ORDINANCE NO. 8 -2007
TRANSPORTATION - SHUTTLING
AN ORDINANCE TO AMEND THE CODE OF ORDINANCES FOR THE CITY OF
TYBEE ISLAND, GEORGIA, TO AMEND CHAPTER 34 TO CREATE A NEW ARTICLE
TO BE DESIGATED AS ARTICLE VI, SHUTTLE /TRANSPORTATION SERVICES, TO
PROVIDE FOR CODIFICATION, TO REPEAL CONFLICTING ORDINANCES, TO
PROVIDE AN ADOPTION DATE AND AN EFFECTIVE DATE, AND FOR OTHER
PURPOSES ALLOWED BY LAW.
WHEREAS, the duly elected governing authority for the City of Tybee Island, Georgia,
is authorized under Article 9, Section 2, Paragraph 3 of the Constitution of the State of Georgia
to adopt reasonable ordinances to protect and improve the public health, safety, and welfare of
the citizens of Tybee Island, Georgia, and
WHEREAS, the duly elected governing authority for the City of Tybee Island, Georgia,
is the Mayor and Council thereof, and
WHEREAS, the governing authority desires to adopt ordinances under its police and
home rule powers, and
WHEREAS, the governing authority desires to amend the Code of Ordinances for the
City of Tybee Island to evaluate certain transportation services.
NOW, THEREFORE, be it ordained by the governing authority of the City of Tybee
Island that Chapter 34 of the Code of Ordinances of the City of Tybee Island is hereby amended
to create a new article to be designated as Article VI, Shuttle /Transportation Services to hereafter
read as follows:
Section 34 -168
Any person engaging in the business of providing transportation for tourism, or shuttle or
similar services of multiple passengers for hire within the City shall be required to register and
secure a license and pay all appropriate taxes and fees as otherwise provided.
Section 34 -169
Any multi - person transportation vehicle shall secure an appropriate parking location for
all vehicles used in connection with the business as approved by the Director of Parking
Services.
Section 34 -170
Any person engaging in the business of shuttling or touring transportation services shall
maintain liability insurance in an amount of not less than one million dollars per occurrence in
aggregate liability coverages.
Section 34 -171
Any properly permitted business providing shuttle and /or transportation services shall be
allowed to designate locations for picking up and discharging passengers subject to the approval
of such locations by the City Manager or the City Manager's authorized designee. Such person
shall be authorized, notwithstanding the provisions of the sign ordinance of the City (Appendix
A, Land Development Code, Article VI) to designate and mark by appropriate banners or flags
not exceeding twelve (12) square feet, pick up and discharge locations. Such banners may
contain logos for the business. Each banner, flag or marking location shall be approved by the
City Manager or the City Manager's designee.
This Ordinance shall become of ective on /day of M AASI - , 2007.
