HomeMy Public PortalAbout039-1989-ZONING - SOUTHSIDE OF SOUTH L ST IN THE 1800BLKORDINANCE NO. 39-1989 AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO.2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING OF PROPERTY LOCATED ON THE SOUTH SIDE OF SOUTH L STREET, IN THE 1800 BLOCK, FROM R-2 SINGLE FAMILY RESIDENCE DISTRICT TO R-4 SU MULTI -FAMILY RESIDENCE SPECIAL USE DISTRICT; AND ALSO AUTHORIZING THE SPECIAL USE OF SAID PROPERTY AS A RESIDENTIAL DEVELOPMENT UNIT PROJECT. WHEREAS, the Zoning Map which is a part of Ordinance No. 2325-1968 designates and describes as R-2 Single Family Residence District the property located on the south side of South L Street in the 1800 block; and, WHEREAS, it is the intent and purpose hereof to change the zoning classification of said property from R-2 Single Family Residence District to R-4 SU Multi -Family Residence Special Use District and to authorize the special use of said property as a residential development unit project; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the day of ,1989, at which time remonstrances were heard from al part es interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Plan Commission was Y to 0 __in favor of/i recommending the passage of Ordinance No. 39-1989. NOW THEREFORE BE IT ORDAINED BY the Common Council of the City of Richmond, Indiana as follows: SECTION 1. That the zoning classification of the property described below, and the same is hereby changed to R-4 SU Multi -Family Residence Special Use District, and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana and all amendments thereto. A part of the Northeast Quarter of Section 9 Township 13 North, Range I West, in the City of Richmond, Wayne County, Indiana, described as follows: Commencing at the northwest corner of said quarter section; thence North 89 degrees 15 minutes 00 seconds East 180.00 feet along the north line of said section; thence South 0 degrees 03 minutes 00 seconds East 550.92 feet to the point of beginning of this description; thence South 89 degrees 59 minutes 57 seconds East 995.70 feet; thence south 0 degrees 24 minutes 42 seconds East 575.00 feet; thence North 90 degrees 00 minutes 00 seconds West 999.33 feet; thence North 0 degrees 03 minutes 00 seconds West 575.00 feet to the point of beginning and containing 13.167 acres, more or less. That as provided in Articles 23, 45 and 48 of Chapter 154 of the Code of Ordinances, the following described use of the above described property is allowed as a residential development unit project. SECTION 3. That as a condition of being granted the special use and as an additional restriction on said use, the following requirements shall hereafter and at all times be met by the owner of said real estate. A. The Special Use site plan and petition shall be marked Exhibit A and made a part of this Ordinance. B. The owner shall dedicate right-of-way to be used as a public street as indicated on the special use site plan. SECTION 4. This Ordinance shall be in full force and effect from and after its passage and approval as by law aquired. Location: East of South 16th Street on the south side of South L Street in approximately the 1800 block CITY PLAN COMMISSION RICHMOND, INDIANA June 29, 1989 Mrs. Sally Hutton, President Members of Common Council and Ms. Mary Merchanthouse, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance No. 39-1989 Plan Commission Case PC-89-13 Dear Mrs. Hutton, Members of Common Council and Ms. Merchanthouse: The Richmond City Plan Commission conducted a public hearing on Tuesday, June 27, 1989, on the petition of Wernle Children's Home of the American Lutheran Church, Owner, Rick Freeman, Agent, requesting a rezoning from R-2 Single Family Residence District to R-4SU Multi -Family Residence Special Use District and also requesting final approval and special use authorization for a residential development unit project on property located on the south side of South L Street in the 1800 block. The proposed project consists of 100 dwelling units to be constructed in eight (8) buildings. The dwelling units are proposed to be available to low income families. Twenty-one (21) notices of public hearing were sent to the surrounding residents with one (1) returned in opposition to the petition. During the public hearing, no one spoke in opposition to the request. The Plan Commission determined that the project complies with the approved preliminary plan and complies with the requirements of the Zoning Ordinance.
