A special meeting of Town Council was held today at 1 :00 P.M., in the Town Hall and was attended by Mayor Brown, who presided, and Councilmen Davis, Cary, Hohenstein, Fleetwood and Daniels, Town Attorney Solms, Chief Price. The meeting was called to discuss the closing of the places selling alcohol beverages on Sundays under orders of Govenor Maddox of Georgia, and also ways and means to handle the matter. The Mayor informed Council thatGovernor Maddox has ordered all places dispensing alcohol beverages be closed from Saturday midnight to Sunday midnight. Councilman Daniels stated that Sheriff Griffin has called the Mayor and himself, informing them that the Governor issued orders that all places selling alcoholic beverages be closed on Sundays and that the law wild -bet.enforced -- he attended a meeting a which Mr. Eugene McCracken, attorney for the liquor dealers, was present and it was agreed that the enforcing of the law be left with the municipalities, that Mr. McCracken stated the Legislature has put the laws on the books, pouring is now legal -- Mr. Solms stated that there is no doubt about it. Councilman Fleetwood stated that Council can make a pouring Ordinance, it is a separate operation -- Council is authorized to set up rules, as Town has Ordinance on books. Councilman Davis read from several statutes -- stated that Council has shirked its duty -- operators were given word that sales would not be stopped -- Councilman Daniels stated that he did not remember this -- Mr. Solms read a clipping from the Savannah Press regarding closing which stated that Atlanta is in direct violation of the law -- all Sunday sales are illegal. Councilman Fleetwood suggested passing an Ordinance today to close them, it might be unconstitutional, if they stay open it is up to them -- Chief Price be notified to have them closed. Mr. Solms stated that Georgia statutes of 1956 gave cities power to regulate operations -- bars have always been regulated by Police Committee of Council Councilna Hohenstein asked if bars are alowwed to remain open would there be any retaliations -- Mr. Solms replied that there probably would be -- Councilman Darnels stated that he always has gone aloe. with Sunday sales -- Councilman Dada°m stated that there is no Ordinance. Daniels Councilman/stated that the Laws of Georgia should be eom.ed with -- Councilman Fleetwood stated as regards to restaurents and bars. Councilman Daniels moved that an Ordinance be p.ssed to discontinue sale of alcoholic beverages from Saturday midnight to Sunday midnight -- Councilman Cary seconded -- those voting YES - Cary, Hohenstein and Daniels: thsoe voting NO - Fleetwood and Davis. Councilman Fleetwood moved that.the Ordinance be amended not to apply to mixed drinks in lounges and restaurants - only to package shops -- Mr. Solms stated that the hours can be regulated by Police Committee -- Councilman Davis seconded the motion - those voting YES - Fleetwood and Davis -- those voting NO - Cary, Hohenstein and Daniels. Placed on first reading; ORDINANCE AN ORDINANCE TO PROVIDE RULES AND REGULATIONS FOR THE RETAIL SALE OF ALCOHOLIC BEVERAGES OR DISTEILLED SPIRITS FOR BEVERAGE PURPOSES BY THE DRINK AS PROVIDED BY GEORGIA LAWS 1964, PAGE 771, (GA. CODE ANNOTATAED H58 -1083; TO PROVIDE A PENALTY FOR THE VIOLATION THEREOF AND FOR: OTHER PURPOSES. SECTION I g Be it ordained by the Mayor and Councilmen of Savannah Beach, Tybee Island, in Council assembled, that the following rules and regulations for the retail sale of alcoholic beverages or distilled spirits for beverage purposes by the drink, said sales to be for sonsumpj:ion on the premises only, shall be governed by the following , to wit: (a) - Said business shall not open before 9:00 a.m.o'clock on Monday through Saturday of each and every week. (b) - Said business shall not open before 1:00 p.m. o'clock on Sunday. (c) - Said businesses shall close not later than 3 :00 .m. o'clock each and every day of the week. The proprietor of such business shall clear all customers and patrons from the premises of his -,place of business not later than 3 :00 a.m. o'clock. (d) - Said businesses shall not be authorized to do business other than during the hours herein stipulated. SECTION 11 - The owner and operator of each such place of business shall be responsible for the compliance with this Ordinance. SECTION 111A Any person, firm or corporation violating any of the provisions of this Ordinance shall, upon conviction before the Recorder's Court of said Town, be subject to be fined in the sum of not more than $100.00 or to be imprisoned not more than 30 days, either or both, or any portion of either or both, in the discretion of the Court, and /or revocation of license. SECTION 14 g All Ordinances or parts of Ordinances conflicting with the provisions of this Ordinance are hereby repealed. 145 A letter from U.L.Harley regarding his lot 11, block 12, F.S.Ward, was read. A special meeting of Council was held today 5:00 p.m., in the Council Room and was attended by Mayor Brown, who prseided and Councilmen Davis, Hohendtein, Daniels, Fleetwood, Counihan, Carey. The meeting was called for the purpose of considering the sale of mixed drinks on Sunday. Councilman Daniels stated that he was against operating on Sunday - that Atlanta Judge Dyer has issued &_ order stopping enforce%• ment of the law - the Mayor statedthat if Atlanta to close neither should we - Councilman Daniels also stated that if• mixed drinks are allowed to be sold, then beer should be allowed too. Councilman Fleetwood read a letter from Town Attorney Solms, dated August 4, 1967, giving his opinion that to permit sales on Sunday would be a violation of the laws of Georgia. The Mayor read the Ordinance Councilman Davis moved that it be adopted, Councilman Fleetwood seconded and the motion passed - on second reading - unanamously: ORDINANCE. r-7-1 AN ORDINANCE TO -PROVIDE RULES AND REGULATIONS FOR THE RETAIL SALE OF ALCOHOLIC BEVERAGES OR DISTILLED SPIRITS FOR BEVERAGE PURPOSES BY THE DRINK AS PROVIDED BY GA. LAWS 196., page 771, (GA. CODE ANNOTATED EB 58 -1053: TO PROVIDE A PEN TY FOR THE VIOLAT DN THEREOF AND FOR OTHER PURPOSES. SECTION I: Be it ordained by the Mayor and Councilmen of Savannah Beach, Tybee Island, in Council assembled,.that the following rules and regulations for the retail sale of alcoholic beverages or distilled spirits for beverage purposes by the drink, said sales to be for consumption on the premises only, shall be goverened by the following, to wit: (a) Said businesses shall not open before 9 :00 a.m.,o'clock on Maday through Saturday of each andkevery week. (b) Said bisinesses shall not open before 1:00 p.m. o'clock on Sunday. Said b.sinesses shall close not later than 3:00 a.m. o'clock each and every day of the week. The pmoprietor of business shall clear all customers and patrons from the premises of his place of business not later than 3 :00 a.m. o'clock.
