HomeMy Public PortalAbout081-1988-ZONING - WESTSIDE OF CHESTER BOULEVARD IN THE 2300BLKAMENDED ORDINANCE NO. 81-1988 AN ORDINANCE GRANTING PRELIMINARY APPROVAL TO A COMMERCIAL DEVELOPMENT UNIT PROJECT IN A R-2 SINGLE FAMILY RESIDENCE DISTRICT AND C--2 COMMERCIAL DISTRICT ON PROPERTY LOCATED ON THE WEST SIDE OF CHESTER BOULEVARD IN THE 2300 BLOCK PURSUANT TO ARTICLES 45 AND 48 OF CHAPTER 154 OF THE CODE OF ORDINANCE, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA. WHEREAS, the Zoning Map which is a part of Ordinance No. 2325-1968 designates and describes as R-2 Single Family Residence District and C-2 Commercial District the property located on the west side of Chester Boulevard in the 2300 block; and, WHEREAS, it is the intent and purpose thereof, pursuant to Articles 45 and 48 of the Zoning Ordinance, to grant preliminary approval of a Commercial Development Unit Project on the above said property; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the day of`n ,1988, at which time remonstrances were heard from all parties interested in or affected by this Ordianance; and, WHEREAS, the vote of the Richmond City Plan Commission was /� to O in favor of" recommending the passage of Ordinance No. 81-1988. NOW THEREFORE BE IT ORDAINED BY the Common Council of the City of Richmond, Indiana as follows: SECTION 1. That pursuant to Articles 45 and 48 of the Zoning Ordinance, preliminary approval for a Commercial Developement Project on the property described below is hereby granted. Part of the Northeast Quarter of Section 20-Township 14 North- Range 1 West, City of Richmond, Wayne County, Indiana, and more particularly describee as follows: Commencing at a brass plug marking the southeast corner of said Quarter Section and thence running South 89 degrees 59 minutes 09 seconds west along the south line of said Quarter Section 330.00 feet to an iron rebar marking the point of beginning of the tract described herein; thence running south 89 degrees 59 minutes 09 seconds west along the south line of said Quarter Section 462.00 feet to an iron rebar; thence running north 00 degrees 00 minutes 00 seconds east parallel with the east line of said Quarter Section 495.00 feet to an iron rebar; thence running north 89 degrees 59 minutes 09 seconds east parallel with the south line of said Quarter Section 462.00 feet; thence running south 00 degrees 00 minutes 00 seconds west parallel with the east line of said Quarter Section 495.00 feet to the point of beginning. Said above tract containing 5.250 acres. SECTION 2. That as a condition of being granted preliminary approval for a Commercial Development Unit Project and as an additional restriction on said use, the following requirements shall hereafter and at all times be met by the owner of said real estate: a. The property owner shall prepare a committment to be recorded in the Office of the Wayne County Recorder agreeing that the commercial outlot fronting on Chester Boulevard, as shown on the Development Unit Project site plan, shall not derive direct access from Chester Boulevard. DOOLEY DIRECTOR OF PLANNING, PERMITS AND INSPECTIONS Dear Mrs. Morris, Members of Common Council and Mrs. Merchanthouse: The Richmond City Plan Commission conducted a public hearing on November 22, 1988, on the petition of Rees Realty regarding preliminary approval of a Commercial Development Unit Project on property located on the west side of Chester Boulevard in the 2300 block. The property in question consists of approximately 6.5 acres and is located generally between the Ponderosa restaurant and Star Bank. The proposed project includes a 122 unit Super 8 Motel and a tract for a future commerical development. During the public hearing, the petitioner requested that the petition be amended by reducing the area under consideration for the Commerical Development Unit Project. The Plan Commission accepted the amendment. Fifty-nine (59) notices of public hearing were sent to surrounding residents and businesses. Two notices were returned in opposition to the petition. During the public hearing two people spoke in opposition to the request. In making its recommendation the Plan Commission considered the requirements of the Zoning Ordinances in Article 45 and 48. . The Commission determined that the proposed project complies with the Zoning Ordinance with the stipulation of one condition as follows: That the property owner shall prepare a committment to be recorded in the office of the Wayne County Recorder agreeing that the commercial outlot frontage on Chester Boulevard shall not derive direct access from Chester Boulevard. Therefore the Plan Commission voted six (6) to zero (0) to recommend that Ordinance No. 81-1988 be adopted with the follow- ing amendments: (1) to modify the legal description of the property under consideration and (2) to add a new section 2 incorporating the above condition.
