The regular meeting of Town Council was held today at 3 P.M. in the Council Room in the Town Hall and was attended by Mayor Brown, who presided and Councilmen Fleetwood, CoundBan, Gary, Daniels, Davis, Supt. Reed, Chief Price, Arnold Seyden, Mr. Evans, J. T. McCusker. Mr. Seyden requested that the Savannah Beach Jaycees would like to lease the stand on the pavilion in Memorial Park. Councilman Counihan moved that they have the use of it free of charge provided that the place is kept clean. Councilman Fleetwood seconded and the motion passed. . The Mayor reported that he had some complaints from residents in the area of Pulaski and Taylor Streets about sand blowing in from Dr. Griley's property and they vented it corrected. Mr. Musker stated that although his family had moved away from Tybee he still owns a house on Officers Row and he is still interested in Savannah Beach. He showed some pictures which he had taken of some of the buildings in his area which were in very bad condition and unsightly and requested the Town to handle the matter. The Mayor in- formed him that the building adjacent to his was owned by Alexander Morris who had been given written notice to correct conditions at the Morris cottage, that an attorney had appeared before Council to represent Mr. Morris. Councilman Daniels stated that the place is a health and fire hazard and that the Town should do something about it. Councilman Davis stated that where property is in a bad state of repair and the owner does nothing about it that the taxes should be raised until it is repaired. Councilman Fleetwood moved that the owner be placed on the docket. Councilman Counihan second- ed and the motion passed. The Mayor stated that all places should be handled the same way and not one. Superintendent Reed stated that sand had been accumulating at the end of 18th Street on the Beach side. The Mayor informed Council that tee timing device for 16th Street Parking Lot was being considered. Councilman Davis reported that ittook three laborers 3 or 4 days to clear a small tract and that the tractor had cleared it in 30 minutes. Councilman Counihan asked when the 16th Street Parking Lot woul be ready for use. Superintendent Reed informed him that it would be Saturday that Wiias still some wiring to be roughed in. He also stated that nine loads had been placed at the Camp Site and between 130 and 140 loads more are needed, also now he has two garbage trucks operating. Councilman Couniha reported that a new pick up to replace the one used by Al Williams is needed and that he had gotten prices. Ford was the low bidder and moved that the Town purchase a Ford Pickup for $1670.96. 'Councilman Cary seconded and the motion passed. A petition for a refund of $50.00 was presented by Mr. Sidney Register claiming that he had paid for the sewer line to his property and when anyone tapped into it he was due a refund. Councilman Counihan moved that a refund be granted, Councilman Daniels seconded and the motion passed. The Mayor reported that Sgt. Wm. W. North, who had loaned his gun collection to the Tybee Museun, wants to sell the lot orcigQ a rental for their use. Councilman Counihan moved that the Town pay $2P. ent and also that an option be gotten to purchase the collection effective May 1, 1967. Councilman Daniels seconded and the motion passed. 131 Chief Price reported that the department is cooperating that it is functioning all right also that business is picking up and there is more activity. Councilmen Counihan and Daniels complimented the Police Department for doing a good job. The Mayor asked Mr. Solms if the Town could compel property owners to repair their build- ings based on a 50,E deteriation. Mr. Solms stated that they should be brought before Council and not be put on the docket. Councilman Cary reported that he had requested Mr. Tom Llewilyn to take pictures of the ten buildings that are being checked. It was decided to call a special meeting of Council for May,lOth and send registered letters to the owners notifying them to be present at this meeting. Councilman Daniels discussed salary increased for the Police Department stating that the Board should be realistic in this) that salaries paid are far below salaries in other Towns. Councilman Fleetwood read a list of the Police Department salaries proposed by Councilman Daniels. Councilman Counihan stated that the budget should be checked to see if all Town employees could be given a 5% increase. Councilman Davis stated that the Policd need more money and so does employees in other departments, that any increase should be across the hoard for all. Councilman Fleetwood stated that the Town has Workmen's Compensation and that is all. There is no Pension Plan for employees. The Mayor stated that if it can be gotten out of the budget that he will go along with it. Councilman Fleetwood stated that the Town has been going backwards financially since 1945. Councilman Counihan suggested discussing the matter and taking action at the next meeting on May 20th. Councilman Cary stated 4hat the Savannah Beach Volunteer Firemen receive no salary except the Chief who receives $30.00 per month. He felt that this salary should be increased to $60.00 per month for the coming year. The training program is good, inspection pro- gram is functioning, that owners of property are being notified whenever necessary to do so, and that he was going to Garden City to inspect their alarm system, also that a central location is needed to handle the alarms. He also stated that the Museum needs to be painted. Councilman Counihan asked why the Town paid for the Tybee School telephone. The Mayor informed him that it has been done for several years. Obuncilman Daniels informed Council that the Police Department was having some difficulty with the Mouse Trap operated by Nick Alexander, that'several weeks ago he was fined $28.00 for interferring with a police officer and had been warned, also that recently he was accused of committing another violation of selling beer to minors, and moved that his license for operating the Mouse Trap be held up pending the action in Police Court. Councilman Fleetwood seconded and the motion passed. The Mayor asked if Councilman Daniels would. consider letting the place remain open until next Monday. Councilman Daniels informed Council that he had received a letter from the Marine Rescue Squadron dated April 6, 1967 in which they requested that the old radio phones from the old police car be donated to them for use in their work. Councilman Counihan moved that the request be granted, Councilman Daniels seconded and the motion passed. Councilman Daniels speaking for Councilman Hohenstein, who was absent, requested funds to equip the soft ball diamond in the amount of $250.00. Mr. Seyden stated that his Committee had some equipment but needed more. Councilman Counihan moved that the request be grant- ed, Councilman Davis seconded and the motion passed. Councilman Davis reported that for mowing and grass cutting: Al present equipment is old, the Tractor is old, and wants permission to purchase a new mower for *350.00; as it would cost $200.00 to repair the old Tractor and $300.00 to repair the International and suggest- ed trading in the old Farma].. 132, Regarding new licenses for mixed drinks and package shopo Councilman Daniels moved that the License Ordinance be amended to charge a fee of 3750.00 for pouring or mixed drink license.and 350.00 for a package shop. Councilman Counihan seconded and the motion passed. Councilman Daniels stated that the Police Committee. approved the sale of whiskey and beer to Sidney A. McKissic, operator of t e DeSota Beach Cocktail Lounge and the beer license to Frederick Desposito at 15th Street and the Strand. Councilman Fleetwood seconded and the motion passed. A request was made from Roy C. Dunn to sell soft drinks by cart at the north end of the island. Referred to the License Committee. A protest was read from Mrs. Mary Harvard protesting against the high charge on her water. It was the opinion of Council that this water charge should be paid by her. Councilman Daniels requested Mr. Solms, assisted by Chief Price, to draw up a new schedule of Los and bonds. Councilman Counihan stated that he checked the tax digest and found that some property owners do not have water meters and also that duplex's do not have separate meters. He also stated that the Tybee Terrace Cottages should be on separate water meters. Councilman Cary asked if the tenant using water doesn't pay, who is responsible. Mr. Solms stated that the owner is responsible also that each one of the Tybee Terrace Cottages should be on a water meter. The Mayor suggested that everyone pay 330.00 for 100,000 gallons of water and then check.the meters every six months. Councilman Davis stated that they should be checot less than three times a year. Councilman Fleetwood stated that the Ordinances of the Town should be codified and that all Ordinances of the Town should be read once then read a second time. 1 Bills covering the several departments were approved for payment. Councilman Fleetwood moved that the 1udget Ordinance for 1967 be adopted, Councilman Counihan seconded and the motion passed. (SEE PAGE ) Councilman Cary moved that the Tax Ordinance covering Real Estate and Personal Property Taxes for the year 1967 be adopted. Councilman Daniels seconded and the motion passed. Councilman Fleetwood moved that the 1967 License Ordinance be adopted, Councilman Counihan seconded and the motion passed. SECTION I: Be it ordained by the Mayor and Councilmen of Savannah Beach, Tybee Island, in council assembled, and it is hereby ordained by the authority of the same, that license taxes for doing business and selling in the Town of Savannah Beach, Tybee Island, Georgia, for the fiscal year beginning on May 1, 1967, and ending on April 30, 1968, shall be payable by each person, firm or corporation transacting or offering to transact any of the kinds of businesses hereinafter specified and scheduled, or practicing or offering to practice any of the professions or callings hereinafter specified or scheduled, whether in connec- tion with any other business, profession or calling or not, and shall pay the license tax hereinafter prescribed on or before engaging in or practicing such profession or calling. The said report to the Clerk of Council of this municipality shall be made within 24 hours after the completion of said trade, purchase or acquisition of said junk or salvage. SECTION III: In the event any business or calling not specifically men- tioned in the above list set forth shall be established in the town of Savannah Beach, Tybee Island, Georgia, the Mayor and Councilmen reserve the right to establish a license fee for same by ordinance., which fee is to be of equal dignity as the license specifically mentioned in the above section, provided, however, that such license shall not be more than the sum of $750.00. SECTION IV: This ordinance shall be subject to alteration or repeal in whole or in part at any time during the fiscal year beginning May 1, 1967, should it be deemed advisable, and no such amendment or repeal shall be construed to impair the right of Council to assess or levy tax for the whole of such year whenever made. 10.00 15.00 25.00 15.00 25.00 10.00 50.00 SECTION V: No license shall be issued to any person, firm or corporation owning or operating an amusement ride of any kind for hire or a passenger vehicle of any kind for hire until such owner or operator has obtained a liability insurance policy with the following minimum limits , to -wit: Bodily injury in an amount of not less than $10,000.00 for each person and not less than $20,000.00 for each occurrence or accident and property damage of not less than $5,000.00 for each accident. This policy or a duplicate copy of this policy must be furnished to the Clerk of Council before the issuance of said license. Said insurance policy shall be endorsed to show that it cannot be cancelled for any cause, non - payment or otherwise, without notice thereof being given to the Clerk of Council of Savannah Beach, Tybee Island, Goergia, at least ten (10) days before said cancellation shall take effect. This policy must specifically cover passenger hazard or risk. SECTION V -a: In lieu of such policy of insurance, any person, firm or corporation owning or operating passenger vehicles for hire, before being issued a license therefor, shall deposit with the Clerk of Council a Surety Bond in the -7- / 32 -.T amount of $10,000.00 for each vehicle operated by said person, firm or corporation,' signed by surety company acceptable to the Mayor and Councilmen of Savannah Beach, said bond guaranteeing the payment of any loss or damage sustained by any person or . persons by reason of the operation of such vehicle, the exact form of such bond to be approved by the Mayor and Councilmen of Savannah. Beach. SECTION V -b: In lieu of such policy of insurance and /or such Surety Bond, any person, firm or corporation owning or operating a passengerv>ehicle for hire, before being issued a license therefore, shall deposit with the Clerk of Council a Real Estate Bond in the amount of $10,000.00 for each vehicle operated by said person, firm or corporation, signed by an owner of real estate who holds merchantable fee simple title to the same and acceptable to the Mayor and Councilmen of Savannah Beach, said bond guaranteeing the payment of any loss or damage sustained by any person or persons -by reason of the operation of such vehicle, the exact form of such Bond to be approved by the Mayor and Councilmen of Savannah Beach. If said Real Estate Bond is approved by the Mayor and Councilmen, the applicant for license shall pay the fee for recording of said bond in the Clerk's Office of the Superior Court of Chatham County, Georgia. SECTION VI: The Mayor and Counciomen reserve the right to refuse to issue to anyone any licenses for any purpose for reasons sufficient to them. SECTION VII: Any person procuring a license on or after November 1, 1967, shall pay one -half of the fee therefor set forth in this ordinance. SECTION VIII: Any person, firm or corporation violating any of the provisions of Section I of this ordinance shall, upon conviction before the Mayor's Court of said Town, be subject to be fined in the sum of not more than $100.00 or be im- prisoned not more than 30 days, either or both, or any portion of either or both, in the discretion of the Court. SECTION Ix: All ordinances or parts of ordinances conflicting with the provisions of this ordinance are hereby repealed. AN ORDINANCE AN ORDINANCE TO ASSESS AND LEVY A LICENSE TAX, UPON RETAIL DEALERS ENGAGED IN THE BUSINESS OF SELLING MALT BEVERAGES, WINE, OR SPIRI'TUOUS,LIQUORS, FOR THE FISCAL YEAR BEGINNING MAY 1, 1967, AND ENDING APRIL 30, 19 6 8; TO PROVIDE FOR THE COT:T.RCTION OF SAID LICENSE TAX; TO PROVIDE' 'FOR THE INSPECTION OF RECORDS AND BOOKS, BOTH WHOLESALE AND RETAIL DEALERS ENGAGED IN THE BUSINESS OF SELLING MALT BEVERAGES, WINE AND SPIRITUOUS LIQUORS; TO FIX PENALTIES FOR THE VIOLATION; AND FOR OTHER PURPOSES. /32 -/C SECTION I: Be it ordained by the Mayor and Councilmen of Savannah Beach, Tybee Island, in' Council' assembled, and it is hereby ordained by the authority of the same, that in addition to all other tax or license fees heretofore or hereafter imposed upon retail dealers engaged in Savannah Beach, Tybee Island, Georgia, in the business of selling malt beverages, wine, or spirituous liquors as defined under the laws of Georgia,'there is imposed and levied upon all such retail dealers within the town of Savannah Beach, Tybee Island, for the fiscal year beginning May 1, 1967, and ending April 30, 1968,' a license tax for the privilege of doing such business in Savannah Beach, Tybee ` Island, to be 'computed and collected as hereinafter set forth. The term "retail dealers" shall include clubs and similar organizations. SECTION II: The amount of the license tax imposed by this ordinance on such dealers shall be computed on the following basis: (a) 20 per case on bottled malt beverages where containers exceed 7 ounces , and 12 per case where containers contain 7 ounces or less. (b) $1.25 per 1/2 barrel of 15 -1/2 gallons on draught beer, proportionately in larger and smaller quantities. (c) 15 per quart on 1/5 gallon; 8 per pint or 1/10 gallon; and 0 per 1/2 pint or smaller, on spirituous liquors. (d) 60 per case on wine. (e) The aforesaid quantity license taxes shall be 50% of the amounts stated on all such legal alcoholic beverages manufactured or produced in Georgia using all Georgia products in the production or manufacture of such beverages. The term "case" as applied to wine shall mean a carton or other container containing 24 bottles of pint size or smaller, or 12 bottles of quart size, or 1/5 size. Fractional parts of cases or barrels , kegs, or drums, or any other size or type containers, shall be computed proportionately. SECTION III: (a) The license tax imposed herein on malt beverages and wines shall be computable and payable monthly; (b) Each wholesale dealer or distributor selling, shipping or delivering malt beverages or wines to any retail dealer in the town of Savannah Beach, Tybee Island, whether delivered to the retail dealer's place of business in Savannah Beach, or elsewhere, for re -sale in Savannah Beach, shall, as a condition to the privilege of carrying on said business in ;Savannah Beach: 1. Keep true and correct records of all sales , shipments or deliveries of such malt beverages or wines to each retail dealer in Savannah Beach, such records to be. preserved for a period of one year and to be made available on request for the inspection of any duly authorized representative of Savannah Beach, Tybee Island; 2. Collect from each such retail dealer in Savannah Beach and add on each invoice at the time of delivery . of the malt beverages and wines; the amount of license fax due .under the terms of this ordinance, and hold, the same in trust for Savannah Beach, Tybee Island, until such amount is remitted to the municipality as next provided; 3. On or before the 10th day of each calendar month, make a verified return to Savannah Beach, Tybee Island, for the monies collected from retail dealers for the month immediately preceding said report, accompanying said return with a remittance to Savannah Beach, Tybee Island, 'for all'license taxes collected. SECTION IV: If any wholesale dealer or distributor fails orrefuses to make the returns herein provided for, the town of Savannah Beach, Tybee Island, shall notify said party in writing, and if the returns are not made and the license taxes remitted within 5 days from date of said notice, the municipality may withdraw from said wholesale dealer or distributor the privilege of doing business in Savannah Beach by revoking his. license;. On such failure to make returns and pay the license taxes accrued, Savannah. Beach, Tybee Island, shall proceed to assess the amount of taxes due under this ordinance from retail dealers who have purchased from such wholesale dealer or distributor, from the best information available, and proceed to collect said license taxes as provided by ordinance for the collection of delinquent license taxes. SECTION V: Each wholesale dealer in spirituous liquors (which shall include all alcoholic beverages excepting beer and wine) shall keep 51-A and 51 -B records available for inspection at all times by duiy authorized agents and /or representatives of Savannah Beach, Tybee Island. Such records shall show the amount and quantity of each item sold by each wholesaler to each retailer and said wholesaler shall collect at the time of the delivery to said retailer the license tax imposed under this ordinance. SECTION VI: It shall be a violation of this ordinance for any person, firm or corporation to sell at retail within the town of Savannah Beach, Tybee Island, any malt beverages, wines , or spirituous liquors on which the license taxes herein provided for have not been paid to the- wholesale dealer or . distributor for the municipality. SECTION VII: It shall be unlawful and a violation of this ordinance for any wholesale dealer or distributor, person, firm or corporation, to deliver any malt beverages, wines , or spirituous . liquors to any retail dealer in the town of Savannah Beach without first collecting the license taxes. -10- 1.32 -/1 SECTION VIII: It shall be unlawful for any person, firm or corporation engaged in the sale as a retail dealer of alcoholic, vinous or malt beverages, to have in his possession any of such beverages unless the tax required by Savannah Beach, Tybee Island, shall first have been paid to the wholesaler, distributor or other source delivering or causing 'said beverages to be delivered to said retail dealer, and whenever any such beverages are found in possession of a retail dealer where records of the payment . of said tax shall not appear upon the records of the wholesale liquor dealer to the municipality, it will be presumed that said tax has not been paid ,and the burden shall be upon the retailer . to prove said fact. SECTION DC Any person, firm or corporation engaged in the distribution by wholesale of any of the beverages mentioned in said ordinance willfully violating the same s-hall be subject to revocation of their license to do business within the corporate limits of the town of Savannah Beach, and all liquor found in the possession of any retail establishment 'in said town of Savannah Beach which has not paid said tax- or reported same under said ordinance shall be subject to confiscation by the municipal authorities of Savannah Beach, Tybee Island, in addition to the other penalties set forth in said ordinance, and sold by the Chief of Police and Ex- Officio Tax Collector and the receipts thereof paid to the .Clerk of Council and, Ex- Officio :Treasurer. SECTION X: Any retailers violating the provisions of this ordinance shall, in addition to the penalties hereinabove set forth, be subject to revocation of their license to do business in said town as provided in other ordinances of Savannah Beach, Tybee Island. SECTION XI: Any person, firm or corporation violating any of the -provisions of this ordinance, or who shall assist any retail dealer in malt beverages, wines, or spirituous liquors in Savannah Beach, • Tybee Island, to evade or avoid the payment of the license taxes herein provided-for shall be guilty of a violation of this ordinance and on conviction thereof in the Mayor's Court of said town shall be fined not more than $100.00 or sentenced to imprisonment for not more than 30 days, or both punishments to be inflicted, in the discretion of the Recorder. SECTION XII :- All ordinances or parts of ordinances in conflict -with this ordinance . are hereby repealed. - 7- .. !3 2 -/U• AN ORDINANCE TO PROVIDE FOR THE TAXATION OF REAL AND PERSONAL PROPERTY IN SAVANNAH BEACH, TYBEE ISLAND, GEORGIA, FOR THE FISCAL YEAR COMMENCING MAY -1, 1967, AN D ENDING APRIL 30, ;1968, AND FROM YEAR TO YEAR UNTIL REPEALED; AND FOR OTHER PURPOSES. SECTION I: Be it ordained by the Mayor and Councilmen of Savannah Beach, Tybee Island, in council assembled, and it is hereby ordained by the authority of the same, that the rate of taxation upon real estate and property within the limits of said town of Savannah Beach, Tybee Island, for the fiscal year commencing May 1, 1967, shall be One and Twenty hundredths (1.20%) percent upon the assessed or returned value of same, the value of real estate . improvements to be ascertained - from the returns of the Committee on Assessments of said :Mayor and Councilmen, and the valuation of personal property to be ascertained from the returns of the owners thereof in _pursuance of the scheme and plan contained in Sections I, II, III and IV of the Ordinance to provide for the .assessment of taxable property in the town of Savannah Beach, Tybee Island, Georgia, and the mode of valuing such property for , taxation, and to carry into effect the provisions of the Act of the General Assembly of the State of Georgia approved August 19, 1922,. Section 21, as amended; and it is further ordained that if any person or persons shall refuse to pay the taxes hereinabove set forth, within 30 days after same shall become due, the Clerk of Council, as Ex- Officio Treasurer of the Town, shall issue execution therefor, and the further sum of $1.00 for costs, and the Chief of Police and Ex- Officio Tax Collector shall proceed with . such execution in the same manner as now provided by law in such cases of execution lodged with the Sheriff of Chatham County. SECTION II: Any tax upon real property assessed and due shall :be payable in semi - annual payments; the first half being due and payable on or before May 1st of each year the second half shall be due and payable on or before November 1st of each year. In the event that any tax is not paid when the same is payable, the outstanding amount shall be immediately executed, the fee for execution being $1.00, and in addition thereto an interest charge of one -half of one percent per month shall be assessed. The provisions of this Section shall not apply to licenses for doing business in said town, said licenses being covered under separate ordinance. The provisions of this Section shall apply, however, to those persons or companies required by the provisions of Section 92 -5902 of the Code of Georgia to make returns to the Comptroller General of Georgia. SECTION III: This ordinance shall continue in effect for each and every fiscal year hereafter unless and until repealed or changed by ordinance. SECTION IV: All ordinances or parts of ordinances conflicting with the provisions of this ordinance are hereby repealed; provided, however, that so much and such parts of ordinances passed, as provide for the execution of tax assessments, or part thereof, shall continue and remain in force so as to authorize the Clerk of Council and Ex- Officio Treasurer to issue execu- tions, and the Chief of Police and Ex- Officio Tax Collector to collect same until said taxes or assessments shall be fully paid. -12-
