HomeMy Public PortalAbout073-1988- ZONING - 2510 CHESTER BOULEVARDORDINANCE NO. 73-1988 AN ORDINACE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING OF PROPERTY LOCATED AT 2510 CHESTER BOULEVARD FROM C-2 COMMERCIAL DISTRICT TO C-2 SU COMMERCIAL SPECIAL USE DISTRICT AND AUTHORIZING THE SPECIAL USE OF SAID PROPERTY AS A MOTOR VEHICLE SERVICE STATION. WHEREAS, the Zoning Map which is a part of Ordinance No. 2325-1968 designates and describes as C-2 Commercial District the property located at 2510 Chester Boulevard; and, WHEREAS, it is the intent and purpose hereof, to change the zoning classification of said property to C-2 SU Commercial Special Use District and to authorize the Special Use of said property as a motor vehicle service station; and, WHEREAS a study of this Ordinance was conducted by the Richmond City Plan Commission eF AaiL=Q1 /,/-, P R d I-OA? 1988, at which time remon ts' r'a ces were heard from all parties interested in or affected by this Ordinance; and, WHEREAS the vote of the Richmond City Plan Commission was 7 to z in favor of/' recommending the passage of Ordinance No. 73-1988. NOW THEREFORE BE IT ORDAINED BY the Common Council of the City of Richmond, Indiana as follows: SECTION 1.That the zoning classification of the property described below, and the same is hereby changed to the C-2 SU Commercial Special Use District, and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana ans all amendments thereto. Part of the Northeast Quarter of Section 20, Township 14 North, Range 1 West, in the City of Richmond, Indiana, and being more particularly described as follows: Beginning at a point in the east line of the Northeast Quarter of said Section 20, and the centerline of United States Highway Number 27, as it currently exists, said point being 1518 feet north (measured along the east line of said Northeast Quarter and along the centerline of said Highway) of the southeast corner of said Northeast Quarter, and running thence from said beginnig point, west, and parallel to the south line of said Northeast Quarter, 228 feet; thence south parallel to the east line of said Northeast Quarter, 162 feet to a point in the northline of Catalpa Drive; thence east, parallel to the south line of said Northeast Quarter, and along the north line of said Catalpa Drive, and said north line extended, 228 feet to a point in the east line of said Northeast Quarter and the centerline of said Highway; thence north along said east line and along said centerline, 162 feet to the place of beginning. Also, Lots Numbered Fifteen (15) and Sixteen (16) in Highland View Subdivision being a part of the Northeast Quarter of Section Twenty (20), Township Fourteen (14) North, Range One (1) West. SECTION 2. That as provided in Articles 31 and 48 of Chapter 154 of the Municipal Code, the following described use of the above described property is allowed as a Motor Vehicle Service Station. Ordinance No. 73-1988 Page 2 SECTION 3. That the Special Use Petition and Site Plan shall marked Exhibit "A" and made apart of this Ordinance. SECTION 4. This Ordinance shall be in full force and effect from, and after its passage and approval as by law required. Mayor ATTEST • • City Cl(brk CITY PLAN COMMISSION RICHMOND, INDIANA December 15, 1988 Mrs. Lynn Morris, President Members of Common Council and Mrs. Mary Merchanthouse, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance No. 73-1988 Plan Commission Case PC-88-16 Dear Mrs. Morris, Members of Common Council and Mrs. Merchanthouse: The Richmond City Plan Commission conducted public hearings on October 25, 1988, November 22, 1988, and December 13, 1988 on the petition of Road America, Inc., owner, John Whalen, Agent, requesting to rezone property located at 2510 Chester Boulevard from C-2 Commercial District to C-2 SU Commercial Special Use District, and also requesting Special Use Authorization for a motor vehicle service station. Forty -Three (43) notices of public hearing were sent to the surrounding residents with five (5) returned in opposition to the petition. During the public hearing four (4) persons spoke in opposition to the petition. Road America, Inc. is currently operating a Mobile Service Station at 2510 Chester Boulevard. This property is zoned C-2 Commercial District. Kocolene Oil Corporation desires to purchase the property, demolish the existing service station and construct a new service station and convenience store. The requirements of the zoning Ordinance are such that a new service station may be constructed on the property only after a rezoning to the Special Use District. The Plan Commission conducted three (3) public hearings on the petition. Residents in the area spoke of their concerns about drainage problems along Catalpa Drive and about traffic congestion on Chester Boulevard. Concerns were also expressed about the impact of the proposed service station on the Green Acres facilities on Mendelson Drive. The Special Use site plan indicates a new curb cut for the proposed service station on Mendelson Drive opposite the curb cut for Richard's Restaurant. Concerns were expressed about the impact of increased traffic on Mendelson Drive on the children using the Green Acres facilities. The Plan Department conducted three (3) meetings with representatives of Kocolene Oil Corporation, Indiana Department of Highways, Richmond Sanitary District and the Traffice Division of the Police Department, to resolve the drainage and traffic concerns. The Plan Commission determined that the petition conplies with the requirements of the Zoning Ordinance and therefore voted seven (7) to two (2) to recommend that Ordinance No. 73-1988 be adopted.
