HomeMy Public PortalAbout072-1988-ZONING - 1804 RICH ROADORDINANCE NO.72-1988 AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, PROVIDING FOR THE REZONING OF THE PROPERTY LOCATED AT 1804 RICH ROAD, FROM M-2 GENERAL INDUSTRIAL DISTRICT TO R-2 SINGLE FAMILY RESIDENCE DISTRICT. WHEREAS, the Zoning Map which is a part of Ordinance No. 2325-1968, designates said property as M-2 General Industrial District; and, WHEREAS, it is the intent and purpose hereof to change the zoning classification of said property from M-2 General Industrial District to R-2 Single Family Residence District; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the a ,5_c day of cf1988, at which time remonstrances were heard form all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Plan Commission was to_V in favor of recommending the passage of Ordinance NO. 72-1988. NOW THEREFORE BE IT ORDAINED by the Common Council of The City of Richmond, Indiana, as follows: SECTION 1. That the zoning classification of the property described below, and the same is hereby changed to R-2 Single Family Residence District, and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana and all amendments thereto: A part of Fractional Section Twenty -Five (25), Township Fourteen (14), Range Two (2), West, bounded and described as follows, to -wit: Beginning at a point in the center in the center of the Richmond and Nolans Fork Turnpike Road where the same crosses the east line of said fractional section; thence north along said section line thirteen and one-half (13 1/2 ) rods, thence west twelve (12) rods; thence south thirteen and one-half (13 1/2) rods to the center of said road; thence east along the center of said road to the place of beginning, containing one (1) acre more of less. SECTION 2 This Ordinance shall be in full force and effect from and after its passage and approval as by law required. WALTERMANN MAYOR OANIEL S. OOOLEY DIRECTOR OF PLANNING, PERMITS AND INSPECTIONS The Richmond City Plan Commission conducted a public hearing on Tuesday, October 25, 1988, on the petition of Mary E. Bowling, owner, Portia Warren, Agent, requesting to rezone property located at 1804 Rich Road, from M-2 General Industrial to R-2 Single Family Residence District, Six (6) notices of public hearing were sent to the surrounding residents with none returned. During the public hearing no one spoke in opposition to the petition. The use of the property in question is residential and it is adjacent to other residential land uses. The Plan Commission determined that the Industrial zoning classification assigned to the property was in error.
