The regular meeting of Town Council was held today at 3 P.M. in the Council Room in the Town Hall and was attended by Mayor James A. Brown, who presided, and Councilmen Hohenstein, Hosti, Fleetwood, Daniels, Lovell, Waters, Town A':..torney Solms Jr., Arthur Davis, J. T. McCusker, L. Maurer, Superintendent Reed, Chief Davis, Lance Smith, Robert Tye, Gene Powers, Lionel Drew, Arthur Gigni3i.liat and John Hendriei.s. The invocation was said by Rev. Glenn Brinson. Mr. Maurer requested permission to operate a reoreat'on center for teen agers. There will be dancing to either live bands or a music box, no beer nor alcoholics will be served, only soft drinks. The location is at Lazaretta Creek on property he is leasing from Mrs. Ralphine Carter. Councilman Lovell asked if it was in the County Councilman Hosti stated that the county had allowed the Town jurisdiction as part of this property as also in the Town Limits. Mr, Maurer stated that the area would be lighted at night and that no gangs would be permitted and that he would have a special officer to police the area The opinion of Council was that if the place was properly operated it would be a n'ce place for teen agers to go. Councilman Waters moved that he be granted a license to operate, Councilman Fleetwood seconded and the motion passed. Mr. McCusker commented on the unsightly condition of some areas in Fort Screven and suggested that an effort be made to clean up the place, that noth'ng had been done in four years, that vandalism is also rampant in the area. He also commented on Sunday Blue Laws. The Mayor informed him that Mr. Solms, Town Attorney, was out of the City. Mr.McCusker stated that, if feasible, he would like to work with Mr. Solms regarding this. The Mayor stated that he would be delighted to have him work with Mr. Solms. Councilman Hohenstein moved that Mr. McCusker and Mr. Solms be appointed a Committee to handle the matter. Councilman Waters seconded and the motion passed. Mr. Hendrix and his colleagues running for the Legislature made a statement that they would cooperate with all of the various governments if elected and asked the support of Council. The Mayor stated that regarding the reading of the water meters that instead of the being read May 1st, that they would be read starting Monday, May 3rd. The Mayor informed Council that some of the meter boxes have been difficult to open but that the McKenna Company had been contacted and they were sending someone down to Inspect them. Mr. Reed stated that all meters would be installed by May lst. Also that at the present time the garbage trucks were operating efficiently. Councilman Hosti stated that the Town must have a new garbage truck. The Mayor stated that a used truck was available. Councilman Hosti stated that that type of truck gave trouble last summer. The Mayor stated that if the used truck which had been purchased gives trouble the sellers would service it. Councilman Hosti stated that he has received bids on several garbage trucks. The Mayor informed him that the Town agreed to buy the garbage truck from the Service Systems concern. He also stated that the Committee should get together and check the truck which had been purchased. Mr. Hosti stated that a new dump truck is needed, and that the newest truck we have is six years old. He presented the following bids which had been received by him: J. C. Lewis Company Dearing Chevrolet Comrnany Hester Motor Company $3,296.70 2,952.46 2,867.00 1 17 The Mayor asked when the truck would be needed, Councilman Hosti informed him that it is needed now The Mayor asked what was the pleasure of Council. Councilman Fleetwood moved that the Committee be authorized to purchase the General Motors truck from the Hester Motor Company, Councilman Hosti seconded and the motion passed. Councilman Fleetwood informed Council that Mrs. Louise Meyer had protested to him re- garding damages done to water connections on her property. The Mayor requested that this be held in abeyance. Councilman Fleetwood called attention to the necessity of having steps for persons to get to the beach over the sea wall and also that since the beach has lowered that the bottom step is too high from the level of the beach. Mr. Reed 'stated that after a while the beach will build up again$. The Mayor informed Council that Hugh Jackson is moving in his equi went today and that there is sufficient material on the job for two weeks work, that the power lines will be put in immediately. The Mayor asked Mr. Reed if the Chapel By The Sea building in Fort Screven had sufficient salvage material in it to tear it down. Mr. Reed stated that it had not. The Mauor asked Chief Davis how he liked his new connection. The Chief stated that he liked it all right that he had gotten a complaint from several sources about the activi- ties at the Beachcombers Club. He investigated and found that the operation is not too good. He also stated that in checking the Mouse Trap, operated by Nick Alexander, that doors lead from the pool room to the bar, which he called Mr. Alexander's attention to. He stated that Mr. Alexander runs a nice clean place. He was asked about the Police Department equipment. He stated that at present it was all right. The Mayor asked what could be done to eliminate the traffic congestiam at Butler & 16th Street. The Chief stated that he understood this matter had been gone into on several occasions. crossing Corncilman Daniels called attention to the bad situation existing on / Butler Avenue especially with children. The Mayor stated that a traffic light should be placed at 8th Street also at 14th Street and he appointed a Committee consisting of Counciimn Waters, Fleetwood and Hosti to get prices and handle the matter and to try and have them up by July 1st. Councilman Waters reported that all parking meters were up by May 1st. The Chief mentioned the playing of stick ball and warping actitities on the beach and asked what should be done about it. Councilman Waters stated tiat last summer these activities were not permitted. The Chief also stated that skiing should be limited to locations other than where there is heavy bathing. The Mayor informed him that Aaron Weiner supplied the life guards in connection with the renting of floats on the beach. Councilman Daniels asked if the Town had an agreement with Mr. Weiner regarding the furnishing of life guards. The Mayor informed him that he had, ten guards on Sundays and h@lidays and extras as the season gets underway. He also stated that the state law requires that bath houses furnish their on life guards. Councilman Waters called attention to the dogs running loose. The Mayor suggested joining forces with other municipalities,that a plan might be worked out where one dog catcher could be employed by a group. Councilman Waters stated that he wo "ld check with the other Mayors regarding this. He also stated that dogs should pay a license and be inocculated. 18 Councilman Waters called attention to some locat1 ns where garbage cans are without covers. He stated that the man on the garbage truck should make a list of those places without covers and also large drums should not be used for garbage but that they would be all right for dry trash. The Mayor stated that it was reported to him on several occasions that children have ?7.een jumping on and off the rocks placed in front of the sea wall and that it was dangerous, that he would have signs installed calling attention to the danger. Councilman Waters moved that bills for General Government for the monthsof March amounting to $2649.82, for Thomas & Hutton amounting to $ 840.00, for one -half the balance on the cash register for $612.80 and,for the Water Department amounting to $491.30 be paid. Councilman Fleetwood seconded and the motion passed. Councilman Lovell wanted to know what was to be done regarding sending out water bills. He was informed that individual accounts were being set up for each Meter on ':a permanent record basis. Councilman Lovell stated that the meter men could read all the meters in two days, three or four at the most. Heaalso informed Council that the McKenna Company will send a man down to check on the Councilman Lovell stated that letters have been sent out informing property omners relative to the charge for water service, that on the 100,000 gallon charge that when the meter goes beyond 100,000 gallons allowed then the rate would start at the rate schedule for 20 cents per 1000. The Mayor mentioned that all commercial places would also be on the same rate schedule. Councilman Daniels called attention to several buildings recently destroyed by fire had not been razed. These should be taken down as quickly as possible. The Mayor informed him that the Town has an Ordinance covering this. Councilman Daniels reported that a while back Council had voted Edmund J. Solomon up to One Hundred Dollars for expenses to attend a clinic for fire fighters but that Mr. Solomon did not make the trip but that there is another meeting of fire fighters which Mr. Solomon would like to attend. Councilman Daniels requested that the money already authorized be used for this purpose to which Council agreed. He also informed Council that the Bennett Allen fire was a complete loss and that the family needed help. Father Wellmeier of St. Michael's Church offered the use of the old parish house until they could get located. The Mayor also stddthatt the Town would be willing to help where it could. Councilman Daniels informed Council that awards will be given next Friday to certain members of the Fire Department. The cost to -e anproximately 345.00. Councilman Hosti reminded Council that when salary increases were given several months ago that through an oversight Frank Kaniats salary was not increased. Councilman Waters stated that it should have been,increased when Cris Blair's salary was increased as Mfr. Kania succeeded Blair. Councilman Hosti stated that Kania should have had the increase. Councilman Fleetwood moved that his salary be increased to $300.00 per month, effective May 1, 1965. Councilman Hosti seconded and the motion passed. Mrs. Robena Coleman protested the license fee of $30.00 assessed against the Wilson Hotel and requested it be reduced to $25.00. The request was denied. Mr. Milton Cowart who contemplates erecting a home on 12th Street and the Strand requested that sanitary facilities be installed so that he could connect up with .the sewer system. The matter was referred to Superintendent Reed to check on. 1 1 1 AN ORDINANCE AN ORDINANCE TO PROVIDE FOR THE RATE OF LICENSE TAXES FOR DOING BUSINESS AND SELLING IN THE TOWN OF SAVANNAH BEACH, TYBEE ISLAND, GEORGIA, FOR TI-E FISCAL YEAR BEGINNING MAY 1, 1965, AND ENDING APRIL 30, 1966; FIXING PENALTIES FOR THE VIOLATION THEREOF; AND FOR OTHER PURPOSES. SECTION Is Be it ordained by the Mayor and Councilmen of Savannah Beach, Tybee Island, in council assembled, and it is hereby ordained by the authority of the same, that license taxes for doing business and selling in the town of Savannah Beach, Tybee Island, Georgia, for the fiscal year beginning on May 1, 1965, and ending on April 30, 1966, shall be payable by each person, firm or corporation transacting or offering to transact any of the kinds of businesses hereinafter specified and scheduled, or practising or offering to practise any of the professions or callings hereinafter specified or scheduled, whether in connec- tion with any other business, profession or calling or not, and shall pay the license tax hereinafter prescribed on or before engaging in or practising such profession or calling. The said report to the Clerk of Council of this municipality shall be made within 24 hours after the completion of said trade, purchase or acquisition of said junk or salvage. SECTION III: In the event any business or calling not specifically men- tioned in the above list set forth shall be established in the town of Savannah Beach, Tybee Island, Georgia, the Mayor and Councilmen reserve the right to establish a license fee for same by ordinance, which. fee is to be of equal dignity as the license specifically mentioned in the above section, provided, however, that such license shall not be more than the sum of $750.00. SECTION IV: This ordinance shall be subject to alteration or repeal in whole or in part at any time during the fiscal year beginning May 1, 1965, should it be deemed advisable, and no such amendment or repeal shall be construed to impair the right of Council to assess or levy tax for the whole of such year whenever made. SECTION V: Any person, firm or corporation owning or operating any riding devices, or passenger vehicles for hire, before being issued a license therefor, shall deposit with the Clerk of Council a policy of insurance against personal injury and property damage, with a receipt showing that the premium thereon has been paid for the length of time covered by the license, in such company and in such amount as may be approved by the Mayor and Councilmen for the benefit of any person or persons who may be killed or injured or sustain damage to property by reason of operation thereof. SECTION V -a: In lieu of such policy of insurance, any person, firm or corporation owning or operating passenger vehicles for hire, before being issued a license therefor, shall deposit with the Clerk of Council a Surety Bond in the amount of $5,000.00 for each vehicle operated by said person, firm or corporation, signed by surety company acceptable to the Mayor and Councilmen of Savannah Beach, said Bond guaranteeing the payment of any loss or damage sustained by any person or persons by reason of the operation of such vehicle, the exact form of such bond to be approved by the Mayor and Councilmen of Savannah Beach. 4' SECTION V -b: In lieu of such policy of insurance and /or such Surety Bond, any person, firm or corporation owning or operating a passenger vehicle for hire, before being issued a license therefor, shall deposit with the Clerk of Council a Real Estate Bond in the amount of $5,000.00 for each vehicle operated by said person, firm or corporation, signed by an owner of real estate who holds merchantable fee simple title to the same and acceptable to the Mayor and Councilmen of. Savannah Beach, said Bond guaranteeing the payment of any loss or damage sustained by any person or persons by reason of the operation of such vehicle, the exact form of such Bond to be approved by the Mayor and Councilmen of Savannah Beach. If said Real Estate Bond is approved by the Mayor and Councilmen, the applicant for license shall pay the fee for recording of said Bond in the Clerk's office of the Superior Court of Chatham County, Georgia. SECTION VI: The Mayor and Councilmen reserve the right to refuse to issue to anyone any licenses for any purposes, for reasons sufficient to them. SECTION VII: Any person procuring a license on or after November 1, 1965, shall pay one -half of the fee therefor set forth in this ordinance, SECTION VIII: Any person, firm or corporation violating any of the provisions of Section I of this ordinance shall, upon conviction before the Mayor's Court of said Town, be subject to be fined in the sum of not more than $100.00 or be imprisoned not more than 30 days, either or both, or any portion of either or both, in the discretion of the Court. SECTION ]X: All ordinances or parts of ordinances conflicting with the provisions of this ordinance are hereby repealed. /Xr AN ORDINANCE AN ORDINANCE TO ASSESS AND LEVY A LICENSE TAX, UPON RETAIL DEALERS ENGAGED IN THE BUSINESS OF • SELLING MALT BEVERAGES, WINE, OR SPIRITUOUS LIQUORS, FOR THE FISCAL YEAR BEGINNING MAY 1; 1965, AND ENDING APRIL 30, 1966; TO PROVIDE FOR THE COLLECTION OF SAID LICENSE TAX; TO PROVIDE FOR THE INSPECTION OF RECORDS AND BOOKS, BOTH WHOLESALE AND RETAIL DEALERS ENGAGED IN THE BUSINESS OF SELLING MALT' BEVERAGES, WINE AND SPIRITUOUS LIQUORS; TO FIX PENALTIES FOR THE VIOLATION; AND FOR OTHER PURPOSES. SECTION- I: - Be it ordained by the Mayor and Councilmen of Savannah Beach, Tybee Island, in Council assembled, and it is hereby ordained by the authority of the same, that in addition to all other tax or license fees heretofore or hereafter imposed upon - retail dealers engaged in Savannah Beach, Tybee Island, Georgia, in the business of selling malt beverages, wine, or spirituous liquors as defined under the laws of Georgia, there is imposed and levied upon all such retail dealers within the town of Savannah Beach, Tybee Island, for the fiscal year beginning May 1, 1965, and ending April 30, 1966, a license tax- for the privilege of doing such business in Savannah Beach, Tybee- Island, fo -be computed and collected as hereinafter set forth. The term "retail dealers" shall include • clubs and similar organizations, SECTION II:- The amount of the license tax imposed by this ordinance on such dealers shall be computed on the following basis: (a) 20 per case on bottled malt beverages where containers exceed 7 ounches, and 12 per case where containers contain 7 ounces or less. (b) $1.25 per 1/2 barrel of 15 -1/2 gallons on draught beer, proportionately in larger and smaller quantities, (c) 10 per quart on 1/5 gallon; 8 per pint or 1 /10 gallon; and 4 per 1/2 pint or smaller, on spirituous liquors. (d) 60 per case on wine. (e) The aforesaid quantity license taxes shall be 50% of the amounts stated on all such legal alcoholic beverages manufactured or produced in Georgia using all Georgia products in the production or manufacture of such beverages. The term "case" as applied to wine shall mean a carton or other container containing 24 bottles of pint size or smaller, or 12 bottles of quart size, or 1/5 size. Fractional parts of cases or barrels, kegs, or drums, or any other size or type containers, shall be computed proportionately. SECTION III: (a) The license tax imposed herein on malt beverages and wines shall be computable and payable monthly;- OD) Each wholesale dealer or distributor selling, shipping or delivering malt beverages or wines to any retail dealer in the town of Savannah Beach, Tybee Island, whether delivered to the retail dealer's place of business in Savannah Beach, or elsewhere, for re -sale in Savannah Beach, shall, as a condition to the privilege of carrying on said business in Savannah Beach: 1. Keep true and correct records of all sales, shipments or deliveries of such malt beverages or wines to each retail dealer in Savannah Beach, • such records to be preserved for a period of one year and to be made available on, request for the inspection of any duly authorized representative of Savannah Beach, Tybee Island; 2. Collect from each such retail dealer in Savannah Beach and add on each invoice at the time of delivery of the malt beverages and wines, the amount of license tax due under the terms of this ordinance, and hold the same in trust for Savannah Beach, Tybee Island, until such amount is remitted to the municipality as next provided; 3, On or before the 10th day of each calendar month, make a verified return to Savannah Beach, Tybee Island, for the monies collected from retail dealers for the month immediately preceding said report, accompanying said return with a remittance to Savannah Beach, Tybee Island, for all license taxes collected. SECTION W: If any wholesale dealer or distributor fails or refuses to make the returns herein provided for, the town of Savannah Beach, Tybee Island, shall notify said party in writing, and if the returns are not made and the license taxes remitted within 5 days from date of said notice, the municipality may withdraw from said wholesale dealer or distributor the privilege of doing business in Savannah Beach by revoking his license. On such failure to make returns and pay the license taxes accrued, Savannah Beach, Tybee Island, shall proceed to assess the amount of taxes due under this ordinance from retail dealers who have purchased from such whole- sale dealer or distributor, from the best information available, and proceed to collect said license taxes as provided by ordinance for the collection of delinquent license taxes, SECTION V: Each wholesale dealer in spirituous liquors (which shall include all alcoholic beverages excepting beer and wine) shall keep 51-A and 51 -B records available for inspection at all times by duly authorized agents and /or representatives of Savannah Beach, Tybee Island. Such records shall show the amount and quantity of each item sold by each wholesaler to each retailer and said wholesaler shall collect at the time of the delivery to said retailer the license tax imposed under this ordinance. SECTION VI: It shall be a violation of this ordinance for any person, firm or corporation to sell at retail within the town of Savannah Beach, Tybee Island, any malt beverages, wines, or spirituous liquors on which the license taxes herein provided for have not been paid to the wholesale dealer or distributor for the municipality. SECTION VII: It shall be unlawful and a violation of this ordinance for any wholesale dealer or distributor, person, firm or corporation, to deliver any malt beverages, wines, or spirituous liquors to any retail dealer in the town of Savannah Beach without first collecting the license taxes. f g' �c SECTION VIII: It shall be unlawful for any person, firm or corporation engaged in the sale as a retail dealer of alcoholic, vinous or malt beverages, to have in his possession any of such beverages unless the tax required by Savannah Beach, Tybee Island, shall first have been paid to the wholesaler, distributor or other source delivering or causing said beverages to be delivered to said retail dealer, and whenever any such beverages are found in possession of a retail dealer where records of the payment of said tax shall not appear upon the records of the wholesale liquor dealer to the municipality, it . will be presumed that said tax has not been paid and the burden shall be upon the retailer to prove said fact, SECTION IX: Any person, firm or corporation engaged in the distribution by wholesale of any of the beverages mentioned in said ordinance wilfully: violating the same shall be subject to revocation of their license to do busi- ness within the corporate limits of the town of Savannah Beach, and all liquor found in the possession of any retail establishment in said town of Savannah Beach which has not paid said tax or reported same under said ordinance shall be subject to confiscation by the municipal authorities of Savannah Beach, Tybee Island, in addition to the other penalties set forth in said ordinance, and sold by the Chief of Police and Ex- Officio Tax Collector, and the receipts thereof paid to the Clerk of Council and Ex- Officio Treasurer, SECTION X: Any retailers violating the provisions of this ordinance shall, in addition to the penalties hereinabove set forth, be subject to revocation of their license to do business in said town as provided in other ordinances of Savannah Beach, Tybee Island, - - SECTION XI: Any person, firm or corporation violating any of the provisions of this ordinance, or who shall assist any retail dealer in malt beverages, wines, or spirituous liquors in . Savannah Beach, Tybee Island, to evade or avoid the payment of the license taxes herein provided for shall be guilty of a violation of this ordinance and on conviction thereof in the Mayor's Court of said town shall be fined not more :than $100,00 or sentenced to imprisonment for . not more than 30 days, or both punishments to be inflicted, in the discretion of the Recorder, SECTION XII: All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed, 1 AN ORDINANCE TO PROVIDE FOR THE TAXATION OF . REAL AND . PERSONAL PROPERTY IN SAVANNAH BEACH, TYBEE ISLAND, GEORGIA, FOR THE FISCAL YEAR COMMENCING MAY 1, 1965, AND ENDING APRIL 30, 1966, AND FROM YEAR TO YEAR UNTIL REPEALED; AND FOR OTHER PURPOSES. SECTION I: Be it ordained by the Mayor and Councilmen of Savannah Beach, Tybee Island, in council assembled, and it is hereby ordained by the authority of the same, that the rate of taxation upon real estate and personal property within the limits of said town of Savannah Beach, Tybee Island, for the fiscal year commencing May 1, 1965, shall be Two and Twenty -two hundredths (2.22 %) percent upon the assessed or returned value of same, the value of real estate improvements to be ascertained from the returns of the Committee on Assessments of said Mayor and Councilmen, and the valuation of personal property to be ascertained from the returns of the owners thereof, in pursuance of the scheme and plan contained in Sections I, II, III and IV of the Ordinance to provide for the assessment of taxable property in the town of Savannah Beach, Tybee Island, Georgia, and the mode of valuing such pro- perty for taxation, and to carry into effect the provisions of the Act of the General Assembly of the State of Georgia approved August 19, 1922, Section 21, as amended; and it is further ordained that if any person or persons shall refuse to pay the taxes hereinabove set forth, within 30 days after same shall become due, the Clerk of Council, as Ex- Officio Treasurer of the Town, shall issue execution therefor, and the further sum of $1,00 for costs, and the Chief of Police and Ex- Officio Tax Collector shall proceed with such execution in the same manner as now provided by law in such cases of execution lodged with the Sheriff of Chatham County. SECTION II: Any tax upon real property assessed and due shall be payable in semi - annual payments; the first half being due and payable on or before May 1st of each year; the second half shall be due and payable on or before November lst of each year, In the event that any tax is not paid when the same is payable, the outstanding amount shall be immediately executed, the fee for execution being $1,00, and in addition thereto an interest charge of one -half of one percent per month shall be assessed. The provisions of this Section shall not apply to licenses for doing business in said town, said licenses being covered under separate ordinance. The provisions of this Section shall apply, however., to those persons or companies required by the provisions of Section 92 -5902 of the Code of Georgia to make returns to the Comptroller General of Georgia. SECTION III: This ordinance shall continue in effect for each and every fiscal year hereafter unless and until repealed or changed by ordinance, SECTION IV: All ordinances or parts of ordinances conflicting with the provisions of this ordinance are hereby repealed; provided, however, that so much and such parts of ordinances passed, as provide for the execution of tax assessments, or part thereof, shall continue and remain in force so as to authorize the Clerk of Council and Ex- Officio Treasurer to issue executions, and the Chief of Police and Ex- Officio Tax Collector to collect same until said taxes or assessments shall be fully paid. 1 19. Mrs. E. Turner requested permission to operate the+atand in Memorial Park. Permission granted. Mr. Michael Counihan protested the amount shown on the water meter on his property at Estill Station. Superintendent Reed was instructed to check on this. Mr. Morris Levy requested that he be relieved of paying Interest and penalties on his 1964 taxes. It was moved, seconded and passed that it be granted. Councilman Lovell moved that the 1965 budget for the General Government operation and the Water Department be adopted. Councilman Waters seconded and the motion passed. Councilman Fleetwood moved that the Tax Ordinance for 1965 be adopted. Councilman Hosti seconded and the motion passed. A special meeting of Town Council was held today at 5:30 P.M. in the Council Room in the Town Hall and was attended by Mayor Brown, who presided, and Councilmen Fleetwood, Daniels, Lovell, Waters, Hohenstein, Town Attorney Solms.
