HomeMy Public PortalAbout08-08-2013THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF RICHMOND, INDIANA, AUGUST 8, 2013 The Board of Public Works and Safety of the City of Richmond, Indiana, met at 5:00 P.M., Thursday, August 8, 2013, in the Council Chambers at the Municipal Building, 50 North 5th Street, Richmond, Indiana. President Robinson called the meeting to order and the following business was conducted: ROLL CALL Present were: Vicki Robinson and Dian Lawson. Absent was Tony Foster. Also in attendance were Assistant City Attorney Kim Vessels, City Clerk Karen Chasteen, Tom Cannon, Bruce Oesterling, Building Commissioner; Dave Burns; Dave Mears, Milestone; Lt. Rod Cole, Traffic Division; Tracy Bosell, Street Superintendent; Sue Roberson, Human Resources; Sarah Waddle, Department of Sustainability — Earlham College; and, Media. APPROVAL OF MINUTES The Minutes were held for approval on August 15, 2013. CLAIMS FOR PAYMENT Ms. Lawson moved to approve the claims for payment for August 9, 2013 in the amount of Two Hundred Fifty One Thousand One Hundred Twenty Dollars and thirty four cents ($251,125.34) with a second by Ms. Robinson. Upon a vote viva voce, the motion carried. REQUESTS STREET CLOSURE AND TRAFFIC CONTROL CYCLING & FITNESS WAREHOUSE Mini - Marathon - Start and finish at Reid Hospital August 24, 2013 — 6:30 — 12 Noon Ms. Lawson moved to approve, supported by Ms. Robinson. Upon a vote viva voce, the motion carried. STREET CLOSURE NATCO COMMUNITY EMPOWERMENT CENTER Grand Opening — South 17th Street adjacent to 1627 East Main Street August 9, 2013 — 3:00 — 6:00 pm Ms. Lawson moved to approve, supported by Ms. Robinson. BID OPENINGS STREET MILLING /PAVING PHASE 3 One bid was received from Milestone Paving: Project No. 1: Project No. 2: Project No. 3: Project No. 4: Project No. 5: Project No. 6: Additional Milling: $ $113,370.30 $127,149.12 $ 61,107.70 $ 18,172.48 $22,091.97 $ 4,687.20 — Airport 1.40 sq /yd This bid was referred to the Street Department for due diligence. CONTRACTS CONTRACT NO. 108 -2013 — TOSCHLOG EXCAVATING Demolition of a structure located at 310 North 3 I Street $4,200.00 Board of Works Minutes August 8, 2013 Page 3 of 4 Ms. Lawson moved to approve, supported by Ms. Robinson. Upon a vote viva voce, the motion carried. CONTRACT NO. 115 -2013 - Memorandum of Understanding — Earlham College - Civic Engagement Ms. Lawson moved to approve, supported by Ms. Robinson. Upon a vote viva voce, the motion carried. Ms. Lawson moved to authorize Sue Roberson to sign Contract No. 115 -2013, supported by Ms. Robinson. Upon a vote viva voce, the motion carried. CONTRACT NO. 116 -2013 — Memorandum of Understanding Earlham College - Sustainable Community Initiative Ms. Lawson moved to approve, supported by Ms. Robinson. Upon a vote viva voce, the motion carried. CONTRACT NO. 117 -2013 — Contribution Agreement Economic Growth Group — re Unsafe Buildings $100,000.00 Ms. Lawson moved to approve, supported by Ms. Robinson. Upon a vote viva voce, the motion carried. CONTRACT NO. 118 -2013 — Memorandum of Understanding Re Unsafe Buildings $1,000 /month to David Burns to assist with inspection of exterior maintenance issues. Ms. Lawson moved to approve, supported by Ms. Robinson. Upon a vote viva voce, the motion carried. ADDENDUMS None RESOLUTIONS None PETITIONS None HEARING APPEAL BY PETITIONER TERRY L. ROBINSON, TRADEMARK CONSTRUCTION, LLC. of a fine issued in connection with work done at 2698 US 35 North, Richmond, IN This hearing is an appeal by the Petitioner Terry L. Robinson, Owner, Trademark Construction, LLC, verses the City concerning a fine issued in connection with work done at 2698 US 35 North. President Vicki Robinson called the hearing to order and noted for the minutes that two (2) board members and legal counsel were present. She went on to explain how the hearing was to be conducted. Board Counselor Vessels explained that this hearing was being legally held by Indiana Law. All parties who were to testify on behalf of both Petitioner and Respondent were sworn in by Board of Works Minutes August 8, 2013 Page 4 of 4 the City Clerk. They included Bruce Oesterling, Building Commissioner; Terry Robinson and Mike Frame, Trademark Construction; and Mike Schwab, Brooks and Schwab Plumbing. After presentation of the evidence, cross examination, and closing statements, Board Member Lawson moved to take the matter under advisement with a second by President Robinson. The motion was unanimously passed. There are copies of the documents and a recording on file of these proceedings.
