HomeMy Public PortalAbout058-1989-VACATION- PORTION OF AN ALLEY RUNNING SOUTH OFF OF NORTH A ST BETWEEN NORTH 15TH AND 16TH STBOOK 16PAGE 15 AMENDED ORDINANCE NO. 58-1989 AN ORDINANCE VACATING A CERTAIN PUBLIC WAY WITHIN THE CITY OF RICHMOND, INDIANA, BEING THAT PORTION OF AN ALLEY RUNNING SOUTH OFF OF NORTH A STREET BETWEEN NORTH 15TH AND NORTH 16TH STREETS. WHEREAS, Frederick A. Adelsperger, Lee Overdorf and June Overdorf have petitioned the Common Council of the City of Richmond, requesting to vacate the alley running south off of North A Street between North 15th and North 16th Streets; and, WHEREAS, the Common Council, pursuant to the provisions of I.C. 36-7-3- 12, conducted a public hearing on said vacation petition on -16 5 ,1989; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission on the ,2nAay of Q.0 1989, at which time remonstrances were heard from all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Plan Commission was to to 6 in favor of/ieesite recommending passage of Amended Ordinance No. 58-1989. NOW THEREFORE BE ORDAINED by the Common Council of the City of Richmond, Indiana as follows: SECTION 1. That subject to the preservation of all easements for existing utilities, the public way described below is hereby vacated. Being a 10.00 foot wide alley in Lots 585 and 586 in Elizabeth's Starr's Addition running north and south between North A Street and a 20.00 foot wide east and west alley between North 15th Street and North 16th Street, to be vacated and being more particularly described as follows: Beginning at a "T" cut in the northeast corner of said alley to be vacated, said point being, 110.00 feet east of the northwest corner of Lot 586 in Elizabeth Starr's Addition, and runing thence, from said beginning point, south,along the east line of said alley to be vacated and parallel to the west line of said Lot 586 and 585, 100.00 feet to a point in the north line of said 20.00 foot wide east and west alley and being the southeast corner of said alley to be vacated; thence west, along the north line of said east and west alley, 10.00 feet to the southwest corner of the alley to be vacated; thence north, along the west line of said alley to be vacated and parallel to the west line of said Lots 585 and 586, 100.00 feet to the northwest corner of said alley to be vacated and a point in the south line of North "A" Street, thence east, along the south line of North "A" Street, 10.00 feet to the place of beginning. SECTION 2. This Ordinance shall be in full force and effect from and after the passage and approval as by law required. Adelsperger and Lee and June Overdorf, owners; George Sowers, agent requesting the vacation of the dedicated right-of-way of a 10' alley running south off of North A Street between North 15th and North 16th Streets. Eight (8) notices of public hearing were sent to the surrounding residents with seven (7) returned in favor of the request. During the public hearing, no one spoke in opposition to the request. During the public hearing, the petitioner requested that the petition be amended by adding a legal description of the alley proposed to be vacated. The Plan Commission voted to accept the amendment to the petition. The Plan Commission determined the public right -of way is nolonger needed for the future growth and development of the City. The Commission voted ten (10) to zero (0) to recommend that Ordinance No. 58-1989 be amended by incorporating the alley's legal description into Section 1. of the Ordinance and upon that amendment the Ordinance be adopted.
