation the following additional sum;
of money are hereby appropriated and set apart out of the fund named and for thf
purposes specified. Said sum being subject to the laws governing the same.

SECTION 3. This Ordinance shall be in full force and effect from and after its passage an(
approval by the Mayor and is subject to the laws of the State of Indiana governinc
emergency appropriations.

TRANSCRIPT OF PROCEEDINGS CERTIFICATE

COUNCIL OF THE CITY OF RICHMOND, INDIANA
The Common Council of the City of Richmond, Indiana, met in regular session in the Council Chambers in
the Municipal Building of said City on April 17, 1989 at the hour of 7:30 P.M.
Councilmember Hutton presided with the following members present:
Councilmembers: Elstro, Lundy, Brookbank, Hankinson, McBride, Parker, Morris, and Paust.
Absent: None
The following business was had to -wit:

The Clerk presented Proof of Publication of Notice to Taxpayers printed in the Richmond Palladium
Item, a newspaper of general circulation in the City of Richmond, Indiana, on the date of April 7,
1989. Said notice stated that a public hearing would be held on the 17th day of April, 1989, by the
Common Council to consider additional appropriations in excess of the budget for the year 1989 within
the City of Richmond, Indiana. The Proof of Publication was examined and found to be in order.
Councilmember Morris moved the Proof of Publication be received and filed, seconded by
Councilmember Elstro and on unanimous voice vote the motion was carried.
The Clerk read on second reading Ordinance No. 24-1989.
President Hutton announced Ordinance No. 24-1989 was on public hearing.
After hearing all persons present, Ordinance No. 24-1989 was placed on final passage or rejection and
on a call of the rail the following was recorded:
Ayes: Elstro, Lundy, Brookbank, Hankinson, McBride, Morris, Parker, Paust and Hutton
Nays: None
The vote being 9 to 0 in favor of the passage of Ordinance No. 24-1989.

The statutory requirements for a local police agency to follow in claiming and receiving their three
dollars (83) per case from fees collected for the Law Enforcement Continuing Education program have
changed at various times since January 1, 1987.
The original legislation (January 1, 1987 to June 30, 1987) authorized claims to be filed two times
each year, June 15 and December 15, for the preceding six month period. Fees were to be transferred
to either the Local Law Enforcement Continuing Education Fund or a Local Police Continuing Education
Fund.

Effective July 1, 1987, a User Fee Fund was created in each city, town, or county with a court. Fees
collected for the Law Enforcement Continuing Education program by the courts must now be placed in
this fund on a monthly basis. hbnthly claims may be submitted to the fiscal body as authorized by IC
33-i9-B-4. Fees claimed and transferred must be placed into a Local Law Enforcement Continuing Educa-
tion Fund on receipt.
Legislation passed by the 1988 General Assembly adds some new conditions for fees collected on or
after July 1, 1988. (1) Claims still may be flied monthly to transfer fees from the User Fee Fund to
the city or town Local Law Enforcement Continuing Education Fund. (2) The new statutes now require
additionally that the claims must be made on the User Fee Fund in the same fiscal year In which the
fees are collected. In other words, fees collected on or after July 1, 1988 must be claimed in 1988.
(PLEASE NOTE: Since It would be difficult to anticipate December collections within December, the
State Board of Accounts is taking the audit position that the July to December, 1988 fees may be
claimed up to January 31,. 1989. We understand legislation will be proposed to correct this timing
problem.) To summarize, fees may be claimed monthly from the User Fee Fund, but they must be claimed
each year by January 31 of the succeeding year. Since the prevailing statutes make no mention of
prior collections, It is presumed this new provision applies only to collections received on or after
July 1, 1988.
