AN ORDINANCE GRANTING PRELIMINARY APPROVAL TO A COMMERCIAL
DEVELOPMENT UNIT PROJECT IN A C-2 COMMERCIAL DISTRICT ON
PROPERTY LOCATED ON THE EAST SIDE OF CHESTER BOULEVARD IN THE
2500 BLOCK PURSUANT TO ARTICLES 31, 45, AND 48 OF CHAPTER 154 OF
THE CODE OF ORDINANCE, COMMONLY KNOWN AS THE ZONING ORDINANCE OF
THE CITY OF RICHMOND, INDIANA.
WHEREAS, the Zoning Map which is a part of Ordinance No.
2325-1968 designates and describes as C-2
Commercial District the property located on the
east side of Chester Boulevard in the 2500 block;
and,
WHEREAS, it is the intent and purpose thereof, pursuant to
Article 31, 45, and 48 of the Zoning Ordinance, to
grant preliminary approval of a Commercial
Development Unit Project on the above said
property; and,
WHEREAS, a study of this Ordinance was conducted by the
Richmond City Plan Commission the day
of ,1988, at which time remonstrances
were heard from all parties interested in or
affected by this Ordianance; and,
WHEREAS, the vote of the Richmond City Plan Commission
was to in favor of/in opposition to
recommending the passage of Ordinance No. 62-1988.
NOW THEREFORE BE IT ORDAINED BY the Common Council of the
City of Richmond, Indiana as follows:
SECTION 1. That pursuant to Article 31, 45, and 48 of the
Zoning Ordinance preliminary approval for a
Commercial Developement Project on the property
described below is hereby granted.
Being a part of the Northwest Quarter of Section 21, Township 14
North, Range 1 West in the City of Richmond, Wayne County,
Indiana, and being more particularly described as follows:
Beginning at a point in the west line of the Northwest Quarter
of said Section 21, said point being 553.19 feet north 0 degrees
and 48 minutes east of an iron rod found at the southwest corner
of said Northwest Quarter, and running thence, from said
beginning, continuing north 0 degrees and 48 minutes east, along
said west line 736.48 feet to a point; thence south 89 degrees
and 12 minutes east, 287,23 feet; thence north 0 degrees and 48
minutes east, parallel to the west line of said Northwest
Quarter, 54 feet to a point; thece south 89 degrees and 12
minutes east, 312.89 feet to an iron rod set; thence north 0
degrees and 48 minutes east, parallel to said west line, 399.35
feet to an iron pipe found in the southwardly right-of-way line
of the Cart Road; thence along a curve in the southward
right-of-way of said Road having a 858.51 foot radius curve to
the left, a chord which bears north 55 degrees and 01 minutes
east, a distance of 236.26 feet to the point of tangency of said
curve; thence north 47 degrees and 08 minutes east, along said
right-of-way, 173.96 feet to a point of curve in said southward
right-of-way; thence along the curve in the southward
right-of-way of said Road having a 914.93 foot radius curve to
the right, a chord which bears north 58 degrees, 24 minutes and
05 seconds east, a distance of 357.76 feet to an iron pipe
found; thence south 0 degrees, 48 minutes and 56 seconds west,
1666.27 feet to an iron pipe found; thence north 87 degrees, 57
minutes and 19 seconds west, 1219.59 feet to the place of
beginning.
AND ALSO, "Being a part of the Northwest Quarter of Section
Twenty-one (21), Township Fourteen (14) North,
Range One (1) west, in the City of Richmond,
Indiana, and being more particularly described as
follows: Beginning at a point on the west line
of the Northwest Quarter of Section Twenty -One
(21), said point being five hundred fifty and
fifty-five hundredths (550.55) feet north of the
southwest corner of said Northwest Quarter, and
running thence, from said beginning point, south
eighty-eight (88) degrees and forty-five (45)
minutes east, assuming the west line of said
Northwest Quarter to run north and south, a
distance of five hundred sixty and five hundredths
(560.05) feet; thence south, parallel to the west
line of said Northwest Quarter, two hundred five
and twenty hundredths (205.20) feet; thence north
eighty-eight (88) degrees and forty-five (45)
minutes west, five hundred sixty and five
hundredths (560.5) feet to a point on the west
line of said Northwest Quarter; thence north,
along said west line, two hundred five and twenty
hundredths (205.20) feet to the place of
beginning, containing an area of two and sixty-
four hundredths (2.64) acres, more or less.
SUBJECT TO: The right-of-way of all legal
highways.
SECTION 2. This Ordinance shall be in full force and effect
from and after its passage and approval as by law
required.

Dear Mrs. Hutton, Members of Common Council, and Ms. Merchanthouse:
Mr. Bob Bever, Agent for the petition of Diane Jaffe and Richard Siebert, requesting
preliminary approval for a commercial development unit project on property located in the
2500 block of Chester Boulevard, notified the Richmond City Plan Commission at its regularly
scheduled meeting on April 26, 1989, that the petitioners desire to withdraw their petition.
As such, Ordinance No. 62-1988 should be stricken.
