IONA CITY HALL
OCTOBER 20, 2020 — 7:00 P.M.
PRESENT: Mayor Dan Gubler, Council President Rob Geray, Council Member Michael
Thompson (via teleconference), Council Member Peter Wadsworth, Council Member Kathy
McNamara, Public Works Director Zech Prouse (via teleconference) and City Office Assistant
Rylea Farrens.
ABSENT: City Attorney Andrew Rawlings and City Clerk/Treasurer Keri West.
VISITORS: Scott Kelly, Leann Grover and Doug Ricks.
Mayor Gubler welcomed everyone and Council President Geray led the Pledge of Allegiance. A
roll call was taken by Assistant Farrens to open the meeting.
CONSENT AGENDA: City Council Work Meeting and Regular Meeting Minutes of
September 15, 2020 were reviewed. Council reviewed the finance reports for the period ending
September 30, 2020 (100% of the fiscal year elapsed). The City had $1,011,077.21 in the bank
and routine bills had been paid, "Exhibit A".
Mayor Gubler entertained a motion. Council President Geray made a motion to approve the
consent agenda as presented. Council Member Wadsworth seconded the motion. All in favor.
Motion carried.
ITEMS OF BUSINESS:
Business License Application — Doug Tolbert, Powerhouse Coach, Inc. — Mayor Gubler
stated this item was discussed at the City Council Meeting in September when Mr. Tolbert had
applied for a Conditional Use Permit for his RV repair business. At that time, it was determined
Mr. Tolbert required a Business License, rather than a Conditional Use Permit. Council Members
had no questions regarding this application.
Mayor Gubler entertained a motion. Council Member McNamara made a motion to approve the
Business License for Doug Tolbert, Powerhouse Coach, Inc. Council Member Wadsworth
seconded the motion. All in favor. Motion carried.
Ordinance to Amend and Enact New Sections of the Iona City Code Title 8, Chapter 1 —
Parks (Ord. 247-10-20) — Council President Geray stated this item is difficult to approve
without Attorney Rawlings present. He also asked if Mayor Gubler or other Council members
had perspective on this update. Assistant Farrens stated there was a man regularly digging in the
City Park with a metal detector and Director Prouse wanted to add language to the City Code to
prohibit such activities in the parks. Director Prouse confirmed. Council President Geray stated
he has gone through it and has some feedback for Attorney Rawlings to address prior to approval
from the City Council at next month's meeting. Council President Geray mentioned Section 8-1-
3: Operation of Motor Vehicles, and requested to add a line that allows City employees to
operate motor vehicles for maintenance and other City business. Director Prouse agreed and also

stated the section he had requested to have added was Section 8-1-5(B): Damages to Park
Grounds. Council President Geray acknowledged this addition and also mentioned Section 8-1-
5(A): Planting or Removal of Plants. He continued and stated the first line should read, "No
trees, shrubs, vines, or other plants shall be planted in any public park without the consent of the
City." It currently has the word "with" instead of "without". Director Prouse agreed.
Council President Geray recommended tabling this discussion and vote until the suggestions can
be implemented into an updated version of this chapter. Mayor Gubler agreed.
Mayor Gubler entertained a motion. Council President Geray made a motion to table the
Ordinance 247-10-20 to Amend and Enact New Sections of the Iona City Code Title 8, Chapter
1 — Parks until the next scheduled City Council Regular Meeting. Council Member Wadsworth
seconded the motion. All in favor. Motion carried.
Discussion of Disposition of Stanger Building— Mayor Gubler stated this discussion took place
during the Work Meeting, immediately preceding this meeting. He continued and stated the lease
with the Bonneville Art Association on the Stanger Building has expired and the City is
considering divesting itself of that property. Mayor Gubler stated the City has been paying the
maintenance and repairs for the building and only a small group of people are benefiting from it.
Council Member Wadsworth asked if the City could expand their usage of the building, since it
is on the National Register of Historic Places. Council President Geray recommended tabling this
for a future discussion when Attorney Rawlings is present.
STAFF REPORTS: Assistant Farrens reported for Clerk West and stated the City has currently
received $1,708.01 in reimbursement funds from the CARES Act. She also stated the City has
applied for a grant from Game Time, Inc. to assist with the cost of the new playground
equipment for the Country Haven Park. We are still awaiting notification on this. Assistant
Farrens also reported the City has received a credit from Blue Cross in the amount of $1,308.69
due to decreased claims processed over the past 12 months. Assistant Farrens continued and
stated the Veterans Day program is still planned for November 11th and will be held at the City
Building. She is still planning the details of this event.
Assistant Farrens stated the Trunk or Treat is still planned to take place on Saturday, October 31St
from 2-4pm and requested feedback from the Council on whether they want this event to
continue as is. Council Member Wadsworth stated the City needs to be very cautious with the
type of events we invite members of the public to and how we handle those events in this type of
situation. Assistant Farrens said she will be implementing precautions, such as social distancing.
She requested help from Mayor Gubler and the Council to be in attendance and assist with social
distancing enforcement. Assistant Farrens continued and stated we have received 24 RSVPs to
do trunks, including 3 businesses. She also stated we have extended the time this year to allow
people to spread out the time they are here. Council President Geray stated he does not oppose
the Trunk or Treat due to the community interest, but he also does not personally support it. He
prefers having kids go trick or treating the old fashioned way and will not be at the City Trunk or
Treat. Assistant Farrens stated this event will be in the afternoon, so children will still be able to
go trick or treating around the neighborhoods. Council Member Wadsworth suggested displaying
a sign that allows people to attend the Trunk or Treat at their own risk and manage themselves.
He continued and stated he does not agree with having people there to enforce the social

distancing, having place marks on the sidewalks or requiring people to wear masks. Council
President Geray stated he agrees, but is concerned with liability if the City is hosting an event
and not following guidelines outlined by Eastern Idaho Public Health (EIPH). Assistant Farrens
stated she has talked to EIPH and they have instructed us to have all food handlers wear masks
and gloves and to encourage social distancing. Council President Geray suggested having
someone enforce the guidelines for those doing the trunks, but not the attendees. Assistant
Farrens agreed.
Council Member Wadsworth, Council Member McNamara and Council President Geray all
stated nothing to report. Council Member Thompson did not respond via telephone.
Director Prouse stated nothing to report.
Deputy Williams stated there have been several areas in the City that have been reported as
speeding hazards. He has been monitoring these areas and has been giving warnings and
citations when necessary. Mayor Gubler also stated there are situations in the City where people
are living in RVs, which is not permitted long-term. Council President Geray advised Deputy
Williams to review Iona City Code 11-11-24, regarding long-term habitation in RVs.
SUGGESTED AGENDA ITEMS: Scott Kelly requested to be added to a future agenda to
possibly change the zoning of his property from Commercial to Residential. He would then like
to split the property to build two houses. Mayor Gubler stated there is a process to do this which
includes an application, fee and a Public Hearing. He advised him to call Clerk West at the City
Office to get additional information on this process.
Representative Doug Ricks stated there has been new legislation that included a change in the
way the State of Idaho distributed sales tax to the cities throughout the state. However, they
found that many cities were receiving much more than others per capita. He continued and stated
there is a new bill being presented that addresses this situation.
