HomeMy Public PortalAbout064-1989- ZONING- SOUTHSIDE OF SOUTH L ST IN THE 1800BLKORDINANCE NO. 64 -1989 AN ORDINANCE REPEALING ORDINANCE NO. 39-1989 AND AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO.2325 -1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING OF PROPERTY LOCATED ON THE SOUTH SIDE OF SOUTH L STREET, IN THE 1800 BLOCK, FROM R-2 SINGLE FAMILY RESIDENCE DISTRICT TO R-4 SU MULTI -FAMILY RESIDENCE SPECIAL USE DISTRICT; AND ALSO AUTHORIZING THE SPECIAL USE OF SAID PROPERTY AS A RESIDENTIAL DEVELOPMENT UNIT PROJECT. WHEREAS, the legal description written in Section 1. of Ordinance No. 39- 1989 is in error; and, WHEREAS, the Zoning Map which is a part of Ordinance No. 2325-1968 designates and describes as R-2 Single Family Residence District the property located on the south side of South L Street in the 1800 block; and, WHEREAS, it is the intent and purpose hereof to repeal Ordinance No. 39- 1989 and to change the zoning classification of the property described below from R-2 Single Family Residence District to R-4 SU Multi -Family Residence Special Use District and to authorize the special use of said property as a residential development unit project; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the a 5 day of Qu_ _,1989, at which time remonstrances were heard from all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Plan Commission was �- to_ O in favor of/i recommending the passage of Ordinance No. 64 -1989. NOW THEREFORE BE IT ORDAINED BY the Common Council of the City of Richmond, Indiana as follows: SECTION 1. That Ordinance No.39-1989 is hereby repealed and that the zoning classification of the property described below, and the same is hereby changed to R-4 SU Multi -Family Residence Special Use District, and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana and all amendments thereto. Being a part of the Northeast Quarter of Section 9, Township 13 North, Range 1 West in the City of Richmond, Indiana, and being more particularly described as follows: Beginning at an iron rod set, said point being more particularly described as follows: Commencing at the northwest corner of the Northeast Quarter of said Seciton 9, and running thence, north 89 degrees, 13 minutes, and 00 ORDINANCE NO. 64-1989 PAGE 2 seconds east, along the north line of said Northeast Quarter, 180.00 feet to a railroad spike set; thence south 0 degrees, 03 minutes, and 05 seconds east, parallel to the west line of said Northeast Quarter, 404.66 feet to the beginning point of this description, and running thence, from said beginning point, north 89 degrees, 13 minutes, and 00 seconds east, parallel to the north line of said Northeast Quarter, 996.13 feet to an iron rod set; thence south 0 degrees, said Northeast Quarter, 470A0 feet to an iron rod set; thence south 89 degrees, 13 minutes, and 00 seconds west, parallel to the north line of said Northeast Quarter, 995.90 feet to an iron rod set; thence north 0 degrees, 03 minutes, and 05 seconds west, parallel to the west line of said Northeast Quarter, West, parallel to the west line of said Northeast Quarter, 470.00 feet to the place of beginning, containing an area of 10.746 acres. SECTION 2. That as provided in Articles 23, 45 and 48 of Chapter 154 of the Code of Ordinances, the following described use of the above described property is allowed as a residential development unit project. SECTION 3. That as a condition of being granted the special use and as an additional restriction on said use, the following requirements shall hereafter and at all times be met by the owner of said real estate. A. The Special Use site plan and petition shall be marked Exhibit A and made a part of this Ordinance. B. The owner shall dedicate right-of-way to be used as a public street as indicated on the special use site plan. SECTION 4. This Ordinance shall be in full force and effect from and after its passage and approval as by law aquired. CITY PLAN COMMISSION RICHMOND, INDIANA August 31, 1989 Mrs. Sally Hutton, President Members of Common Council and Mrs. Mary Merchanthouse, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance No. 64-1989 Plan Commission Case PC-89-20 Dear Mrs. Hutton, Members of Common Council and Mrs. Merchanthouse: The Richmond City Plan Commission conducted a public hearing on Tuesday, August 29, 1989, on the petition of Wernle Children's Home of the American Lutheran Church, owner, Freeman Planning and Design, agent, requesting a rezoning from R-2 Single Family Residence District to R-4SU Multi -Family Residence Special Use District; and also requesting special use authorization for a residential development unit project on property located in the 1800 block of South L Street, on the south side. The proposed residential development unit project consists of one hundred (100) dwelling units to be located in eight (8) buildings. The project will be designed to serve low and moderate income families as tennants. Common Council and the Plan Commission have already considered and approved the proposed project with the adoption of Ordinance No. 39-1989. Subsequent to the adoption of Ordinance No. 39- 1989, the property owner and developer determined that the project site should be relocated approximately 200' to the north. This relocation renders the legal description contained in Ordinance No. 39-1989 to be incorrect. Ordinance No. 64-1989, if adopted, would repeal Ordinance No. 39-1989 and would approve the project on the new site. During the public hearing no one spoke in opposition to the petition. The Plan Commission determined that the requested relocation of the site does not alter the original basis for approval of the project.
