HomeMy Public PortalAbout04-16-2007PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, MONDAY, APRIL 16, 2007 The Common Council of the City of Richmond, Indiana met in regular session Monday, April 16, 2007, in the Council Chambers in said City. President Pappin presided and the following business was conducted: PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR GLOVER ROLL CALL Councilors present were Howard "Jack" Elstro, Etta Lundy, Bruce Wissel, Karl Sharp, Bing Welch, Larry Parker, Al Glover, Gil Klose and Diana Pappin. APPROVAL OF MINUTES Councilor Parker moved to approve the minutes of the meeting of April 2, 2007, with a second by Councilor Glover. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS RESOLUTION NO. 6 -2007 — A RESOLUTION ALLOWING A LATE FILED STATEMENT OF BENEFITS FORM FOR A TAX ABATEMENT FOR MAC -DEL, INC. The Clerk read Resolution No. 6 -2007 by title only. This Resolution would allow Mac -Del, Inc. to request a tax abatement for real estate valued at $275,000. The paperwork was not filed on time due to a change in pertinent personnel at Mac -Del. The Tax Abatement Committee recommended approval. Councilor Wissel moved to approve Resolution No. 6 -2007 with a second by Councilor Parker. Upon a vote viva voce, the motion passed. COMMUNICATION FROM THE MAYOR The first weekend of the Spring Clean -Up was very successful. Over one hundred volunteers were on hand. The neighborhood clean -up schedule continues through May 25. REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the March 29 and April 5, 2007 meetings were accepted as presented. REPORTS FROM DEPARTMENT HEADS - None REPORTS FROM STANDING COMMITTEES - None REPORTS FROM SPECIAL COMMITTEES - None REPORTS FROM ORGANIZATIONS - None MISCELLANEOUS BUSINESS - None Common Council Minutes April 16, 2007 Page 2 of 3 Councilor Elstro moved to suspend the rules and read Ordinance Nos. 26, 27, 28 & 29 -2007 on first reading by title only with a second by Councilor Lundy. Upon a vote viva voce, the motion passed. ORDINANCE NO. 26 -2007 — A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR A CERTAIN PARCEL FROM R -2 RESIDENTIAL DISTRICT TO C -2 COMMERCIAL DISTRICT (900 Catalpa Drive) The Clerk read Ordinance No. 26 -2007 on first reading by title only. This Ordinance is a request to rezone property at 900 Catalpa Drive from R -2 Residential District to C -2 Commercial District in order to allow the owner to sell the property for commercial purposes. Ordinance No. 26 -2007 was referred to the Plan Commission for public hearing at its meeting on April 26, 2007. ORDINANCE NO. 27 -2007 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (Optical Disc Solutions) The Clerk read Ordinance No. 27 -2007 on first reading by title only. This Ordinance is a request by Optical Disc Solutions for a ten -year tax abatement for equipment valued at $1,109,200. Ordinance No. 27 -2007 was referred to the Tax Abatement Committee for due diligence. ORDINANCE NO. 28 -2007 — AN APPROPRIATION ORDINANCE AMENDING ORDINANCE NO. 55- 2006 KNOWN AS THE 2007 SALARY ORDINANCE The Clerk read Ordinance No. 27 -2007 on first reading by title only This Ordinance would increase the salary of the Golf Course Superintendent by $3,000. The Superintendent was hired in 1979 and, as part of his compensation package, was permitted to live in the residence located on the golf course at Highland Lake at no cost to him. The Park Department later agreed to pay the utilities in lieu of paying for additional responsibilities beyond a 40 -hour week. Per the Wayne County Health Department, the property is no longer habitable. The necessary repairs would cost in excess of $30,000. The Superintendent agreed to purchase a home off -site. The requested salary adjustment would compensate him for his increased living expenses. Councilor Welch moved to advance Ordinance No. 28 -2007 to second reading and to suspend the rules and read by title only with a second by Councilor Sharp. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 28 -2007 on second reading by title only. Council President Pappin declared Ordinance No. 28 -2007 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Elstro moved for engrossment of Ordinance No. 28 -2007 with a second by Councilor Lundy. Upon a vote viva voce, the motion passed. Councilor Lundy moved to advance Ordinance No. 28 -2007 to third and final reading and suspend the rules and read by title only with a second by Councilor Elstro. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 28 -2007 on third reading by title only Ordinance No. 28 -2007 was adopted with a 9 -0 roll call vote. Common Council Minutes April 16, 2007 Page 3 of 3 ORDINANCE NO. 29 -2007 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (ASAHITIC America Corporation) The Clerk read Ordinance No. 29 -2007 on first reading by title only. This Ordinance is a request for a ten -year tax abatement by ASAHITIC America Corporation for equipment valued at $35,995 Ordinance No. 29 -2007 was referred to the Tax Abatement Committee for due diligence. ORDINANCES ON SECOND READING ORDINANCE NO. 22 -2007 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (Mac -Del Inc. Real Estate) The Clerk read Ordinance No. 22 -2007 on second reading by title only. This Ordinance is a request by Mac -Del, Inc. for a ten -year tax abatement for real estate valued at $275,000. The Tax Abatement Committee requested Ordinance No. 22 -2007 be held to allow sufficient time for due diligence. ORDINANCES ON THIRD READING ORDINANCE NO. 47 -2006 — A GENERAL ORDINANCE OF THE CITY OF RICHMOND, INDIANA, FOR THE PURPOSE OF MANAGING THE STORMWATER COLLECTION AND CONVEYANCE SYSTEMS AND ACTIVITIES IN THE CITY, ESTABLISHING RATES AND CHARGES FOR THE USERS OF THE STORMWATER SYSTEM OF THE CITY AND OTHER RELATED MATTERS The Clerk read Ordinance No. 47 -2006 on third reading by title only. Councilor Welch moved to hold this Ordinance to allow for more advertisement. This motion failed due to a lack of a second. Ordinance No. 47 -2006 was adopted with a 7 -2 roll call vote. Dissenting were Councilors Welch and Parker.
