In August the Idaho Transportation Department {ITD) sent you a letter about plans to resurface Idaho
State Highway 55 between Donnelly and Deinhard Lane in McCall. ITD will be adjusting driveway
approaches on and off Idaho 55 to match the new grade of the roadway as part of the project . Included
with the letter was a property use agreement, which we have not received back.
In order for ITD to complete this work, please fill out, sign and return the enclosed Property Use
Agreement by October 12, 2020. A postage -pai d return envelope has been included fo r your
convenience. ITD plans to repair potholes and place a new layer of pavement. This project will create a
smoother driving surface and extend the service life of the roadway .
Completing the enclosed agreement gives ITD permission to enter your property and replace your
driveway approach. Please return the entire agreement. If you would like a copy, please let us know and
one w ill be mailed to you.

The Idaho Transportation Department (ITD) is
developing paving plans for State Highway 55
between Donnelly and Deinhard Lane in McCall.
Beginning just north of Donnelly, ITD will repair
potholes and then place a new layer of p avement over
Idaho 55. This project will create a smoother driving
surface and extend the service life of the roadway.

Construction is completed
ITO is working with all agencies, municipalities and members of
the public who have a stake in Idaho 55.
PROJECT COST
The estimated cost of the project is $5.4 million.

PROPERTY USE AGREEMENT

KNOW ALL MEN BY THESE PRESENTS, That City of McCall (Airport), hereinafter "Grantor", whose
address is 216 E Park Street, McCall ID, in consideration of the benefits to be received from the facility to
be constructed and other good and valuable consideration, the receipt of which is hereby
acknowledged, hereby grants unto the STATE OF IDAHO, Idaho Transportation Department, by and
through the Idaho Transportation Department, 3311 West State St., Boise, ID 83703, and its successors
and assigns, hereinafter "Grantee", the right to go upon, occupy and use the following described
property:
A portion of the property as shown
on Exhibit "A" attached hereto and
made a part hereof.
FOR THE PURPOSE OF regrading or repaving residential or commercial approach, together with the right
and privilege of ingress and egress to and from said property for said purposes.
IT IS UNDERSTOOD that the Agreement herein granted shall terminate upon completion of the above
mentioned construction project .
IT IS ALSO UNDERSTOOD that the agreement herein granted does not convey any right or interest in the
above described property, except as stated herein, nor prevent Grantor from the use of said property,
except as stated herein; provided however that such use does not interfere with the rights herein
granted.
In addition, the Grantee, its successors, assigns, agents, contractors, subcontractors, employees agree to
the following conditions of entry.
22. DAMAGE TO PROPERTY: Grantee shall exercise care to avoid damaging the property in any
manner not consistent with the purpose for which this agreement is issued. Grantee will
promptly repair any such damage to the property caused by Grantee, and Grantee will
indemnify Grantor against any claims or losses arising in connection with Grantee's work on the
property under this agreement.
23. CLEANUP: Upon completion of the project, the Grantee will ensure that the area used during
construction will be clean of all rubbish, excess material, and equipment.
24. COOPERATION WITH GRANTOR: Grantee shall at all times cooperate with Grantor and comply
with reasonable requests not inconsistent with the purpose of which this agreement is issued .
The Grantor does hereby covenant with the Grantee that he lawfully owns and possesses the
aforementioned and described tract of land , and that he has a go~;i nd lawful right to convey such use.
