HomeMy Public PortalAbout063-1988- AMENDING ARTICLE 30 OF CHAP 154AMENDED GENERAL ORDINANCE NO. 63-1988 AN ORDINANCE AMENDING ARTICLE 30 OF CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO.2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA. WHEREAS, it is the intent of this Ordinance to amend Article 30 Of Chapter 154 of the Municipal Code; and, WHEREAS,a study of this Ordinance was conducted by the Richmond City Plan Commission the ? 7rz day of 1988, at which time remonstrances were he rd�f�romJall parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the City Plan Commission was 7 0 / in favor of/in recommending the passage of Ordinance No. 63-1988. NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond, Indiana as follows: SECTION 1. That Article 30.003 shall be amended to read as follows: 30.003 Retail and Service Uses as follows: (35) Laboratories, medical, dental, industrial, research, experimental, and testing,(including actual production for experimental and testing purposes only and not for sale or transfer, except that sale or transfer for test marketing purposes shall be permitted), provided there is no danger from fire or explosion nor of offensive noise, vibration, smoke, dust, odors, heat, glare or other objectionable influence. SECTION 2. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. DOOLEY DIRECTOR OF PLANNING, PERMITS AND fNSPECTIONS Dear Mrs. Morris, Members of Common Council and Mrs. Merchanthouse: The Richmond City Plan Commission conducted a public hearing on September 27, 1988, on its own initative to consider an amendment to the Zoning Ordinance, being Chapter 154 of the Code of Ordinances. The C-1 District regulations, in Article 30.003 (35), presently allow laboratories, medical, dental, research, experimental and testing facilities, provided there is no danger from objectional elements. It is the Plan Departments's opinion, that this language would allow research and development facilities of the type contemplated by the Belden on their premises at 2200 U.S. 27 South. In discussing this with Belden's attorney, it was requested that this issue be put before the Plan Commission and Common Council in the form of a Zoning Ordinance amendment to clarify this section of the Ordinance. The proposed Ordinance provides that industrial research and development facilities would be allowed in Commercial Zoning Districts, including production operations for testing and experimental purposes only. During the public hearing, the Commission determined that the proposed Ordinance should be further amended to provide that the transfer or sale of materials should be permitted for test marketing purposes only. The Plan Commission voted seven (7) to one (1) to recommend that Common Council adopt Ordinance No. 63-1988 as amended.
