HomeMy Public PortalAbout02-12-2002, DRAFTPLANNING COMMISSION MINUTES - FEBRUARY 12, 2002 PRESENT: PLANNING COMMISSIONERS RON JOHNSON, JERRY BROST, RANDY BRINKMAN, LENNY LEUER, ELIZABETH WEIR, TOM SUPEL, SHARON JOHNSON, MARY VERBICK AND DICK PICARD. ALSO PRESENT PLANNING AND ZONING ADMINISTRATOR, ADMINISTRATOR CLERK -TREASURER PAUL ROBINSON AND PLANNING AND ZONING ASSISTANT SANDIE LARSON. Chairperson Lenny Leuer called the meeting to order at 7:06 p.m. Lenny Leuer and Loren Kohnen added #7 to the agenda - housekeeping items. 1. PUBLIC HEARING ON RE -ZONING CERTAIN PROPERTIES IN THE HOLY NAME LAKE AREA TO SUBURBAN RESIDENTIAL Loren Kohnen explained the re -zoning and put up an overhead of the area to be re- zoned. Jim Nielsen, 295 Lakeview Road, asked what the ramifications to the homeowners were of this re -zoning. L. Kohnen said that all of the lots being considered for re -zoning are non -conforming in the rural residential zone and with the suburban residential a number of them will still be, but some of the set -backs will be less. Also , with suburban residential zoning, none of the lots can be further subdivided. He said the value of the homes probably will go up somewhat, because of being served with city sewer. Tom Supel reiterated that the value would go up because of the sewer and not the re- zoning. J. Nielsen asked if there was any benefit to the residents. Paul Robinson said it will reduce the need for variance requests. Jerry Brost said that going to suburban residential will give the owner more flexibility, less set -backs - is there any estimate in the appraisals of the properties. Lenny Leuer said it is not the planning commission's place to venture into tax changes. T. Supel asked if the Sween lot was not included because it now conforms to the rural residential zoning. Planning Commission Minutes February 12, 2002 1 L. Kohnen said yes and we would not want to include it in suburban residential because of the size, it could be subdivided and we don't want that. L. Leuer asked about the lot that has a portion of it out into the lake and what about the rest of Holy Name Lake. Fred Prodahl, 305 Lakeview Road, said the rest of us own down to the lake. L. Leuer asked if the one lot that has the triangle into the lake, was being re -zoned including the portion into the lake, P. Robinson said where the dark line is on the map, is the area being considered for re- zoning. L. Leuer asked what the piece in the lake was zoned. There was further discussion on what the zoning for the parcels in the lake were. F. Prodahl said if the Raskob's wanted to put a fence up be the dark area on the map they could and our lots would all stop at the water. L. Leuer asked about the lot on Holy Name Drive that had land on both sides of the road, is it included in the re -zoning and the answer was yes. P. Robinson said that it was all on PIN number, if the small piece on the lake side was left out, it would be zoned Rural Residential - is that better or worse? L. Kohnen said the landowner used that portion for lake access only. L. Leuer wanted to know if the square footage of the lots was accurate. P. Robinson said he took the figures from the county - the numbers could be off some. The public hearing was closed. MOVED BY ELIZABETH WEIR AND SECONDED BY JERRY BROST TO RECOMMEND APPROVAL OF THE REZONING OF THE 14 LOTS IN THE HOLY NAME LAKE AREA TO SUBURBAN RESIDENTIAL. MOTION PASSED. 2. ANTHONY PATTERSON - 1912 HIGHCREST DRIVE - SIDE YARD SET -BACK VARIANCE FOR 2ND STORY ADDITION Sandie Larson noted letter received from a neighbor of Mr. Patterson's stating that they had no problem with this request. Planning Commission Minutes February 12, 2002 2 Loren Kohnen read his memo to the planning commission and put up an overhead of the area. He stated that this addition would have less impact on the neighbors than the current space being used as a greenhouse with grow lights, etc. Loren also put up overheads of before and after of the house. Anthony Patterson aid they will use the 1st story space as a family/sitting room and the 2nd story space will be incorporated as part of the master bedroom. Dick Picard asked if there would be any change in the footing/foundation area. He said he noticed some digging in the area. A. Patterson said no, they had done some digging to make sure it was a frost footing. Lenny Leuer said he noticed there as an entrance from the greenhouse to the basement and to the house. A. Patterson said they would eliminate the entrance to the basement. Randy Brinkman told Mr. Patterson he should tell his contractor to stay tight to the house and not wonder around the property too much because of his mound system and also the neighbors. A. Patterson said absolutely. L. Kohnen said this is fairly simple construction with no foundation work. A. Patterson said the only challenge will be the roof trusses for the 2nd story. Elizabeth Weir said she went thru Tom's list and the ordinance and if she takes it literally, there are more reasons not to grant this variance than to grant it, but it is a small variance with less impact on the neighbors, the footings already exist and it is a reasonable use of the house, so she is in favor of granting the variance. R. Brinkman said this is a nice addition to the house. Tom Supel said that the factors do not stand alone. He said he felt this was a straight forward proposal. He said he did go through the 6 factors, but this is a minimal variance with minimal impact on the neighbors. He said he did support the request. Tom asked Loren about the main purpose of the setbacks being fire protection and said he presumed that there is nothing in the lay of the property that would be a fire prevention issue. L. Kohnen said that the urban areas allow a 10' setback, so 15' is no problem. Planning Commission Minutes February 12, 2002 3 MOVED BY ELIZABETH WEIR AND SECONDED BY RANDY BRINKMAN TO RECOMMEND APPROVAL OF A 5' SIDE YARD SETBACK VARIANCE FOR ANTHONY PATTERSON AT 1912 HIGHCREST DRIVE: Hardship being the topography of the property and the location of the existing house and the fact that this is a minimal variance request. MOTION PASSED. 3. LOCH DEVELOPMENT - 3600 CHIPPEWA ROAD - WETLAND SETBACK VARIANCE FOR SEPTIC SYSTEM This item was tabled per the applicants request to give them time to have the wetlands delineated. Loren Kohnen gave some background on what this request entailed. He explained that when this division was done there were adequate areas for the septic sites, but when they put in the driveway the soils were disturbed. He said a spot has been found about 53' from the wetland where our ordinance requires 75' He did state that the MPCA recommends 50', so the 75' is arbitrary. There was discussion of where the driveway is, etc. 4. DISCUSSION OF PLANNING COMMISSION TRAINING GUIDE Sharon Johnson asked about scheduling a work session to discuss the training guide with either all the members or a smaller group. She said she is getting a lot of feedback from different people and there is a need to get together to discuss it. A work session was set up for 7 p.m., Wednesday, February 20, 2002. The group will meet in the downstairs meeting room. 5. MINUTES OF JANUARY 8, 2002 There were some grammar and spelling errors noted and with some changes in text. MOVED BY ELIZABETH WEIR AND SECONDED BY JERRY BROST TO APPROVE THE MINUTES AS CORRECTED. MOTION PASSED. 6. UPCOMING PLANNING WORKSHOPS The workshops were discussed with members giving Sandie the ones they would like to attend. She will take care of getting them signed up. Planning Commission Minutes February 12, 2002 4 Loren updated the planning commission on the council meeting the previous week and also on the upcoming items for the March planning commission meeting. Lenny Leuer stated that at the end of the March meeting a new chairperson would be elected, so the members should be thinking about who they would like for the position.
