HomeMy Public PortalAbout078-1989- ORDINANCE TO ANNEX TO THE CITY CERTAIN CONTIGUOUS TERRITORY ADJACENT AND ABUTTINGROOIS TIM SPECIAL ORDINANCE NO. 78-1989 AN ORDINANCE TO ANNEX TO THE CITY OF RICHMOND, INDIANA CERTAIN CONTIGUOUS TERRITORY ADJACENT AND ABUTTING THERETO, DESCRIBING THE SAME, PROVIDING FOR THE PUBLICATION THEREOF, FIXING THE TIME WHEN THE SAME SHALL TAKE EFFECT AND ASSIGNING SAID TERRITORY TO A COUNCILMANIC DISTRICT IN THE CITY OF RICHMOND, INDIANA. WHEREAS, Alton W. and Mary P. Hodgin, John A. and Beverly A. Hodgin, Mary Brenneman and Anna Carter, being the owner's of record of a certain parcel of land, all being within the hereinafter described area, have petitioned the Common Council of the City of Richmond, for the voluntary annexation of said hereinafter described area as set out, and in accordance with 1C-36-4-3-5; and, WHEREAS, the petitioners own one hundred percent (100%) of the land sought to be annexed; and, WHEREAS, the land to be annexed is contiguous and adjacent to the present boundary of the City of Richmond, Indiana; and, WHEREAS, a study of this Ordinance was conducted by the Common Council the 20th day of November, 1989, at which time comments where heard from parties interested in or affected by this Ordinance. NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond, Indiana as follows: SECTION 1. That the following described territory, adjacent to the corporate boundaries of the City of Richmond, Indiana, be annexed to and hereby is declared to be a part of the said City of Richmond, Indiana; said territory being located in Wayne Township, Wayne County, Indiana and being more particularly described as follows: Located in the southeast quarter of Section 3, Township 13 North, Range 1 West, Wayne Township, Wayne County, Indiana, being part of the land conveyed to Alton W. Hodgin, et al, by deed recorded in Deed Book 357, page 492, all of the land conveyed to Alton W. and Mary P. Hodgin by deeds recorded in Deed Book 258, page 167 and Deed Book 387, page 28, and all of the land conveyed to John A. and Beverly A. Hodgin by deed recorded in Deed Book 442, page 413, all deeds of the Wayne County Deed Records, and being more particularly described as follows: Beginning at a railroad spike found at the southeast corner of said section 3 and in the centerline of Hodgin Road; thence with the south line of said Section 3 and the centerline of Hodgin Road, North 89 degrees 38 minutes 05 seconds west for 1,409.18 feet to a railroad spike found at the southeast corner of Woodgate, Section 3 Subdivision as recorded in Plat Book BOOK JPPac(�.� Special Ordinance No. 78-1989 Page 2 14, page 81 of the Wayne County Plat Records; thence with the east line of Woodgate, Section 3, North 0 degrees 29 minutes 43 seconds east for 988.54 feet to the northeast corner of said Woodgate, Section 3; thence south 89 degrees 41 minutes 39 seconds east for 1,406.85 feet to a point in the east line of said Section 3; thence with the east line of said Section 3 , south 0 degrees 21 minutes 37 seconds west for 990.00 feet to the point of beginning; and containing 31.977 acres. SECTION 2. That this Ordinance shall be in full force and effect from and after its passage, approval and publication as by law required. SECTION 3. That upon the effective date of the annexation of the territory described above, said territory shall be assigned to and become a part of Councilmanic District 4 in the City of Richmond, Indiana. Hodgin, Mary Brenneman and Anna Carter, hereby petition the Common Council of the City of Richmond, Indiana, for the annexation of certain real estate presently situated outside and adjacent to the corporate boundaries of the City of Richmond, Indiana, as follows: (1) The real estate consists of a total of thirty one and nine hundred seventy-seven thousandths (310977) acres and is adjacent to the corporate boundaries of said City of Richmond, Indiana. The description of said real estate and the terms and conditions requested to be applicable to said annexation are all as more fully described in the proposed annexation ordinance no. 1989 attached hereto and made a part hereof. (2) The petitioners own one hundred percent (100%) of the land sought to be annexed and request the adoption and passage of said special ordiance in accordance with the statutes of the State of Indiana, particularly IC 36-4-3-5. The Common Council of the City of Richmond, Indiana, met in regular session in the Council Chambers in the Municipal Building of said City on November 20, 1989 at the hour of 7:30 P.M. Councilmember Hutton presided with the following members present: Councilmembers: Elstro, Lundy, Brookbank, Hankinson, McBride, Parker, Morris, and Paust. Absent: None The following business was had to -wit: (OTHER BUSINESS HAD) The Clerk presented Proof of Publication of Notice to Taxpayers printed in the Richmond Palladium Item, a newspaper of general circulation in the City of Richmond, Indiana, on the date of nd of 1989. Said notice stated that a public hearing would be held on the day of 1989, by the Common Council to consider additional appropriations in excess of the budget for the year 1989 within the City of Richmond, Indiana. The Proof of Publication was examined and found to be in order. Councilmember moved the Proof of Publication be received and filed, seconded by Councilmember and on unanimous voice vote the motion was carried. The Clerk read on second reading Ordinance No. 79-1989. President Hutton announced Ordinance No. 79 -1989 was on public hearing. After hearing all persons present, Ordinance No. 79-1989 was placed on final passage or rejection and on a call of the roll the following was recorded: Ayes: Lundy, Brookbank, Hankinson, McBride, Parker, Morris, Paust and Hutton Nays: Elstro Absent: The vote being 8 to 1 in favor of the passage of Ordinance No. 79-1989, (OTHER BUSINESS HAD) There being no further business, on a motion duly made, seconded and passed the meeting was adjourned. /s/ Sarah L.
