HomeMy Public PortalAboutOrdinance 3265 ORDINANCE NO. 3265 AN ORDINANCE AUTHORIZING THE ISSUANCE OF A SPECIAL USE PERMIT FOR DRIVE-THRU WINDOWS AT THE SOUTHWEST CORNER OF ROUTE 126 AND DRAUDEN ROAD, IN THE VILLAGE OF PLAINFIELD, WILL COUNTY, ILLINOIS WHEREAS, the Village of Plainfield has considered an application of Lenny's Gas N Wash Plainfield, LLC for a special use permit for drive-thru windows at the convenience store and the car wash to be located on property at the southwest corner of Route 126 and Drauden Road, and the Plainfield Plan Commission has made certain findings based on the evidence presented in said case that: a. The special use will not be injurious to the use and enjoyment of other property in the immediate area for the purposes already permitted, nor substantially diminish property values within the neighborhood; and b. The establishment of the special use will not impede the normal and orderly development and improvement of the adjacent properties for uses permitted in the subject zoning district. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF PLAINFIELD, WILL AND KENDALL COUNTIES, ILLINOIS AS FOLLOWS: Section 1: Recitals - The President and Board of Trustees of the Village of Plainfield hereby adopt and incorporate as their own, the above findings recited. Section 2: Approval — The President and Board of Trustees of the Village of Plainfield hereby approve the application for a special use permit for drive-thru windows at the convenience store and the car wash to be located on property at the southwest corner of Route 126 and Drauden Road, and legally described as follows: That Part Of The East 933.00 Feet Of The North 467.00 Feet Of The East Half Of The Northeast Quarter Of Section 18, Township 36 North, Range 9 East Of The Third Principal Meridian Lying East Of A Line Drawn 380 Feet West Of And Parallel With The West Line Of The Land Conveyed To The Village Of Plainfield, Illinois By Special Warranty Deed Dated March 23, 2005 Recorded April 22, 2005 As Document Number R2005-66843 (Except The Land Conveyed To The People Of The State Of Illinois For Right Of Way As Per Document No. 484648 And Except Therefrom The Land Conveyed To The Village Of Plainfield, Illinois By Special Warranty Deed Dated March 23, 2005 And Recorded April 22, 2005 As Document Number R2005-66843), In Will County, Illinois. PIN: 06-03-18-200-006-0000 (part of) Property Address: SW corner, Route 126 and Drauden Road, Plainfield, IL 60586 Section 3: Severability - The various portions of this Ordinance are hereby expressly declared to be severable, and the invalidity of any such portion of this Ordinance shall not affect the validity of any other portions of this Ordinance, which shall be enforced to the fullest extent possible. Section 4: Repealer - All ordinances or portions of ordinances previously passed or adopted by the Village of Plainfield that conflict with or are inconsistent with the provisions of this Ordinance are hereby repealed. Section 5: Effective Date — This Ordinance shall be in full force and effect from and after its passage and approval. PASSED THIS 16TH DAY OF MAY, 2016.
