AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE
NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF
RICHMOND, INDIANA, PROVIDING FOR THE REZONING OF THE PROPERTY LOCATED ON
THE WEST SIDE OF STRAIGHTLINE PIKE IN THE 1900 BLOCK, FROM R-2 SINGLE
FAMILY RESIDENCE DISTRICT TO C-4 GENERAL BUSINESS DISTRICT.
WHEREAS, the Zoning Map which is a part of ordinance No. 2325-1968,
designates said property as R-2 Single Family Residence District;
and,
WHEREAS, it is the intent and purpose hereof to change the zoning
classification of said property from R-2 Single Family Residence
District to C-4 General Business District; and,
WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan
Commission the day of 1988, at which time remonstrances
were heard form all parties interested in or affected by this
Ordinance; and,
WHEREAS, the vote of the Richmond City Plan Commission was to in
favor of/in opposition to recommending the passage of Ordinance
NO. 80-1988.
NOW THEREFORE BE IT ORDAINED by the Common Council of The City of
Richmond, Indiana, as follows:
SECTION 1. That the zoning classification of the property described
below, and the same is hereby changed to C-4 General
Business District, and that said property be regulated in
accordance with the Zoning Ordinance of the City of
Richmond, Indiana and all amendments thereto:
A tract of land located in the Southeast Quarter Section of Section
Eight (8), Township Thirteen (13) North, Range One (1) West, in the
City of Richmond, Wayne County, Indiana, and more particularly
described as follows: Beginning at the southeast corner of the
Southeast Quarter of Section Eight (8), thence north along the east
line of said Section Eight (8). eight hundred forty-seven and
ninety-five hundredths (847.95) feet, thence west one hundred
twenty-five and eight -tenths (125.8) feet to the east right-of-way
line of U.S. Highway 27, thence southwestwardly on a 0 degree, 59
minute curve, on the east right-of-way line of said U.S. Highway 27
and the west line of this tract eight hundred fifty-six and
eigth-tenths (856.8) feet to the south line of Section Eight (8),
thence east two hundred seventeen and fifty-four hundredths (217.54)
feet to the point of beginning. Containing three and thirty-four
hundredths (3.34) acres, more or less.
SECTION 2 This Ordinance shall be in full force and effect from and
after its passage and approval as by law required.

Dear Mrs. Morris, Members of Common Council and Mrs. Merchanthouse:
The Richmond City Plan Commission conducted a public hearing
on November 22, 1988, on the petition of Richard H. Terwilliger
requesting to rezone property located on the west side of
Straightline Pike in the 1900 block from R-2 Single Family
Residence District to C-4 General Business District.
Nineteen (19) notices of public hearing were sent to surrounding
residents. Three (3) notices were returned in opposition to the
petition. During the public hearing six (6) persons spoke in
opposition to the request. These persons spoke about their
concerns regarding storm water drainage; and the impact the
rezoning would have on the value and use of adjoining property.
The Plan Commission voted six (6) to zero (0) to recommend
that Common Council deny Ordinance No. 80-1988.
