S. Chu Terrace Hi Chantel! I hope you had a great holiday. Smith Cottage #4, at 8 T.S. Chu Terrace, is not listed in the Georgia or National Registers. Per the attached letter of February 25, 2014, the complete required documentation for nomination has not yet been received. These minimal requests remain outstanding at this time, and an additional photography submission will now be required, as NR photography requirements have changed since the date of this letter. Further, because this property is being rehabilitated using HP tax incentives, the property will not be formally nominated to the registers until rehabilitation is complete and has been certified by HPD's Tax Incentives staff, as noted in the attached letter. I have CU Carole Moore on this email- I encourage you to reach out to her regarding the status of rehabilitation certification. They also advised that enforcement was through the courts and not a code compliance issue (don't know why they added that but thought I'd pass it along). Here's the requirements (my comments in red italics): Per ADA website (http://www.ada.gov/rec13a.htmi) Sec.36.405 Alterations: Historic preservation. (a) Alterations to buildings or facilities that are eligible for listing in the National Register of Historic Places under the National Historic Preservation Act (16 U.S.C. 470 et seq.), or are designated as historic under State or local law, shall comply to the maximum extent feasible with section 4.1.7 of appendix A to this part. (I think feasible is the operable word here) (b) If it is determined under the procedures set out in section 4.1.7 of appendix A that it is not feasible to provide physical access to an historic property that is a place of public accommodation in a manner that will not threaten or destroy the historic significance of the building or facility, alternative methods of access shall be provided pursuant to the requirements of subpart C (below) of this part. (therefore ADA requirements that would impact the NR eligiblity are waived - seems to be no different than the FEMA requirements, which would jeopardize NR eligiblity and the securing of tax credits) Sub Part C: It specifically states in Section 8.31 Historic Properties that "Accessibility to historic properties subject to alterations need not be provided if such accessibility would substantially impair the significant historic features of the property or result in undue financial and administrative burdens." CIUCEVICH, PRINCIPAL 13-02S-0 Ray Hord, Building Official RECEIVED c f City of Tybee Island 403 Butler Avenue Tybee Island, GA 31328 RE: 8 T.S. Chu Terrace — ADA Compliance and National Register—eligible historic resources undergoing a tax advantaged rehabilitations Mr. Hord: I am writing in reference to the tax advantaged rehabilitation of 8 T.S. Chu Terrace and the issue of ADA compliance. In my view, this project is waived of most regulations related to ADA as these modifications to the structure would render the building ineligible for listing on the National Register and in turn, endanger the securing of tax incentives for the property owner. Sec.26.405(b) of the Americans with Disabilities Act (re -printed below) clearly states that if it is "not feasible to pr ovide physical access to an historic property that is a place of public accommodation in a manner that will not threaten or destroy the historic significance of the building or facility, alternative methods of access shall be provided pursuant to the requirements of subpart C of this part. Subpart C effectively waives ADA compliance as it specifically states in Section 8.31 that "Accessibility to historic properties subject to alterations need not be provided if such accessibility would substantially impair the significant historic features of the property or result in undue financial and administrative burdens." My client is more than willing, however, to comply with those ADA regulations that do not jeopardize the buildings historic status, such as safety hand rails in bathrooms or other reversible accessories and or alterations that are clearly compliant with the Secretary of Interiors Standards for Rehabilitation. Installation of a handicap access ramp is problematic, however, as existing setbacks on the sides of the building prevent construction of a ramp in the most suitable section of the building as recommended by the Secretary's Standards. As a result, we are recommending that the wheelchair ramp be excluded from minimum compliance. 22 WEST BRYAN ST., #139, SAVANNAH, GA 31401 912-233-8655 RACQUATREFOIL@AOL.COM QUATREFOIL CONSULTING HISTORIC PRESERVATION CONSULTANTS ROBERT A.
