HomeMy Public PortalAboutOrdinance 78-457ORDINANCE NO. 78 -457 AN ORDINANCE AMENDING ORDINANCE NO. 75• -410 OF THE CITY OF TEMPLE CITY BY ADOPTING BY REFERENCE THE LOS ANGELES COUNTY BUILDING CODE AND AMENDMENTS AS IN THE 1977 EDITION OF THE LOS ANGELES COUNTY BUILDING LAWS PUBLISHED BY THE BUILDING NEWS, INC. FOR AND INSTEAD OF THE PRESENT BUILDING CODE AND MAKING OTHER AMENDMENTS. THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES ORDAIN: SECTION 1. Ordinance No. 75 -410 entitled "Building Code" adopted August 5, 1975, as codified Section 7100, et. seq. of the Temple City Municipal Code, is hereby amended by adopting by reference, except as hereinafter provided, that certain Building Code known and designated as the Los Angeles County Building Code as contained in the 1977 edition of the Los Angeles County Building Laws published by Building News, Inc., and such code shall be and become the Building Code of the City of Temple City, regulating the erection, construction, enlargement, alteration, repair, moving, removal, demolition, conversion, occupancy, use, height, area, maintenance of all structures and certain; equipment therein specifically regulated and grading within the City of Temple City, and providing for the issuance of permits and the collection of fees therefore, providing penalties for violation of such code, declaring and establishing fire zones. Three copies of said Los Angeles County Building Laws have been deposited in the office of the. City Clerk of the City of Temple City, and shall beat all times maintained by said Clerk for use and examination by the public. Said edition of the Los Angeles County Building Code, except as provided hereinafter, is hereby substituted for, and shall take the place of, the Building Code set forth in said Ordinance No. 75 -410, and such amending ordinances previously adopted. SECTION 2. Section 101 of said Los Angeles County Building Code is amended to read: Section 101. Title. Section 7100, et seq. of thelTemple City Municipal Code, shallbe. known as the "Building Code ", may be cited as such, and will be referred to herein as "this Code ". The provisions of said Section 7100 et.seq. applying to dwellings, lodgings, houses, hotels, apartment houses, convents, monasteries or other uses classified by this Code as a Group R -1 or R -3 Occupancy and including Chapters 1, 2, 3, 4 and 98 and 99 is and may be cited as the "Housing Code". SECTION 3. Section 207 of said Los Angeles County Building Code is amended to read: Section 207. Definitions. Whenever any of the names.. or terms defined in this Section are used in this Code, each such name or term shall be deemed and construed to have the meaning ascribed to it in this Section. "Board of Appeals" shall mean the Board of Appeals established by Section 206 of said Los Angeles County Building Code. "Building Department" shall mean the "Building and Safety Divi- sion" of the Department of County Engineer. "Building Official" shall mean. County Engineer of the County of Los Angeles. "City" shall mean the City of Temple City except. in. Section 103 of said Building Code, "County ", "County of Los Angeles" or "unincorporated territory of the County of Los Angeles" shall mean the City of Temple City. "County Engineer" shall mean the County Engineer of the County of Los Angeles. "Electrical Code" shall mean Section 7300, et seq, of the Temple City Municipal Code. "Fire Code" shall mean Section 3100, et seq. of the Temple City Municipal Code. "Fire Zone" shall mean the fire zone adopted by an ordinance creating and establishing fire zones or where no such fire zones have been adopted by the City of Temple City shall be considered to be in Fire Zone No. 3. "General Fund" shall mean the City Treasury of the City of Temple City. "Health Code" or "Los Angeles County Health Code" shall mean Section 3200, et seq. of the Temple City Municipal Code. "Health Officer" shall mean the Health Officer of the City of Temple City. "Mechanical Code" shall mean Section 7200, et seq. of the Temple City. Municipal Code. "Plumbing Code" shall mean Section 7400, et seq. of the Temple City Municipal Code: "Special Inspector" shall mean a person holding a valid Certificate of Registration issued by the County of Los Angeles as set forth in Section 305 (b) of said: Los Angeles County Building Code. SECTION 4 Section 208 of the Building Cade of the City of Temple City shall read as follows: • Section 208 (a). Compliance with Code,` A person shall not erect, construct, enlarge, alter, repair, move, improve, remove, convert, demolish, equip•,'use,occupy or maintain any building or structure or perform any grading in the City, or cause the same to be done, contrary to, or violation of any of the provisions of this Code.: (b) Penalty. Any person, firm or corporation violating any of the provisions of this Code shall be deemed guilty of a mis- demeanor, and each such person shall be deemed guilty of a separate offense for each and everyday or portion thereof during which any violation of any of the provisions of this Code is committed, continued or permitted, and upon conviction of any such violation, such person .•shall be punishable by a fine of not more than $500, or by imprisonment for not more than six months, or by both such fine and imprisonment. SECTION 5. Section 303 of said Los Angeles County Building Code is amended by amending Table No, 3 -A to 1k times the fees shown, 1 SECTION 6. Said Los Angeles County, Bu.i.lding Code is amended by deleting Section 307 therefrom.' SECTION 7. - Section 9906 of said Los Angeles County Building Code is amended to read: Section 9906. Building Rehabilitation Appeals Board. In order to hear appeals provided for in Chapter 98 and in this chapter, there shall be and is hereby created a Building Rehabilitation Appeals Board consisting of five (5) members who are qualified to pass on matters pertaining to substandard building and property. The members of the Board shall be appointed by and hold office at the pleasure of the City Council of the City of Temple City and may recommend such new legislation as deemed necessary. The Board shall adopt reasonable rules and regulations for conducting its investigations. The Planning Director shall be an ex- officio nonvoting member and act as secretary.. He shall keep a record of all proceedings and notify all parties concerned of the findings and decisions of the Board. SECTION 8. Section 9907 of said Los Angeles County Building Code is deleted. SECTION 9. The provisions of said Ordinance No. 75 -410 as amended by this ordinance insofar as they are substantially the same as the provisions of said Ordinance No. 68 -267 prior to November 19, 1970 shall be construed as restatements and continuations and not as new enactments. All changes and modifications of the Uniform Building Code, 1973 Edition in said Ordinance No. 75 -410 as amended by this ordinance are reasonably necessary because of local conditions. This finding is made pursuant to Section 17958.5 of the State Health and Safety Code. SECTION 10. The City Clerk shall certify to the adoption of this Ordinance and to its approval by the Mayor and shall cause the same to be published in the Temple City Times, a newspaper of general circula- tion, printed, published, and circulated in the City of Temple City.
