A RESOLUTION WHEREAS, Savannah Beach, Tybee Island, has application No. P -Ga -3077 pending with the Housing and Home Finance Agency, and it is necessary that the town take certain action to ensure compliance with Title VI of the Civil Rights Act of 1964; and, WHEREAS, Form CFA -1901 must be executed by an authorized official of Savannah Beach, Tybee Island, and submitted to the Housing and home Finance Agency. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Councilmen of Savannah Beach, Tybee Island, in council assembled, that the Mayor of Savannah Beach, Tybee Island, be, and he hereby is, authorized to execute Form CFA -;90; pf the Housing and Home Finance Agency Community Facilities Administration which relates to assurance of compliance with the Housing and Home Finance, Agency regulations under Title VI of the Vicil Rights Act of 1964. BE IT FURTHER RESOLVED that a copy of this resolution be spread upon the minutes of Council and a copy thereof attached to saidForm CFA -1901 and forwarded to the Housing and Home Finance Agency to accompany application No. P-Ga-3077 of Savannah Beach, Tybee Island. There being no further business the meeting adjourned subject to the call of the Mayor. Clerk of Council Mayor Savannah Beach, Tybee Island, Ga. Any 19, 1965. The regular meeting of Town Council was held today at 3 PM in the Council Room in the Town Hall and was attended by Mayor James A. Brown, who presided, and Councilmen Hohenstein, Fleetwood, Daniels, Lovell, Wateirs, Hosti, Town Attorney Solms, Jr., Supt. Reed, Chief Davis and Chief E. Solomon. The Invocation was said by the Rev. Truman Moore. The Mayor asked Mr. Reed if the warning signs had been placed along the sea wall and Mr. Reed stated that they had. The Mayor stated that at the northeastern area in Fort Screven the sea is cutting out the beach and mud is showing behind the rocks. The Mayor called attention to the lack of sanitary sewerage facilities on the east side of Twelfth Street and that Mr.Milton Cowart was contemplating building a home in this area and asked if there was a main running in this area along part of the strand. The Mayor called attention to the gasoline consumption 21 that more gasoline was used this year than last and asked why. Mr. Reed stated that the vehicles are using it. He also stated that some of the streets are being re- paired and steps are being constructed along the sea wall. He also called attention to the sanitary sewer mains running across property on Eighth Street which Mr. John • McGinty purchased and is now planning to build. Mr. McGinty is protesting having the main run across his property. The Mayor asked how many piling had been put down at the fishing pier and Mr. Reed stated that there were thirty -four (34) now in place. Council was informed that the henna Supply Company were having a man from the factory come down and look at the meter boxes. The Mayor asked Mr. Reed who read the water meters. Mr. Reed stated that E. L. Mulling, Billy Parker and himself. He also re- ported that a new location is needed for a garbage dump as the present one is almost filled. The Mayor suggested that the area back of the sea wall along the golf course could be used. The Mayor informed Council that recently he had read a clipping from the Atlanta Paper regarding the unsightlessness of junk yards and suggested that some- thing be done down here regarding this. Councilman Lovell suggested that considera- tion be given to acquiring disposal units in homes. Chief Davis reported that the Police Department is functioning all right at this tire, that another meter maid would be needed when school closes. He also stated that last Sundayis traffic was very heavy and he had a men located at Butler & Sixteenth Street to regulate it. Councilmen Waters stated that the meter maids now checking the park- ing meters have one day off a week and that no one patrols that area when she is off., and that a new meter maid could be used on weekends and also an extra could be used along 16th Street. Councilman Hohenstein moved that one meter maid be employed, Councilman Water seconded and the motion passed. Councilman Daniels in discussing the life guard situation stated that private bath houses are now open and that life gnardsare not on duty. If an agreement has been made to furnish so many guards with the ooncessienaire, those agreeing to furnish the life guards should live. up to it Council decided that no life guards would be furnished for picnics held at Memorial Park unless they were from the Tybee Schools. Councilman Hohenstein stated that the picnic groups from Savannah should furnish their own . life guards. The Mayor appointed a Committee consisting of Councilmen Daniels, Hohenstein and Fleetwood to contact Mr. Aaron Weiner and work out an adequate life saving program. Chief Davis asked if the Town should furnish jackets for the life guards. He was in- formed that the bathing suits for the life guards employed by the Town would be furnished by the Town. Councilman Lovell asked Mr. Reed what was the condition of the water meter at Mr. Michael Counihal's property. Mr. Reed stated that it was functioning all right. Councilman Waters moved that bills for the month of April for General Government amount- ing to $2,351.15 and for the Water Department amounting to $833.65 be paid. Councilman Fleetwood seconded and the motion passed. Councilman Lovell asked about the proposed traffic lights on Butler Avenue and he was in- formed that the Committee is handling this. He also stated that he understood that Chatham County employs a dog catcher. He also asked if the Committee appointed by the Mayor consisting of Messrs. So7.rms and McCusker had made a report. The. Mayor informed him that he had not received a report at thisttime. He also stated that when the 100,000 gallons of water allowed property owners was used then the overage would be billed on the next billing, also that those delinquent in paying for the water meters should be pressed to pay up or pay what they can. Councilman Lovell wanted to know what the status was of the Deady water account. Councilman Fleetwood informed him that equipment was used In Pirate Park which had been rented from Mr. Deady for $500.00. Mr. Deady owes the Town $500.00 for back water ser- vice to April 30th, 1965 plus $250.00 for the current year. He has three 3 inch meters which cost over $700.00 each. Councilman Lovell stated that the Savannah Campers 22 Association had some benches which could be used in the park. We should try and get some of them. Councilman Lovell moved that the bill for 3500.00 which the Town owes Mr. Dendy for rental of the equipment be offset by the 3500.00 which It. Dendy owes the Town. Councilman Waters seconded and the motion passed. Councilman Fleetwood moved that the flat water rate paid by Mr. J H. Dendy of 3250.00 at the present time be extended to cover the year beginning May 1, 1965. Councilman Hohenstein seconded and the motion passed. 1 Councilman Daniels in discussing the fire which destroyed the home of Dr.Portman on Shirley Road last Saturday Afternoon reported that three lengths of hose had ruptured during the fire. The Mayor stated that he understood that the fault was at the couplings. Chief Solomon stated that the fault was not at the couplings but in the hose away from the couplings, that the hose was old. He also suggested that the Southern Bell T & T Company furnish another number at the Fire Station as numerous calls have been coming in at the same time. He will talk to Mr. Gilchrist of the Telephone Company. Councilman Daniels recommended that the Police and Fire Departments get together so that they can understand what each is to do when a fire occurs. He also stated that the Fire Department needed some new hose and moved that the Town purchase 500 feet of 2i inch fire hose. Councilman Waters seconded and the motion passed. Chief Solomon informed Council that at a recent Firemen's dinner everyone had a nice time and also on the trip to Atlanta he had gotten a film which he would show. The Mayor appointed Councilman Daniels to handle nth Mr. Solomon. Councilman Hohenstein asked what happened to the parking meters which were to be placed in the area of Memorial Park. He stated we were losing revenue. 'Councilman Waters informed him that the expense of installing the meters with the paving of streets at the present time was very expensive. Councilman Hohenstsdn suggested that a clean up fee b. charged for use of the park. Mr. Solms doubted if the public would pay a charge. The Mayor called attention to the increase in the pay rolls and stated that now that the season had started that it would continue to increase for the rest of the season. Councilman Waters stated that a patrol is needed on the beach front to enforce the law. Councilman Hohenstein moved that the Police `Committee be authorized to hire one man at a salary of 000.00 per month effective June 1, 1965 to patrol the beach front with authority to arrest people littering the area and also prohibiting dogs on the beach front for the months of June, July and August. Councilman Waters seconded. Those voting "yes" were Councilmen Hohenstein, Daniels, Lovell, Waters, Hoste Councilmen Fleetwood voted "no ". Councilman Hohenstein reported that the ditch running along the north side of Twelfth Street from Jones Avenue to Horse Pen Creek carried a very bad odor. He was informed that the pumping station at Fourteenth & Fourth Avenue is emptied into this ditch during emergencies. The Mayor reminded Council that an effort should be made to collect delinquent taxes. ouncil agfeed that the property would be advertised in July for sale in August. The Estate of W.D. Prescott requested that portions of Lots 5 & 6, Ward 1, which was sold for taxes in 1961 and for which all taxes and costs were paid to the Town, be conveyed back to them. Councilman Lovell moved that the property be quit claimed back to than and that the following Resolution be adopted. Councilman Daniels seconded and the motion passed. 1 1 6A. R ES GLUT I0N WHEREAS on the first day of April, 1961 the Chief of Police of Savannah Beach, Tybee Island, Georgia conveyed to Savannah Beach, Tybee Island; Georgia the following described property, it being the property of the late William D. Prescott, deceased, by virtue of a sale of said property for delinquent taxes for the years 1956, 1957, 1958 and 1959, and, WHEREAS Dorothy P. Prescott, widow and sole beneficiary under the will of the late William D. Prescott, has redeemed said property by paying all taxes due and the cost incurred in the sale thereof and has petitioned Savannah Beach, Tybee Island to quit claim said property to her. NUJ THEREFORE be it resolved by the Mayor and Council of Savannah Beach, Tybee Island, Georgia in council assembled that the property known as the Western and Middle portions of a sub•division of lots five (5) and six (6,, Ward one (1), Savannah Beach, Tybee Island, Chatham County, Georgia, as appears on a plat of subdivision recorded in the office of the clerk of Superior Court of Chatham County, Georgia in Deed Book 10 I, Page lOs, is hereby quit claimed to the said Dorothy P. Prescott and the Mayor is au- thorized and directed to execute a quit clam deed and the Clerk of Council is authorized and directed to attest the same and affix the corporate seal .thereto to accomplish the purpose of this resolution. T Mrs. Mary Anna Rich protested against the assessment placed on the improvements on her property, Lots 15 & 16 of McLeod Sub -Div, Ward 5, and asked that they be reduced. The Assessment Committee agreed to reduce assessment on the improvements to $2000.00. Council was informed that a notice had been received from the Referee- in- Bankrupto that a hearing will be held on June 1, 1965 in connection with the case of Tybeeland, Inc, E.C. Bobo. Mr. Solms will handle the matter. Councilman Lovell stated that the bath house operated by Tybeeland should be required to employ a life guard. Councilman Fleetwood read a letter from Mr. Wm. Fiahback of Fort Screven complimenting the Mayor and Council on the work they are doing. Councilman Hosti reported that the new GNO &vmp'truok had been purchased from the Hester Motor Campeny. 24 Savannah Beach, Tybee Island, Ga. June 16, 1965. The regular meeting of Town Council was held today at 8 P.M. in the Council Room in the Town Hall and'was attended by Mayor James A. Brown, who presided, and Councilmen Hohenstein, Hosti, Fleetwood, Daniels, Lovell,'Waters, Town Attorney So]sis, Supt. Reed, -Chief Davis, Mr. Milton Coward, Mr. Arthur Davis, Fire Chief Solomon. Mr. Coward informed Council that he was contemplating erecting a year around home on the ocean front on L'Twelfth Street and rdquested that he be given sanitary sewerage facilities to his place. He was informed that there was sufficient fall from his location to go into the Town's sewer mains. Mr. Reed stated that he had sufficient fall but that it would be necessary to use steel pipe to run down the side of Tweth Street. The Mayor asked if it was the policy for the Town and the property owner to share the cost. Councilman Hosti stated that it was not always. The Mayor asked if Mr. Reed had talked mitt' Mr. Coward about the cost, Mr. Reed stated that he had not. Councilman Hosti suggested'that Other property owners in that area pay their proportion- ate cost of the sewer line. Mr Coward stated that he would be willing to<pay one quarter of the cost of the material and the Town would lay "the pipe and that the other three property owners be billed when the line is installed. Councilman Fleetwood moved that the work be done and that each of the four property owners be billed one— quarter the cost of the material, and that each be billed their proportionate share of the material when the line--is installed, the Town to lay the line without cost to the property owners. Councilman Hohenstein seconded and the motion passed. Councilman Hosti moved that a quit claim deed be given to Mrs. Margaret Framer for.the eastern portion of Section I of Beach Lot 73, Ward 4, to within 18 feet west of the seawall. Councilman Waters seconded and the motion passed. The minutes, after several corrections, were read and adopted. The Mayor stated that Mr4mA thur Davis informed him that there were fifteen benches which the Town could get gerW,Limiffegested that if the benches were given to the Town to accept them. Councilman Lovell asked about the sewer line running across Mr. John McGinty's lot on 8th Street. The Mayor stated that'a plat had been made showing-the main running - across Mr. McGinty's lot but that Mr. McGinty does not want to build his house over the sewer line. Mr. Reed reported that the fishing pier is now 240 feet out in the sea, that sonie'of the material had not been delivered, it was necessary to change some of the 3x10's to 8 x 12's and that the extra size would cost more. Mr. Reed stated that the pier should be completed in August, also that the various departments are functioning all right. 7-0 ounei].man Fleetwood brought up the matter of cleaning the lots. The Mayor stated that the Town does not have the funds to do the work. Mr. Fleetwood suggested that Supt. Reed check the lots to be cleaned and the- property owners notified that theTown would clean the lots and would bill them. Councilman Daniels asked about the Old beach theatre. The i+ ayor asked if property owners could be put'on docket for not cleaning their lots. It vas the opinion of Council -that they could. Councilman Daniels asked if the Health Department would have jurisdiction. Councilman Fleeted stated that at the last grand jury session they stated that some work had been taken over by the Mosquito Control Commission. Councilman Hohenstein stated that it is a health hazard. Councilman Waters stated that the.priees charged by tin operators are too high for most of the property owners to pay. 25 Councilman Lovell stated that the-garbage disposal area is developing into a pollution problem. The'mayor asked if some of the refuse could be put behind the sea wall. Mr. Lovell asked if the tides came ever the sea well at the proposed area that the Mayor had in mid and the Mayor stated that some high tides did. Mrs Lovell also called attention to the old stoves and other articles left at the old garbage dump at Estill Station and stated that it should be cleared up. Mr. Reed informed him that 'it was put there by residents on Spanish Hammock. Mr. Lovell suggested that the drag line should be gotten before the hurricane season started. The Mayor stated that he would talk to Mr. Fultz in an effort to get the drag line down. Councilman Lovell stated that the eater Committee may have to hire some extra help to read the water meters. He shatedtthathtbere were approximately 900 and that they be paid ten cents per meter reading. He also stated that some of the Town employees spay be interested in doing this extra work on their time that Mr. Reed could talk to some of them about it. Councilman Lovell will handle the matter. Councilman Daniels wanted to know if any more walkways over the rocks at the sea wall were up. Mr. Reed stated that they were up as far as Second Street. Councilman Lovell wanted to know if the McKenna Company had sent their man down to look at the water meters. Mr. Reed stated that practically all of them worked. Chief Davis requested new bedding for the jail and suggested getting plastic pads as they were easy to handle and to keep clean. He stated that about helve are needed now. Councilman Fleetwood moved that.the Chief be authorized to purchase the pads, etc., Councilman Lovell seconded and the motion passed. The Chief asked what to do about delinquent business licenses. him to start going after them now. Councilman Daniels suggested that the 0Tybee Times° a weekly news -sheet distributed on the island, be allowed to operate without being charged it license,, for the present. The Mayor recommended that the license ordinance be amended to reduce the fee for dancing with live music from $100.00 to $50.00 and for dancing to the music box from $50.00 to $35.00 and that those lincnnses which have been paid for dancing with live music that they be refunded for the difference. Councilman Fleetwood moved that the license ordinance be amended for dancing by live music to $50.00 and dancing with the music box to $35.00 and that those who have paid full license be refunded. Councilman Daniels seconded and the motion passed. Councilman Hohenstein wanted to know from Chief Davis what is the general situation of orderly conduct, ete.,on 16th Street. The Chief stated that it was a little rough at times but had not gotten out of hand. The Mayor suggested that the Chief check all locations. Councilman Has ti stated that this had been done. The Chief informed Council that no one under 21 years of age is permitted in a bar and also employees under 21 years of age are not permitted to work in one. Councilman Hosti wanted to know how it could be stopped. Mr. Solms stated that he would check the law. The Chief stated that girls under 21 are working in bars. The Mayor asked if the Mach front isbeing kept clean and the Chief stated that it was. Councilman .Waters reported that the new man employed Checking. along the beach is working all right and that he patrols as far as 5th and 6th Street and farther up if necessary. Council- man Lovell asked what is being done towards keeping the dogs off the beach. The Chief stated that they were doing the best they could. Councilman Waters moved that bills for General Government for the month of May amounting to $7,820.75, for the Water Department amounting to $947.07 and also that the Hester Motor Company for $1,304.88 and the J.C.Lewis Motor Company for $930.00 be paid. Councilman Daniels seconded and the motion passed. The Mayor instructed 26 Councilman Lovell informed Council that $24,691.32'had been collected on the sale of water meters and that we still owe approximately $20,000.00. This money must be collected now and that a notice be sent to delinquents to pay up by July 10th. Councilman Lovell and Mr. Solms will handle the matter. Councilman Lovell reported that a survey of the disposal system and showing costs for a new system would amount to $500,000.00. Chemicals for one with would cost $2,150.00. Councilman Daniels reported that in connection with the life guard situation that it was agreeable to ha,Te ten life guards on duty, he was informed that in past years the Red Cross supplied extra guards on week ends and holidays. He thinks that he could get at least five guards from them tih o do voluntder work but they must be furnished meals, etc. He suggested that the Red Cross be contacted with this thought in view. It was the opinion of Council that it was a good idea and he was appointed a committee to handle the matter. Councilman Fleetwood asked if the Bond for the construction of the fishing pier was issued, he also culled attention to delinquent taxes. After some discussion the Mayor asked what was the pleasure of Council. Councilman Waters moved that fi fats be issued for delinquent tax payers and that the property be advertised in September for sale at the court house in October. Councilman Hosti seconded and the motion passed. Councilman Hosti called attention of Council to the bad condition of 16th Tenets (Izlar Avenue) and stated that it should be repaired at once. Councilman Daniels also mentioned 15th Street, Butler to Chatham, 4th Street, Bright Street, Logan Street and a number of other streets, that all need to be repaired. Councilman Hosti was instructed to get prices on these oosts. The Mayor mentioned that the Town's income was up and so were the expenses. Councilman Fleetwood suggested paying off the note which the Town has at the bank and then borrow later. The Mayor suggested that it be paid later but to pay off the fishing pier now. The Mayor also reported that the parking meters are still being broken into. Councilman Lovell asked about the traffic lights to be installed on Butler Avenue. Councilman Waters informed him that a representative of the Company had been here and that he would be back Friday. Fire Chief Solomon informed Council that the Town's fire alarm system was not working satisfactorily and that he had talked to Mr. Gilchrist of the Telephone Company and was informed that they have another system which is better than the one we have and that the cost of the new system would be approximately $8.00 per month. The Mayor requested him to get together with the Finance Committee and explain the new set up. Mr. Solomon stated that there is an old ordinance which does not permit trailers, mobile homes, campers, eto.,to locate in the 'own's limits and requested that the Ordinance be amended to permit trailers, mobile homes, campers, etc.,to locate in the Town limits, it would help the Towles finances. He mentioned that with the new fishing pier in operation and with the golf course nearby that an area in that section should be designated for a location for campers, mobile homes, eto.,pro- vided they had facilities. He informed Council that he had reoentiy purchased a large strip of land in that area and wanted to develop it. Councilman Waters stated that they had discussed it and felt that something should be done. Mr. S olms stated that zoning laws prohibit the Iodation of these vehicles in residential zones and also that the Town does have an ordinance against it, that it would depreciate property ya].ues, that,if tents were used this might be different. 27 The Mayor appointed a Committee consisting of Councilmen Daniels, Fleetwood and Town Attorney Solos and Mr. Solomon to handle the matter. The Mayor reported that. the State Fire Marshal has called attention to the condition of the old Mayflower Hotel, Chapel by the Sea, Buildings #40 and #41 on Officers Row in Fort Screven, also Steve Causey's House on Butler Avenue and stated that they should either be repaired or tern down. Councilman Hosti suggested that the Building and Electrical Inspectors should check these places and notify the property owners to re- pair them. Mr. Solms stated that the owners of the Mayflower Hotel should be notified that they cannot occupy the building until it is repaired. He will notify him. Mr. David Rosenzweig requested that a shade be placed on the street light at 10th Street on the side of the light which shines into several of :his bed rooms. The matter of the Matthews request to open llth Street was again presented. The Mayor stated that they have access to their property but that Council cannot at this time open the street as the cost is too great. Mr. Buckley reported to Council that the transaction where the Town had used some of Mr. J. H. Dendy's equipment that a plan had been worked out whereby Mr. Dandy would be paid 11500.00 for rental of the equipment and that as Mr. Dendy owes the Town $500.00 for delinquent water rent, that the matter could be adjusted. He presented the check to Mr. Dendy amounting to $500.00 for his endorsement so that it could be applied against the equipment rental but that Mr. Dandy refused to endorse the check. Councilman Hosti reported that a taxpayer had gotten a parking ticket for - parking his motorcycle near the police station and he felt that he should not be required to pay when there were a number of motorcycles parked there at this time. Referred to the Police Committee. Councilman Lovell reported that 30 million gallons less water wabspumped in May, 1965 than in May 1964.
