HomeMy Public PortalAboutOrdinance 76-440ORDINANCE NO. 76 -440 AN ORDINANCE OF THE CITY OF TEMPLE CITY PROVIDING A CHANGE OF ZONE IN RESIDENTIAL PLANNED DEVELOPMENT CASE NO. 76-480 THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES ORDAIN: SECTION 1. The City Council does hereby find, determine and declare as follows: (a) That the owners of certain real property located in the City of Temple City, County of Los Angeles, State of California, located at 6362 and 6404 North Oak Avenue, in said City, more particularly described as: (1) The Northerly 130 feet of Lot 6 in Block "J" of Santa Anita Land Company's Tract, as per map recorded in Book 6 Page 137 of maps, in the Office of the County Recorder of said County. Except that portion of said land lying Easterly of the West Line of Tract 14533, as per map recorded in Book 311 Pages 45 and 46 of Maps, in the Office of the County Recorder of said County. (.2) The Southerly 80 feet of the Westerly 228 feet of Lot 3 in Block "J" of Santa Anita Land Company's Tract as per map recorded in Book 6, Page 137 of Maps in the Office of the County Recorder of said County. have heretofore filed an application for a change of zone from R -1 to RPD; (b) That the Planning Commission has heretofore recommended such change by its Resolution No. 76- 717PC; (c) That the City Council conducted.a duly noticed public hearing on such application, that said hearing was duly closed; and (d) That based upon the evidence adduced at said hearing, the Planning Commission files and applicable staff reports, and each member of the City Council being familiar with the proposed site, said City Council deter- mines that the zone change should be granted, as applied for, for the following reasons: 1.. The size and shape of the property is adequate for RPD development; and 2. The proposed development is consistent with the General Plan of the City and with surrounding residential, development; and 3.. The subject site has adequate traffic circulation and street access to Oak Avenue. SECTION 2, The Zoning Code of the City .of Temple City is . hereby amended to change the zone of the subject properties to RPD for the reasons hereinabove set forth, and the provisional plan, Marked Exhibits "A" and "B" hereto, be approved and merged into said zone pursuant to Section 9445 of the Temple City Zoning Code. SECTION 3. The following requirements are imposed on the provisional plan: 1. That the development of the subject property shall be substantially in accordance with the plot plans Exhibits ° "A" and "B "; and 1 Ordinance No. 76 -440 2. That the southerly driveway approach shall be widened to 16 ft. at the base of "X" as shown on the plot plan; and 3. That the existing southerly driveway shall be widened to 16 ft. for the first 90 ft. from the westerly pro- perty line; and 4. That the area designated for open parking spaces, located between Unit 1 and Unit 7, shall be screened on the west side by a five ft. high decorative, view - obscuring fence or wall; and 5. That in the event of any sale, transfer or lease of the property by applicant prior to December 31, 1995, the applicant shall construct ten additional covered parking garage spaces. The City may enforce this covenant and be entitled to attorneys fees if this provision is not fully complied with within 60 days after such sale, transfer or assignment. 6. That all applicable City regulations shall be complied with; and 7. That applicant shall file, or cause to be filed, with the City Clerk, a document which the City may record, which shall acknowledge that the owner of the subject property is aware of and accepts the conditions set forth in Paragraph 1 through 6 above, and that the subject property is bound by and subject to the pro- visions contained therein. SECTION 4. The City Clerk shall certify to the adoption of this Ordinance and shall cause the same to be published as provided by law. APPROVED and ADOPTED this 16th day of November, 1976.
