A GENERAL ORDINANCE AMENDING SECTION 97.02
OF THE CITY OF RICHMOND CODE
WHEREAS, the Richmond Street Tree Commission currently consists of ten (10)
members; and
WHEREAS, the person holding the position of Director of the Department of Public
Works and Engineering is designated a member of the Street Tree
Commission by City of Richmond Code; and
WHEREAS, due to the time demands placed on the Director of the Department of Public
Works and Engineering it is desirable that said Director have the option to
designate an employee of the department to serve on the Street Tree
Commission; and
WHEREAS, it is also desirable to have a representative of the Department of Parks and
Recreation serve on the Street Tree Commission; and
WHEREAS, in a letter dated December 18, 1996, the Street Tree Commission conveyed
their unanimous recommendation that current City Code be amended to
incorporate certain changes.
NOW, THEREFORE, be it ordained by the Common Council of the City of
Richmond, Indiana, that Section 97.02 of the City of Richmond Code is hereby amended
to read as follows:
97.02 MEMBERSHIP
The Commission shall be comprised of eleven (11) members, each of whom shall
be entitled to one vote. Said members shall serve without compensation and shall adopt
their own by-laws including the designation and election of officers.
(a) Three citizen members shall be appointed by the Mayor, for 3-year
staggered terms beginning with 1, 2 & 3 year terms respectively.
(b) Three citizen members shall be appointed by City Council, for 3-year
staggered terms beginning with 1, 2 & 3 year terms respectively.
(c) One member shall be appointed by the Richmond Advisory Plan
Commission.
(d) The Director of the Department of Public Works and Engineering or an
employee of said Department designated by the Director of said Department shall
serve by virtue of holding such office.
(e) The Superintendent of the Transnussion and Distribution Department of
Richmond Power and Light or an employee of said Department designated by the
Superintendent shall serve by virtue of holding such office.
(f) A member of Common Council shall be designated by the President of the
Council annually.
(g) The Superintendent of the Department of Parks and Recreation or an
employee of said Department designated by the Superintendent of said Department
shall serve by virtue of holding such office.

RI?: Vacation Petition No. 5-1997 (Ordinance No. 29-1997)
Deer Mr. Dickman:
Please advise the members of Common Council that the Richmond Advisory Plan
Commission conducted a public hearing, Thursday, April 25, 1997, on the petition to
vacate the public place described as 30 feet off the entire east side of Lot Number 49
in M. Parry's Addition to Greenwood, now a part of the City of Richmond, located at
the northeast corner of South M and 11th Streets.
The owners represent that:
(1) 'The additional right-of-way is not necessary to promote adequate and proper
traffic flow; and
(2) There are no plans or circumstances under which the future: use of said public
wav would be necessary; and
(3) The requested change would provide clear title for the property without
creating any practical effect.
Tlie Commission voted 7 in favor and none opposed, with 4 absent, to recommend
tlhe passage of Vacation Petition No. 5-1997 and amended Ordinance No. 29-1997
