They also advised that enforcement was through the courts and not a code compliance issue (don't know why they added that but thought I'd pass it along). Chu Terrace — ADA Compliance and National Register—eligible historic resources undergoing a tax advantaged rehabilitations Mr. Hord: I am writing in reference to the tax advantaged rehabilitation of 8 T.S. Chu Terrace and the issue of ADA compliance. In my view, this project is waived of most regulations related to ADA as these modifications to the structure would render the building ineligible for listing on the National Register and in turn, endanger the securing of tax incentives for the property owner. Sec.26.405(b) of the Americans with Disabilities Act (re -printed below) clearly states that if it is "not feasible to pr ovide physical access to an historic property that is a place of public accommodation in a manner that will not threaten or destroy the historic significance of the building or facility, alternative methods of access shall be provided pursuant to the requirements of subpart C of this part. Subpart C effectively waives ADA compliance as it specifically states in Section 8.31 that "Accessibility to historic properties subject to alterations need not be provided if such accessibility would substantially impair the significant historic features of the property or result in undue financial and administrative burdens." My client is more than willing, however, to comply with those ADA regulations that do not jeopardize the buildings historic status, such as safety hand rails in bathrooms or other reversible accessories and or alterations that are clearly compliant with the Secretary of Interiors Standards for Rehabilitation. Installation of a handicap access ramp is problematic, however, as existing setbacks on the sides of the building prevent construction of a ramp in the most suitable section of the building as recommended by the Secretary's Standards.
