HomeMy Public PortalAbout028-1989- ZONING - EASTSIDE OF THE DRIVE KNOWN AS SOUTH 52ND PLACEORDINANCE NO. 28-1989 AN ORDINANCE GRANTING PRELIMINARY APPROVAL TO A RESIDENTIAL DEVELOPMENT UNIT PROJECT IN A R-4 MULTI -FAMILY RESIDENCE DISTRICT ON PROPERTY LOCATED ON THE EAST SIDE OF THE DRIVE KNOWN AS SOUTH 52ND PLACE, PURSUANT TO ARTICLES 45 AND 48 OF CHAPTER 154 OF THE CODE OF ORDINANCE, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA. WHEREAS, the Zoning Map which is a part of Ordinance No. 2325-1968 designates and describes as R-4 Multi -Family Residence District the property located on the east side of the drive known as South 52nd Place; and, WHEREAS, it is the intent and purpose hereof, pursuant to Articles 45 and 48 of the Zoning Ordinance, to grant preliminary approval of a Residential Development Unit Project on the above said property; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the.2&,,,F day of ,1989, at which time remonstrances were heard from all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Plan Commission was to _in favor of/' recommending the passage of Ordinance No. 28-1989. NOW THEREFORE BE IT ORDAINED BY the Common Council of the City of Richmond, Indiana as follows: SECTION 1. That pursuant to Article 45 and 48 of the Zoning Ordinance, preliminary approval for a Residential Developement Project on the property described below is hereby granted. Being a part of the Southwest Quarter of Section 36, Township 14 North, Range 1 West in the City of Richmond, Wayne County, Indiana, and being more particularly described as follows: Beginning at an iron rod found at the southeast corner of a tract in the name of Parc Lorraine, Section One, as recorded in Deed Records Book 361, page 250 in the office of the Wayne County Recorder, Wayne County, Indiana, and running thence, from said beginning point, north 10 degrees, 12 minutes and 22 seconds west, along the east line of a 45.00 foot wide ingress and egress easement and along the east line of said Parc Lorraine, 275.00 feet to an iron rod set; thence north 79 degrees, 47 minutes and 38 seconds east, 192.00 feet to an iron rod set; thence south 40 degrees, 33 minutes and 11 seconds east, 318.66 feet to an iron rod set; thence south 79 degrees, 47 minutes and 38 seconds west, 353.00 feet to the place of beginning, containing an area of 1.720 acres. Ordinance No. 28-1989 Page 2 SECTION 2. That as a condition of being granted preliminary approval the owner shall at all times comply with the following conditions: A. The Special Use site plan and petition shall be marked Exhibit A and made a part of this Ordinance. B. Modifications of the develpment Unit Project requirements and standards setforth in Article 45 of the Zoning Ordinance shall be allowed only in conformance with the approval Special Use site plan. SECTION 3. This Ordinance shall be in full force and effect from and after its passage and approval as by law aquired. Mayor ATTEST: City Cl rk CITY PLAN COMMISSION RICHMOND, INDIANA June 5, 1989 Mrs. Sally Hutton, President Members of Common Council and Mrs. Mary Merchanthouse, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance No. 28-1989 Plan Commission Case PC-89-10 Dear Mrs. Hutton, Members of Common Council and Mrs. Merchanthouse: The Richmond City Plan Commission conducted a public hearing on Tuesday, May 23, 1989, on the petition of Richmond Industrial Center, Inc., owner, Ronald W. Morton, agent, requesting preliminary approval for a residential development unit project on property located in the 100 block of South 52nd Place on the east side. The proposed residential development unit project consists of twenty-one (21) dwelling units to be located in five (5) buildings. The project will be administered by Dunn Center and is designed to serve elderly and handicapped tennants. The petition for the project also requests that the requirements pertaining to off-street parking be modified to reduce the number of spaces from 25 to 15. The petition indicates that 15 spaces will be sufficient to serve the needs of the elderly and handicapped tennants. Six (6) notices of public hearing were sent to the surrounding residents with none returned to the Plan Department. During the public hearing Ms. Rose Russell, manager of the Pare Lorraine Apartments, spoke of Parc Lorraines' concerns about the number of parking spaces proposed to be provided for the project. Ordinance No. 28-1989 Page 2 The Plan Commission determined that the petition complies with the requirements of Zoning Ordinance in all aspects, with the exception of the number of parking spaces to be provided. The Commission determined there is justification to grant the requested modification and voted six (6) to zero (0) to recommend that Ordinance No. 28-1989 be adopted.
