HomeMy Public PortalAbout2020.144 - (10-20-20)RESOLUTION NO. 2020.144 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA AUTHORIZING A MEASURE LH OVERSIGHT COMMITTEE TO REVIEW EXPENDITURES OF MEASURE LH FUNDS, INFORM THE PUBLIC OF THE EXPENDITURES, AND REPORT ANNUALLY TO THE CITY COUNCIL ON THE OVERSIGHT COMMITTEE'S ACTIVITY WHEREAS, on August 4, 2020, the City Council initiated the process to levy an annual excise tax on each hospital engaging in business within City limits, known as Measure LH; and WHEREAS, the tax to be imposed by Measure LH would be an amount equivalent to three percent (3%) of the hospital's gross receipts; and WHEREAS, Measure LH has been placed on the November 3, 2020, ballot; and WHEREAS, Measure LH is a general tax, which refers to a general levy by a government that offers no special benefit to the taxpayer, but instead support to governmental programs that benefit all; and WHEREAS, the proceeds from the Measure LH would be deposited into the City of Lynwood's general fund and could be used for any and all municipal purposes; and WHEREAS, Measure LH would be operative if a majority of the electors voting on the measure vote to approve the imposition of the tax at an election called for that purpose; and WHEREAS, if Measure LH is approved by the voters on November 3, 2020, it is the desire of the City Council of the City of Lynwood to establish a Measure LH Oversight Committee that would be responsible for reviewing expenditures of Measure LH funds, informing the public of these expenditures, and reporting annually to the City Council on the Committee's activity; and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY FIND, DETERMINE, ORDER AND RESOLVE AS FOLLOWS: Section 1. The City Council of the City of Lynwood hereby authorizes the creation of a Measure LH Oversight Committee following the approval of Measure LH by the voters on November 3, 2020. Section 2. The City Council of the City of Lynwood establishes the below procedures for the Measure LH Oversight Committee. A. Composition and Appointment of Members. The Measure LH Oversight Committee shall consist of five (5) members, with each Council Member appointing one member. For purposes of this section, each Council Member shall be deemed the "appointing authority." B. Residency Requirement. Members must reside in the City of Lynwood at the time of their appointment and for the duration of their term. C. Term. The members shall be appointed to a term of two (2) years. Members may be reappointed to subsequent terms. If the appointing Council Member no longer serves, then the term of his or her appointed member may expire if the new Council Member exercises his or her authority to appoint a new member of his or her choosing. D. Compensation. Members of the citizen oversight committee shall be paid a stipend of fifty dollars ($50.00) for each monthly meeting he or she attends. E. Removal. Committee members shall serve at the pleasure of their appointing authority, and may be removed without cause. F. Organization and Meetings. The members shall elect a Chairperson and Vice Chairperson, who shall serve for a one-year term. The Measure LH Oversight Committee shall meet at Lynwood City Hall, once a quarter and at an established date and time suitable for this purpose, as established by the Measure LH Oversight Committee, in consultation with the City Manager, or his or her designee. G. Scope of Duties. The Measure LH Oversight Committee would be responsible for reviewing expenditures of Measure LH funds, informing the public of these expenditures, and reporting annually to the City Council on the Committee's activity. H. City Staff Assistance. The City Manager, or his or her designee, may provide the Measure LH Oversight Committee with staff assistance. I. Vacancy. A vacancy on the Measure LH Oversight Committee will exist whenever a member resigns, ceases to reside in the City of Lynwood, dies, or is removed. The vacancy shall be filled by appointment by the Council Member who appointed said member for the unexpired portion of such term. J. Absences. Section 2-12.1 of the Lynwood Municipal Code shall apply to absences of Measure LH Oversight Committee, and implications and/or consequences for same. Section 3. The City Council of the City of Lynwood hereby directs the Department of Finance and Administration Services to take the necessary steps to adjust the FY 2020- 21 budget to reflect the authorized appropriation of unappropriated general fund balance for use of said Measure LH Oversight Committee as follows: 2 Fund Dept. Div. Object Description Amount 1011 51 TBD 60999 Other Pay (Stipends) $1,000 1011 51 TBD 65020 Operating Supplies $1,250 1011 Budgetary Fund Balance $ 2,250 Section 4. The City Council hereby authorizes the City Manager or his designee to take necessary steps, including the execution of agreements and other related documents as needed to undertake the implementation of all event related services at a cost not to exceed $10,000. Section S. The City Clerk shall certify to the adoption of this resolution and hereafter the same shall be in full force and effect. PASSED, APPROVED and ADOPTED this 20th day of October 2020.
