Type A sediment barriers have been installed where Type C is required and shown on the permit drawings. As shown on the attached plans, the applicant is proposing to elevate the existing fixed deck 3 feet above its current height in order to clear the dune field underneath, and replace ramps and steps as needed in order to maintain access to the beach. After elevating the existing deck, the applicant proposes to downsize the deck to a 14' x 14' area based on the original deck plans that were approved in a Shore Protection Act (SPA) permit on March 26, 1998. In order to address the property owner's concerns about sufficient access to the beach and potential impacts to the sand dunes, the new ramps and walkways will maintain their current 5 -foot wide footprint to and from the deck. Again, please see the attached deck plans for further details. The sand dune is accreting at this location and portions of the existing structure are impacting the dynamic dune field. The proposed project involves raising the existing deck, the addition of stairs to provide access from the existing walkways and replacement of existing handrails and support pilings as needed. The project will begin no sooner than 15 days from the date of this letter and be completed no later than December, 2013. As proposed, the project scope includes constructing an elevated 14' X 14' deck that is 3' above the grade of the existing sand dune. The existing landward walkway measures 187' X 5' and the existing seaward walkway measures 16'6" X 5'. Stairs will be constructed on either side of the newly elevated deck, within the footprint of the existing walkways. The proposed project also includes the replacement of existing handrails and support pilings as necessary. There will be no excavation of the existing structure. Hand tools will be used to cut existing timbers at grade and portions of the seaward walkway that are buried under the dune field will remain undisturbed. The Department authorizes the proposed project as depicted above and in the attached Plan and Description provided all Best Management Practices (BMPs) be used. All work must be accomplished using hand tools only. The proposed project can commence no sooner than 15 - days after the date of this letter. This Letter of Permission is not meant to exempt the above referenced activity from future environmental laws. No equipment, materials or debris may be placed, disposed of, or stored in jurisdictional areas. Any incidental impacts associated with this project must be rectified by fully restoring areas to their pre -construction topographic and vegetative states. This LOP is valid for the above referenced project. Any change in the use, location, dimensions, or configuration of the approved project, without prior notification and approval from this office could result on the revocation of this permission and in the required removal of the materials and related structures.
