The regular meeting of Town Council was held today at 3 P.M. in the Council Room in the Town Hall and was attended by Mayor James A. Brown, who pres,ded, and Councilmen Fleetwood, Hornstein, Lovell, Waters, Hosti, Town Attorney Solms,..Lt. Price, Supt. Reed, Jos. Petty, Jim Sheppard, Mr. Robt Schneider and the Rev. H. Wellmeier. Reverend Wellmeier opened the meeting with prayers. The minutes of the meeting of December 16, 1964 were read and adopted. The Mayor informed Council that M[r. Jos. Mathews had discussed with him opening part of llth Street to get to a lot recently putchased by him, West of 5th Avenue. Eleventh Street has a ditch through a portion of it. Mr. Mathews asked that the ditch be closed and that a storm drainage line of pipe be installed and the ditch covered. The Mayor informed Mr. Mathews that the Town could not issue a building permit for that area as the Town could not furnish sewerage facilities in that area and suggested that he check with the Health Department. Councilman Hosti stated that a permit should not be issued and also that the ditch should not be closed. The Mayor stated that he should be required to present a set of plans and a plot plan. Councilman Lovell suggested referring the matter to Mr. Solms. It t�as also suggested that the matter be referred. to the Health Departmenta /Y 7»c/ 4 °arct , Mayor Brown stated that Savannah Electric & Power Company said that they were not responsible for the motors damaged several months ago. The Mayor stated that the failure of power occurred on Wilmington Island and that the S.E.& P. Co.,did not have cut -off equipment. Councilman Fleetwood stated that the Insurance Company had informed him that they are not ri,sp9,sible as it was not the Town's fault. He also stilted that the Herb Electric Company give an affidavit that the motors were properly installed. The matter was referred to Mr. Solms to handle. . Superintendent Reed reported that some of the old parts in the water lines in 15th Street should be replaced. Referred to Councilmen Waters, Hosti and Supt. Reed to dandle. The Mayor informed Council that he had cancelled the garbage collection contract with Service Systems, Inc.,effective January 1, 1965 and that the Town is now picking up garbage and trash. Councilman Lovell asked what about a garbage truck? The Mayor stated that we owe them for one half month but they owe us. Councilman Lovell asked Mr. Reed what was the situation regarding the water meter which was tamper 4wit) 9/ Chas. Moorman's property. Mr. Reed stated that the register had been correct anc,,$�aat' Moorman had informed him that the meter was registering too much water and he sent it to the Ba�Lge ,M 1 Company to check. They informed him that the meter was all right and he had he register. Mr. Robert Schneider protested against horses of Mr. Willie Whalen running loose at Estill Station. One of the horses nearly ran over one of his children and they were eating flowers, vegetables, etc.,on his and other people's property and that he bed recently taken out a warrant against Mr. Whalen regarding this and he was asking Council to compel him to keep his horses fenced in. Mr. Solms asked Lt. Price why Mr. Whalen did not come to court. Lt.Price stated that he would be in court on February 1st. The Mayor informed Mr. Schneider that Mr. Whalen assured him that the horses would be fenced in. 2 Councilman Waters reminded Council that dogs are on the loose again, that he had instructed the Police Department to pick up the stray dogs and that the dog owners should be required to putchase a dog tag at the Town Hall. Lt. Price informed Council that Mr. Clancy reported that the new police car would be in today and also that the Police Department had started pick'ng up youths under age for drinking. He also stated that tw04e had been placed on duty after the fire was brought under control at T.S. Chu's warehouse on 16th Street and that those men were on duty until the next morning. They were hired for 11.25 per hour each. Councilman Fleetwood stated that the money was well spent and should be patid by the Town. Councilman Hornstein moved that the men who are employed to do standby duty to protect property as a result of fires be pai�1 1.25 per hour and that not over two men should be employed and also that no one�Pl years of age be employed. Councilman Fleetwood seconded and the motion passed. 46 . Lt. Price requested that the Police Department salaries be raised that they are the lowest paid in Chatham County. He has had problems in getting good men to work on the force and recommended that Council give consideration to increasing the salaries in line with other municipalities in Chatham County. The Mayor asked in comparison how does the Tybee department's hours go with other municipalities in Chatham County. Lt. Price stated that the Tybee force puts in more hours. The Mayor informed Lt. Price that the Tybee department has more men employed than the other municipalities. Referred to the Police Committee to handle. Councilman Waters reported that school children getting out of school are racing bicycles on the streets. He instructed Lt. Price to have this stopped at once. Lt. Price stated that he would talk to the school officials on the island and work out something. Councilman Waters moved that bills for the month of December for General Government amounting to $2,015.45 and for the Water Department amounting to $993.95 be paid. Councilman Fleetwood seconded and the motion passed. Councilman Lovell wanted to know what was the status of the water situation with Mrs. Marjorie Durham on Campbell Road. Referred to Mr.•Solms. Councilman Lovell wanted to know when the sea wall project would be completed. The Mayor informed him that January 25, 1965 was the expected completion date that he had talked to Colonel Ramee. The Mayor stated that he wanted to dedicate com- pletion of the new sea wall and invite Colonel Ramee, Congressman Hagan and others to a dinner and asked for a motion authorizing him to do this. C-ouncilman Fleetwood moved that the Mayor be authorized to set a date for the dedication of the new swa wall and dinner for invited guests. Councilman Hornstein seconded and the motion passed. Councilman Fleetwood suggested that the License Ordinance be gone over and revamped to tie in with the proposed new budget. He also suggested that trespassers be kept off the 18 foot easement west of the sea wall. Referred to Mr. Solms. The Mayor informed Council that in connection with the replacing and cleaning out of the sanitary sewerage system damaged by Hirricane Dora, that he had set Wednesday, February 10, 1965 as the date for receiving and opening bids on this project and that Mr. Joseph Hutton would also be in a'tendance. The Committee will meet in the 'Council Room. 1 1 The Mayor asked for nominations for Councilman to succeed Mr. James H. Powers, who resigned. a Councilman Waters nominated Mr. James R. Duncan. The Mayor asked for further nominations, none were offered. The Mayor called for a second to the Duncan nomination, none was offered. There being no second Councilman Hosti suggested putting itloff until a later meeting. Mr. Solms stated that it is required by law that the vacancy be filled within sixty days of the date of the resignation of the previous councilman. The Mayor stated that the vacancy should be filled as soon as possible. Councilman Fleetwood stated that there should be cohesion of the Board and it should be in unanimous agreement and he seconded Councilman'Waters motion which was passed unanimously. The Mayor informed Council that Walter Brown requested permission to build a motel and bath house for Negroes (Lots 9 & 1(, Block 38 Fort Screven Ward). He was negotiating with the owner to purchase this property but the transaction was being held up to ascer- tain if a building permit would be issued. Councilman Fleetwood stated that a hasty decision should not be made in this case that Brown be required to submit flan, plot plan and specifications. The Mayor stated that he favored granting a permit as he believed it would have a tendency to keep the negroes on the north end of the island away from the beach along the strand on the southern end of the island. Councilman Fleetwood stated that he objected to giving a building permit before plans had been submitted to the Building Committee and he also was of the opinion that the area was zoned against commercial activities. Mr. Solms stated that he thought so too. It was decided to defer action at this time and requested that Mr. Solms check on the Town's Building Code and Zoning Ordinance with reference to this matter ecf., f d waters � 1fa l( cuws, Sc gte*. Ca eC%'t 1 7 & Sa/at�'v i Councilman Hosti brought up the matter of the sinking of shallow ve11s and stated that a permit should be required for this, also a fee charged. Councilman Fleetwood seconded and the motion passed. R E S O L U T I 0.N Be it resolved by the Mayor and Council of Savannah Beach, Tybee Island, that the land and parcel of land known as Lot 33—B, Ward 1, which Lot of land was taken for the failure to pay taxes on February 9th, 1962, be now and the same is hereby reconveyed to the Estate of W.D. Prescott and the Estate of Mike Goldberg for the payment of $6.66 which payment fully satisfies all taxes, debts, and encumbrances against the aforementioned tract of land. BUCKLEY CLERK OF COUNCIL SEAL The Mayor informed Council that a meeting will be held in the Manger Hotel on February 2nd for discussing pollution in the Savannah River and invited those who wishedoto go to attend it. Councilman Hohenstein stated that it was reported that some of the meters on 16th Street were being bipassed. Superintendent Reed stated that he would check on this as some of the old lines are in that area also. Councilman Lovell moved that the following Resolution for (Aprlication for Advance for Public Works Planning) be adopted. Councilman Hosti seconded and the motion passed. R E S O L U T I O N
