HomeMy Public PortalAbout036-1989-ZONING - 1900BLK OF STRAIGHTLINE PIKE ON THE WESTSIDEORDINANCE NO. 36 -1989 AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO.2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING OF PROPERTY LOCATED IN THE 1900 BLOCK OF STRAIGHTLINE PIKE ON THE WEST SIDE, FROM R-2 SINGLE FAMILY RESIDENCE DISTRICT TO C-2 COMMERCIAL DISTRICT. WHEREAS, the Zoning Map which is a part of Ordinance No. 2325-1968 designates and describes as R-2 Single Family Residence District the property located in the 1900 block of Straightline Pike, on the west side; and, WHEREAS, it is the intent and purpose hereof, to change the zoning classification of said property from R-2 Single Family Residence District to C-2 Commercial District; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the .day of ____,1989, at which time remonstrances were heard from all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Plan Commission was to —in favor of/in opposition to recommending the passage of Ordinance No. 36-1989. NOW THEREFORE BE IT ORDAINED BY the Common Council of the City of Richmond, Indiana as follows: SECTION 1. That the zoning classification of the property described below, and the same is hereby changed to C-2 Commercial District and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana and all amendments thereto. A tract of land located in the Southeast Quarter Section of Section Eight (8), Township Thirteen (13) North, Range One (1) West, in the City of Richmond, Wayne County, Indiana, and more particularly described as follows: Beginning at the southeast corner of the Southeast Quarter of Section Eight (8); thence North, along the East line of said Section Eight (8), four Hundred thirty-two feet (432.0); thence West two hundred seven (207.0) feet to the east right-of-way line of U.S. Highway 27; thence Southwestwardly on a 0 degree 59' curve on the east right-of-way line of said U.S. Highway 27 and the West line of this tract four hundred thirty-four (434.0) feet to the south line of Section Eight (8); thence East two hundred and seventeen and fifty-four hundredths (217.54) feet to the point of beginning. Containing two and fifteenths (2.15) acres, more or less. Ordinance No. 36-1989 Page 2 SECTION 2. Nineteen (19) notices of public hearing were sent to the surrounding residents with ten (10) returned in opposition to the request and three (3) returned not opposed. During the public hearing, several neighborhood residents spoke in opposition to the petition citing their concerns about the lowering of area property values, increased traffic congestion in the area and storm drainage and sanitary sewer problems in the area. The Plan Commission determined that the C-2 Zoning District would not provide for the highest and best use of the subject property. The Commission voted seven (7) to three (3) to recommend that Ordinance No. 36-1989 be denied. Respectfully, submitted, Daniel S.
