HomeMy Public PortalAbout040-1989-ZONING - EASTSIDE OF SOUTH 52ND PLACE IN THE 100BLKAMENDED ORDINANCE NO. 40 -1989 AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO.2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING OF PROPERTY LOCATED ON THE EAST SIDE OF SOUTH 52ND PLACE, IN THE 100 BLOCK, FROM R-4 MULTI -FAMILY RESIDENCE DISTRICT TO R-4 SU MULTI -FAMILY RESIDENCE SPECIAL USE DISTRICT; AND ALSO AUTHORIZING THE SPECIAL USE OF SAID PROPERTY AS A RESIDENTIAL DEVELOPMENT UNIT PROJECT. WHEREAS, the Zoning Map which is a part of Ordinance No. 2325-1968 designates and describes as R-4 Multi -Family Residence District the property located on the east side of South 52nd Place; and, WHEREAS, it is the intent and purpose hereof to change the zoning classification of said property from R-4 Multi -Family Residence District to R-4 SU Multi -Family Residence Special Use District and to authorize the special use of said property as a residential development unit project; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the 22a day of ,1989, at which time remonstrances were heard from aff parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Plan Commission wasJto d_in favor of/' recommending the passage of Amended Ordinance No. 40 -1989. NOW THEREFORE BE IT ORDAINED BY the Common Council of the City of Richmond, Indiana as follows: SECTION 1. That the zoning classification of the property described below, and the same is hereby changed to R-4 SU Multi -Family Residence Special Use District, and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana and all amendments thereto. Being a part of the Southwest Quarter of Section 36, Township 14 North, Range 1 West in the City of Richmond, Wayne County, Indiana, and being more particularly described as follows: Beginning at an iron rod found at the southeast corner of a tract in the name of Parc Lorraine, Section One, as recorded in Deed Records Book 361, page 250 in the office of the Wayne County Recorder, Wayne County, Indiana, and running thence, from said beginning point, north 10 degrees, 12 minutes and 22 seconds west, along the east line of a 45.00 foot wide ingress and egress easement and along the east line of said Parc Lorraine, 275.00 feet to an iron rod set; thence north 79 degrees, 47 minutes and 38 seconds east, 192.00 feet to an iron rod set; thence south 40 degrees, 33 minutes Amended Ordinance No. 40-1989 Page 2 and 11 seconds east, 318.66 feet to an iron rod set; thence south 79 degrees, 47 minutes and 38 seconds west, 353.00 feet to the place of beginning, containing an area of 1.720 acres. SECTION 2. That as provided in Articles 23, 45 and 48 of Chapter 154 of the Code of Ordinances, the following described use of the above described property is allowed as a residential development unit project. SECTION 3. That as a condition of being granted the special use and as an additional restriction on said use, the following requirements shall hereafter and at all times be met by the owner of said real estate. A. The Special Use site plan and petition shall be marked Exhibit A and made a part of this Ordinance. B. The owner shall dedicate the right-of-way of South 52nd Street for use as a public street. C. The site drainage plan for the development unit project shall be approved by the City Engineer's office. D. The provision of sanitary sewers to the development unit project shall be subject to the approval of the Richmond Sanitary District. SECTION 4. This Ordinance shall be in full force and effect from and after its passage and approval as by law aquired. Mayor ATTEST: City Clerk CITY PLAN COMMISSION RICHMOND, INDIANA June 29, 1989 Mrs. Sally Hutton, President Members of Common Council and Ms. Mary Merchanthouse, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance No. 40-1989 Plan Commission Case PC-89-14 Dear Mrs. Hutton, Members of Common Council and Ms. Merchanthouse: The Richmond City Plan Commission conducted a public hearing on Tuesday, June 27, 1989, on the petition of Richmond Industrial Center, Inc., Owner, Ronald W. Morton, Agent, requesting a rezoning from R-4 Multi Family Residence District to R-4SU Multi -Family Residence Special Use District and also requesting final approval and special use authorization for a residential development unit project on property located on the east side of South 52nd Street in the 100 block. The proposed project consists of 21 dwelling units to be constructed in five (5) buildings. The dwelling units are proposed to be available to handicapped and elderly tennants. Six (6) notices of public hearing were sent to the surrounding residents with nonen returned. During the public hearing, no one spoke in opposition to the request. The Plan Commission determined that the project complies with the approved preliminary plan and complies with the requirements of the Zoning Ordinance. The Commission also determined that Section No. 3 of Ordinance No. 40-1989 should be amended to read as follows: A. The Special Use site plan and petition shall be marked Exhibit A and made a part of this Ordinance. B. The owner shall dedicate the right-of-way of South 52nd Street for use as a public street. C. The site drainage plan for the development unit project shall be approved by the City Engineer's office. D. The provision of sanitary sewers to the development unit project shall be subject to the approval of the Richmond Sanitary District.
