HomeMy Public PortalAbout079-1988- AMENDING AMENDED ORDINANCE 29-1987ORDINANCE NO. 79-1988 AN ORDINANCE AMENDING AMENDED ORDINANCE NO. 29-1987 PROVIDING FOR A TECHNICAL CORRECTION OF THE LEGAL DESCRIPTION CONTAINED IN SECTION ONE OF SAID ORDINANCE. WHEREAS, amended General Ordinance No. 29-1987 was adopted by the Common Council June 1, 1987, which rezoned property located at 1 East Main Street from 0-1 Greenbelt District to C-2 Commercial District; and, WHEREAS, the legal description contained in the above said Ordinance describing the property to be rezoned is in error and needs to be corrected in accordance with the amended petition submitted by the owner and in accordance with the minutes and recommendation of the Richmond City Plan Commission; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission on the �&? day of _ _M9Z/e4,/'- , 1988, at which time remonstrances were heard from all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Plan Commission was to D in favor of;�� ��'�= recommending the passage of Ordinance No. 79-1988. NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond, Indiana, as follows: SECTION 1. That the legal description contained in amended Ordinance No. 29-1987 is hereby amended to read as follows: Being a part of Lots 8, 9 and 10 and 12 in J. P. Plummer and Company Addition, and a part of Lots O.M. 176-A, 198-A 198-A-1, and 239, all in the City of Richmond, Wayne County, Indiana, and being more particularly described as follows: Beginning at a point of intersection of the west line of Lot 11 in J. P. Plummer & Company Addition, extended north to the south right-of-way of East Main Street; thence south, along the extension of the west line of said Lot 11 and along the west line of said Lot 11 to the southwest corner of said Lot; thence east, along the south line of said Lot 11 and Lot 2 in said Addition, to a point in the west right-of-way line of South First Street; thence south, along the west right-of-way of said Street; to a point 381.00 feet south of the south right-of-way of East Main Street; thence west, parallel to the south right-of- way line of said East Main Street, 180.00 feet; thence north, parallel to the west right-of-way line of South First Street, to a point 200.00 feet south of the south right-of-way of East Main Street; thence northwesterly to a point, said point being 285.00 feet west of the west right-of-way line of South First Street and 150.00 feet south of the south right-of-way line of East Main Street; thence north, parallel to the west line of South First Street to a point on the south right-of-way line of East Main Street; thence east along the south right-of-way of East Main Street, to the place of beginning. SECTION 2. This Ordinance shall be in full force and effect nunc pro tune as of the effective date of amended Ordinance No. 29-1987. OOOLEY DIRECTOR OF PLANNING, PERMITS AND INSPECTIONS Dear Mrs. Morris, Members of Common Council and Mrs. Merchanthouse: The Richmond City Plan Commission conducted a public hearing on November 22, 1988, on its own initiative to consider an amendment to amended Ordinance No. 29 1987. The Ordinance in question rezoned property located at 1 East Main Street from 0-1 Greenbelt District to C-2 Commercial District. The proposed Amendment to Amended Ordinance No. 29-1987 would provide for a technical correction of the legal descrip- tion in Section 1 of the Ordinance which describes the property to be rezoned. In May 1987, the Plan Commission conducted a public hearing on a petition submitted by Gennett Investment, Inc., requesting a rezoning of property located at 1 East Main Street from 0-1 to C-4. The petition was amended during the hearing to reduce the requested zoning district.from C-4 to C-2. The amendment also requested a reduction in the acreage to be rezoned. The Plan Commission voted unanimously to recommend the amended petition be granted. At the Council meeting held June 1, 1987, the Ordinance was amended on the floor to reduce the requested zoning classification from C-4 to C-2. However, the Ordinance was not amended re- garding the legal description. The Ordinance before the Common Council, Ordinance No. 79-1988, makes a technical correction in Ordinance No. 29 1987 by amending the legal description to correspond to the petition and to the recommendation of the Plan Commission. During the public hearing, no one spoke in opposition to the Ordinance. The Plan Commission voted six (6) to zero (0)to recommend the adoption of Ordinance No. 79-1988.
