The regular meeting of Town Council was held today at 8 P.M. in the Council Room in the Town Hail and was attended by Mayor James A. Brown, who presided, and Councilmen Fleetwood, Counihan, Cary, Hohenstein, Davis, Daniels, Town Attorney Soims, Judge B. B. Heery and William S. Lovell, Robert L. Waters, Chief Davis, Supt. Reed, George Peters, Fred DeBorde, Hubert Ellzey, H.L.Jordan, Was C. Shell. The Invocation was given by Rev. Manning of the EpPlcopel Chapel. Judge Heery administered the following oath to Mayor Brown: STATE OF GEORGIA CHATHAM COUNTY I, James A. Brown, do solemnly swear that I will faithfully and honestly perform the duties of Mayor of the Town of Savannah Beach, Tybee Island, Georgia, to the best of my skill and ability, without favor or affection, so help me God. Further, I, James A. Brown, a citizen of Savannah Beach, Tybee Island, Georgia, and being an employee of the Town of Savannah Beach, Tybee Island, Georgia, and the recipient of ppblic funds for services rendered as such emplcee, do hereby solemnly swear and affirm that I will support the Constitution of the United States and the Constitution of the State of Georgia, and that I am not a member of the Communist Party and that I have no sympathy for the doctrines of communism and mill not lend my aid,. my support, my advise, my counsel, nor my inference, to the Communist Party or to the teachings of communism. The Mayor thanked Judge Heery for coming down to administer the oaths and stated that he always felt that the Judge was one of the members of the Tybee fan ily and he was always so cooperative, after which Judge Heery excused himself. CARY Mr. Snell informed Council that the Tybee Museum was now a member of the Museum Association, that they could get more exhibits in Telfair also that the Museum was Ding painted on the outside but that the inside 5jiould be painted also; that the roof leaks in several places and moisture is present. Also that they have to contend with vandalism and recently some of the flag poles on top of the Museum had been stolen. Mr. Jordan informed Council that the Government has funds available for the construction of air strips and suggested that Tybee apply for funds for which to have one on the Island. The Town would have to furnish the land and the Government would furnish the funds. He suggested that the,Town approach Governor Sanders for funds for this purchase that a strip of from 3500 to 4000 feet would be necessary and he suggested that the area where the garbage dump is now located near Van Horn Street be considered. Councilman Counihan stated that he would be in Atlanta shortly and he would call on the Governor regarding this. Mr. Jordan was excused. 84 Mr. Murray requested that something be done to correct the bad situation between the Center and Sixth Street seawall as portions of it are crumbling and falling off. Mr. Tenenbaum stated there was no protection from the groins in this area and the beach has lowered to such an extent that when the breakers hit the sea wall his house shakes. He also stated that there were cracks in the seawall. Mr. Mock stated that residents in this area requested previously that the bad condition be corrected but so far nothing had been done. Councilman Counihan stated that money for maintaining seawall and groins was earmarked but that it had not been applied to the repairs ofthe groins and seawall, that facts should not be hidden. The Mayor stated that the groins must be re- paired now. G n ncilman Davis moved that the Sixth Street groin be repaired now and that bids be put out for having the work done. Councilman Hohenstein seconded and the motion passed. Councilman Fleetwood stated that the private owners should bay that area of the beach. A group of surfers represented by Mr. Charles Gay III, requested that Council mark off an area or several areas on the beach front for use of the surfers. They requested an area from Center Street to 8th Street and two hours before and two hours after each high tide be set aside in this area for use of the surfers. A committee consisting of property owners and residents in this area stated that they were not against the surfers as a whole as most of the young people were cooperative but that others were very uncooperative. After some discussion Mr. Luhr Beckmann suggested that from 3rd to 6th Street the surfers be permitted to use and from 7th to 8th be set aside for the surfers and from 8th,to 9th for general bathing. Councilman Counihan moved that surfers be permitted to use from 3rd to 6th and from 7th to 8th as suggested by Mr. Beckmann, skipping two groins. Councilman Fleetwood seconded, those voting "MESS" Daniels, Fleetwood, Davis, Counihan and Cary. Councilman Hohenstein voted "NO" contending that the matter should be given more thought. Mr. Hubert Ellzey requested a refund of Fifty ($50.00) Dollars which he contends he was charged for a pin ball machine at his place of business for the year commencing May 1, 1965, that he did not have a pin ball machine in his store. Mr. Ellzey has not paid his 1966 license. Councilman Fleetwood moved that when he pays for his 1966 license that he be given credit of $50.00 against the 1965 license. Councilman Counihnn seconded and the motion passed. Councilman Daniels informed Council that E.C. Bobo had questioned the number of machines which he was charged for contending that there should be 18 and the Chief reported 19 that Mr. Bobo had submitted checks for his licenses and had also deducted the amount cover- ing a billboard sign that he contends he paid for the last two years and that this sign was down during that time. Councilman Daniels recommended that Mr. Bobo pay all licenses due by him and that if he has any questions for him to write a letter to Council. The Mayor instructed the Chief to get the total amount of all of Mr. Bobo's licenses for the year 1966. The Chief stated that some of Mr. Bobo's machines had been transfefted to other locations. Chief Davis recommended that the parking meters be taken down on the ]4 -15th lot and that a flat charge of One Dollar be charged for all ar part of the days usage. After some discussion Councilman Hohenstein moved that the parking meters in the ]4 15th Street and 16th St parking lots be removed and that a flat fee of One Dollar be charged for all day packing and that a tread mill be used. Councilman Cary seconded and the motion passed. Mr. Solms stated that the street is a public thoroughfare and meters are intended to direct the flow of traffic. The Chief stated that it would be necessary to have a collector at each entrance to collect the fees. Councilman Counihan moved that they be employed, seconded by Councilman Hohenstein and passed. _ 1 1 84-A Preamble: "I am Charles Gay. I live on Wilmington Island and am President of the Savannah Beach Surf. Club. It purpose in appearing before you, and we do appreciate the time you are giving us, is to resent a suggested plan which we hope will be acceptable to Beach property - owners, swimmers and surfers alike. We realize that the propertye owners pay high taxes for the privilege of having homes adjacent to the Ocean, and those on Sixth Street in particular have been harassed by noise, commotion, trespassing, and other annoyances, and we hope that the plan we have to offer might be also acceptable to them, arid put into effect. We suggest: (1) That the four piling spikes on the Beach just North of 6th St. be immediately removed by the Town in order to make this area more safe for swimmers and surfers, and that any other old piling which extends from or juts out from the old jetties and which have proved dangerous in the past to the life of everyone entering the water, but out back, (2) That an area from 5th Street to 8th Street be designated as a surfing area for to hours before and two hours after each high tide. (3) We feel this will give more privacy to the residents on these streets, and further suggest that the Police be called and cases made against any trespassers, unnecessary noise-makers and speeding cars. In passing, may I say that we feel this extended area from 5th to 8th Street will give the surfers more room to spread out and therefore be less hazardous to everyone. Also, there are many times when the tides and too high to surf anywhere in this area except from 7th to 8th streets as the erosion problem has caused the beach to wash away up to this point, and there is a great danger of our expensive boards hitting the sea wall. We have procured the signatures of 88 property- owners who live on the Beach and/or who use the Beach to swim, asking for a safe place for surfers and swimmers alike. Please, don't take away our surfing. We feel it is a good clean sport, and we would like to weed out from our midst those individuals who are discourteous, thoughtless, careless, and who otherwise present an unpleasant picture of the teenager of today. We feel, if given a chance, our Surf Club can police this area, keep it clean, poaV:the signs at the given times and otherwise make the Beach a place where everyone can enjoy the summer. We also feel that surfing is here to stay, and that todays "little swimmers are toporrows "Teenage -S urfers ", - that the problem will exist for many years to come and something should be worked out immediately. 1 85 Chief Davis requested that the police officers be granted an allowance to take care of having their uniforms cleaned. Councilman Daniels recommended that up to $7.00 per month per man be allowed and that bills be submitted by the cleaners for payment through the Town's office. This will also include ?k. 0. S. Blair who services the parking meters. Councilman Counihan seconded and the motion passed. Councilman Hohenstein called attention to the dogs running loose on the beach. He reported that when dogs are seen on the beach the police and the meter maids have in- structions to have them removed from the beach. Councilman Fleetwood protested against the public using his property vest of the sea wall. Superintendent Reed reported that some of the dirt in the area of the fishing pier had been washed out from the heavy rains and he had planned to fill in where needed and cover the surface with shingle tips. The Mayor stated that in reference to the lake addition toNoliday park that sand would be needed to fill it in. Superintendent Reed stated that it would also need two feet of dirt to top it, referred to the Public Works Committee. The Mayor asked how long the present garbage dump could be used and Superintendent Reed stated that time is up now. Superintendent Reed reported on the garbage routes that the crews in some instances have to pick up the garbage off the ground which is a problem. The Mayor stated that the present packer truck has been in operation for the last four years and that the garbage pick up is heavy. Councilman Davis. reported that a new "TUMORS" packer type garbage truck had recently been demonstrated and that its operation was very simple and is a time saver and that the cost complete is $8,000.00. He made a motion that it be pur- chased and that $4,000.00 be paid in cash and the balance of $4,000.00 plus interest be paid next year. Councilman Hohenstein 'seconded and the motion passed. Mrs. Petty called attention to the bad condition of the cemetery in Memorial Park and stated that it should be cleaned and the graves identified as much as possible. The matter was referred to Councilman Hohenstein, Chairman, Parks & Recreation Committee to handle. Fire Chief Solomon reported that the Town of Thunderbolt, through Mayor Gilreath, conveyed their thanks to the Town of Savannah Beach for the cooperation extended by sending one of it's fire trucks to Thunderbolt to assist in a recent fire which occurred there. He also reported that as to the use of fire works that the Ordinary of Chatham County has to issue a permit authorizing fire works displays. The question of the use of fixtures nedessary to set off the fire works was brought up and Council was informed that M'. Gordon Miller had purchased fixtures for the Savannah Beach Chamber of Commerce. Councilman Cary also stated that the Chamber of Commerce had purchased.the fixtures. Mr. Ellzey suggested that the Town have a Tybee Day Celebration having fire works, etc. Councilman Cary agreed and suggested that the fire works display be set off from the_-fishing pier and that Saturday, August 13th be the date. The Mayor appointed a Committee consisting of Councilmen Cary, Daniels and Fleetwood to handle. Councilman Cary moved that the fire works display be set off from the fishing pier, Councilman Counihan seconded and the motion passed. Fire Chief Solomon stated that he had 29 tubes used far fire works displays and that the Town could use them. Be then cal led attention to the Firemen's Convention to be held at Jekyll Island and requested that he be sent as a delegate representing the Town, the convention to last three days. Councilman Cary moved that $75.00 be alloted for ex- penses for Chief Solomon to attend the Convention. Councilman Fleetwood seconded and the motion passed. The.minutes of the meeting of June 15th were read and after several corrections were approved. 86 Councilman Fleetwood moved that bills for General Government amounting to 0,331.24, for the Water Department $1,504.00, Thomas & Hutton for $5,300.00, Hester Motor Co., for $2,381.90 and the J. A. Peters Company $1,000.00 be paid. Councilman Davis seconded and the motion passed. Councilman Fleetwood in discussing the Town's finances stated that the Town needs more money to operate, that texas had not been raised since 1948, that he is opposed to increasing taxes indiscriminey and that the Town should get the County appraisals on Tybee property as soon as possible. That Mr. Buckley should go to the Tax Assessor's office in Savannah and get the Tyhee figures. Also that Mr. R.L.Waters be appointed Police Court Clerk to take over Mr. Buckleys position in taking care of the records. Councilman Daniels wanted to know what records in the Police Court)that if someone was going to be employed that his Committee should know about it. The Mayor stated that it would be an honorary job. Councilman Counihan stated that he objected to it that it looked as if an effort was being made to create a job for Mr. Waters. Councilman Fleetwood stated that the Town has over a fair million dollar digest and that it must get the tax records. Councilman Daniels stated that he doesn't understand the set up and he doesn't like it and would have no part of it that applications should be taken for the position. Councilman Covnihan stated that he was against the set up. Councilman Hohenstein stated that Mr. Waters had lots of experience and that he did not know about the matter until tonight. Coioilman Daniels stated that Council should not hire anyone tonight but to study it and take applications for the position. Councilman Fleetwood recommended that in consideration to Councilman Daniels that no action be taken at this meeting. Nr. Waters stated that he did not ask for the job. Councilman Cary reported that regarding membership in the Fire Department that he hoped to have a report in a few months, that the matter be left alone for the present. He also called attention to the Tybee School that it is a fine grade school and that the teachers are handling two classes and that there is one principal for the Type school and anotherat he had heard rumors that the school would be closed. He requested the Mayor to check on this and also request that Tybee school have a fall time principal. The Mayor suggested the thought that it might be better to lave a Committee call on the Superintendent of Schools. The Mayor stated he would write a letter asking for an appointment. Councilman Cary recommended that State funds be requested but that Superintendent T. Marshall be contacted first. Councilman Cary informed Council that the old ex firemen's group have been active taking training, red cross activities, disaster aot-Tvities and are prepared to work with the Town Officials anytime they are needed. Councilman Daniels stated he had talked to Mr. Fred Lindsay of the American Red Cross and Mr. Lindsay will be down after Labor Day to instruct the Police Department. Councilman Daniels reported that the revenue from the Police Court was $2,740.00 over the same period last year. He also stated that there are some, deficiencies in the Police Department. He also stated that ding the summer months the Police Court 3s too hot that sone fans are needed, also that the Council Room be air- conditioned. The Mayor recommended that one unit be placed in the Council Room and also another in the Clerk's Office but that this matter be held off until next year. Councilman Hohenstein recommended that flood lights be placed on the baseball diamonds and that light meters be used for the operation but that this to be done next year. He also recommended that a fence be placed in the area of Pirates Park to protect the ducks which are kept there as a tourist attraction. Councilman Davis reported that recently a speeding ear killed five of the ducks, wouMd.ed some and three died the next day. Councilman Hohenstein moved that flood lights be installed at the baseball diamonds in Memorial Park, and that coin meters be attached to them and that this be done before next Spring. Also that a fence be placed around the south end of the 7 Island at "Pirates Park" at a cost of $'',424.00. Councilman Daniels seconded and the motion passed. III Councilman Fleetwood moved that a street light be placed in the area of Fifth Avenue and Fourteenth Street. Councilman Davis seconded and the motion passed. Councilman Daniels reported that he had instructed the Police Department to have any old automobiles on the streets removed. 1 1 Councilman Daniels moved that the bill from the Critz Buick Company for $309.75 covering damages to the automobile of Irs. Thelma Durden by one of the Town's trucks, be paid. Councilman Fleetwood seconded and the motion passed. A bill was presented from Curtis Ford for $32.04 for repairs to a Mustang automobile of W.S. Nelson wh6se car was backed into by one of the police oars. Councilman Counihan moved that it be paid, Councilman Cary seconded and the motion passed. A letter was read from Mr.J.Wadley Petit, representing Mrs. Nettie Denmark, requesting that a water bill for $45.00 which had accrued by Rufus E. Randall,tenant, be cancelled. This charge was against House #95 Cedarwood Drive, Fort Screven. Councilman Davis moved that the petition be denied and that the bill be paid. Councilman Counihan seconded and the motion passed. Councilman Hohenstein moved that the following Resolution honoring Mr. E.B. Izlar be adopted. Councilman Counihan seconded and the motion passed. A RESOLUTION WHEREAS, Ernest Barton Izlar, Sr.,came to Tybee Island on April 11, 1889, from Orangeburg, South Carolina and has been in continuous business at this beach resort since that date; and, WHEREAS, Mr. Izlar, Sr.,was Postmaster at, Savannah Beach for 15 years commencing in 1906 and was one of those residents who gave much of his energy and talent to the initial building of this resort; and, WHEREAS, Mr. Izlar,Sr. built the Old Ocean View Hotel in 1902; and the Tybrisa Pavilion; built, owned and operated the Sea Breeze Hotel and the Izlar Bath Hoarse and in recent years he owns and operates the Izlar House; and, WHEREAS, he has been in business at Savannah Beach, Tybee Island, formerly known as the Taft of Tybee, for more than 67 years and is really one of the pioneers and original moving forces of this community; and WHEREAS, he is a Past Commander of the Frances Bartow Camp #93, Sons of Confederate Veterans; he was Honorary Marshall for Memorial. Day Services in Savannahm Georgia, and for over 40 years has been a member of the Board of Stewarts of the Trinity Methodist Church, where he has also held the positions of Chairman and Vice Chairman of the Board of Trustees; and WHEREAS, Mr. Izlar is the oldest citizen of Savannah Beach, Tybee Island, Georgia, and the Mayor and Councilmen of Savannah Beach, Tybee Island desire to recognize his outstanding contribution to community affairs as well as his longevity in the service and business of said resort; and NOW THEREFORE, be it resolved in Council assembled that in honor of Ernest Barton Izlar, Sr.,he be and is hereby known as AFL SAVANNAH BEACH". BE IT FURTHER RESOLVED that this resolution be spread upon the minutes of Council and that a copy thereof be delivered to MrZ Izlar. 88 Councilman Fleetwood moved that the following Resolution be adopted. Councilman Counihan seconded and the motion passed. RESOLUTION, WHEREAS, William S. Lovell was elected to the Council of Savannah Beach, Tybee Island, Georgia on July 9, 1934, and has served in this capacity continuously for over 32 years on Harty committees and has for many years been Chairman of the Water Committee. He has continued the fine leadership displayed by his father, Robert P. Lovell, who was the 3rd Mayor of the Town of Tybee and who was an early builder and pioneer of this beach resort; and WHEREAS, Bill Lovell, as he is known to most of his friends, is a professionally qualified engineer, having graduated from the Georgia Institute of Technoloby and as such is a member of the Georgia Society cfProfessional Engineers, as well as, the American Society of Mechanical Engineers. His knowledge and ability in this field have been invaluable to this municipality, particularly in the fields of water supply and sanitary sewerage. During his service on Council, this community saw the in- stallation of a sewer plant and many miles of sewer lines; sometime thereafter, the municipality, on his recommendation, undertook a study of the feasibility of acquiring the Tybee Water Works,'a privately owned institution. This acquisition is one of which Mr. Lovell may be very proud because it has afforded the citizens of this muni- cipality the opportunity of better fire protection and lower insurance rates through the improvement of the water system. This department is self supporting and is liquidating the bonds which were issued for its purchase; and WHEREAS, Mr. Lovell and his wife, Hollis, are active members of the First Presbyterian Church in Savannah and he has served on the Board of Elders. Upon his retirement on July 1, 1962, as Plant Engineer of Southern Cotton Oil, now known as Hunt — Wesson Foods, he has contributed even more of his time in the interest of this municipality. NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Councilmen of Savannah Beach, Tybee Island, in Council assembled, that Council express its thanks and grateful appreciation to Mr. Lovell for excellent service and great contribution to this muni- cipality; that it officially recognize that his was the longest continuous service as a Councilman and that it was filled with wise guidance and professional ability. BE IT FURTHER RESOLVED, that this resolution be spread upon the minutes of Council and a copy thereof be presented to Mr. Lovell. Councilman Hohenstein moved that the following Resolution be adopted, Councilman seconded and the motion passed. RESOLUTION WHEREAS, Robert L. Waters was elected to Council on tianuary 11, 1956, and during the past eleven (11) years has served on numerous Committees and for the last several years has been Chairman of The Finance Committee of Council; and, WHEREAS, Mr. Waters was born in Bulloch County, Georgia but for 28 years has lived at Savannah Beach, Tybee Island, Georgia and has been very active in religious and civic affairs of this community; and, WHEREAS, he was employed by American Can Company for more than 36 years and upon his retirement devoted his full time and attention to the betterment of his community by his untiring and unselfish devotion in various fields of civic development, and WHEREAS "Punk" Waters, as he is affectionately known, - -is a Past President of the Optimist Club of Savannah Beach, Tybee Ind, Past Lt. Governor of Zone 9, Optimist International, Georgia District and is presently serving as Secretary and Treasurer -of the local Optimist Club; and, he and his wife, Annie, are members of the Trinity Methodist Church of Savannah Beach. NOW, THEREFORE, BE IT RESOLVED, by the Mayer and Councilman of Savannah Beach, Type Island, in Council assembled, that ibis expression of deep appreciation and gratitude of this body he made to Mr. Waters for his great service in his community, not only in his official capacity as Councilman, but also as arresident of the muni- cipality who has devoted many long hours of hard work always keeping in mind that which has been to the best interest of the people of this community; and, BE IT FURTHER RESOLVED, that this resolution of thanks, gratitude and appre- ciation be spread upon the minutes of Council and a copy be presented to Mr. Waters. Councilman Counihan informed Council that the Tybee Terrace Cottages and operating on one meter but that a number of these cottages are owned by individuals and he felt that they should be put on a separate meter. The Mayor stated that a meter could not be put on each building. Councilman Hohenstein concurred with Councilman Counihan that they should be on separate meters. Referred to the Water Committee to handle. The Committee was informed that Lot 17, Block 4, Bay Ward, owned by the Town had been advertised for sale at the Court House in Savannah on Tuesday, August 2nd. An offer of $300.00 cash has been submitted for this lot. Councilman Davis moved that the following Ordinance be adopted, Councilman Counihan seconded and the motion passed. The Ordinance was placed on first and second reading. AN ORDINANCE An Ordinance to establish speed limits on Second Avenue from First Street to Van Horn Street, on Van Horn Street from Second Avenue to Meddin Drive, on Meddin Drive from Van Horn Street to Cedarwood Drive, on Cedarwood Drive from Meddin Drive to Van Horn Drive, Savannah Beach, Tybee Isldnc, Georgia; to provide penalties for the violation thereof; and for other purposes. BE IT ORDAINED by the Mayor and Councilmen of Savannah Beach, Tybee Island, Georgia in council assembled, and it is hereby ordained by Authority of the same as follows: SECTION 1: That the speed limit on Second Avenue from First Street to Van Horn Street, shall be 15 miles per hour. SECTION 2: That the speed limit on Van Horn Street from Seoond Avenue to Meddin Drive, shall be 15 miles per hour SECTION 3: That the speed limit on Meddin Drive from Van Horn Street to Cedarwood Drive, shall be 15 miles per hour. SECTION 4: That the speed limit on Cedarwood Drive from Meddin Drive to Van Horn Street shall be 15 miles per hour. SECTION 5: That any person or persons violating any of the provisions of this Ordinance shall, upon conviction thereof, be subject to be fined not to exceed $100.00 and 3.m- prisoned not to exceed 30 days, either or both in the disxretion of the court. SECTION 6: All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. 90 Councilman Davis moved that the following officers and employees of the Town be reappointed.
