AN ORDINANCE OF THE CITY OF TEMPLE CITY
AMENDING THE TEMPLE CITY ZONING CODE
RELATING TO ADULT BUSINESSES
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES ORDAIN:
SECTION 1. The City Council of the City of Temple City
does hereby find, determine and declare:
(a) That the Planning Commission has heretofore
determined that it is in the public interest, conve-
nience and necessity to add the hereinafter specified
provisions relating to adult businesses to the Temple
City Zoning Code;
(b) That the Planning Department of this City
has indicated that the present controls relating to
the appropriate zoning of "adult businesses" are in-
adequate to meet the special conditions relating to
such uses, including problems relating to litter,
traffic, parking, hours of operation, noise, conges-
tion, public nuisance, depreciation of property values,
confrontations, and other matters relating to the
public health, safety and welfare;
(c) That the existing provisions of the Temple
City Zoning Code do not so provide; and
(d) That the - public interest, convenience and
necessity require the amendment of the Temple City
Zoning Code in the manner hereinafter set forth.
SECTION 2. Part XIVA is hereby added to the Temple City
Zoning Code reading as follows:
Part XIVA - Prohibitions.
"9455-. Prohibition of Adult Businesses.
A. An "adult business" is hereby defined
as any business which is conducted exclusively for
the patronage of adults, from the premises of which
minors and specifically excluded by law, or person
in possession. There shall be excluded from such
definition all activities preempted by State law.
B. "Adult businesses" are prohibited uses
and shall not be permitted in the City.
C. In the event the prohibition provided by
subparagraph B is held by any Court of competent
jurisdiction to be invalid, then such prohibition
shall aply only to those locations situated within
200 feet of any property zoned or used for residen-
tial purposes.
D. In the event any prohibition provided in
subparagraph C is held by any Court of competent
jurisdiction to be invalid or inapplicable, then
such use or uses shall be ipso facto, immediately,
and automatically classified as a conditional use
requiring a Conditional Use Permit pursuant to the
provisions of the Zoning Code of this City."

SECTION 3. The City Clerk of the City of Temple City
shall certify to the passage and adoption of this Ordinance
and to its approval by the Mayor and shall cause the same
to be published in the Temple City Times, a newspaper of
general circulation, printed, published, and circulated in
the City of Temple City.

nance, being Ordinance No. 76 -432 , was introduced at a
regular meeting of the City Council of the City of Temple
City, held on the 17th day of February , 1976, and
was duly passed, approved and adopted by said Council,
approved and signed by the Mayor and attested by the City
Clerk at a regular meeting of the said City Council held on
the 2nd day of March , 1976,. by the following
vote:
