AN ORDINANCE OF THE CITY OF TEMPLE CITY ADDING
NEW SECTIONS 4253 AND 4254 TO THE TEMPLE CITY
MUNICIPAL CODE RELATING TO NEWS RACKS
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY. DOES ORDAIN:
SECTION 1. Sections 4253 and 4254, reading as follows, are
hereby added to the Temple City Municipal Code:
Section 4253. DISPLAY OF CERTAIN MATTER PROHIBITED.
Publications offered for sale from news racks placed
or maintained on or projecting over the sidewalks or high-
way shall not be displayed or exhibited in a manner which
exposes to public view from the sidewalk or highway any
of the following:
(a) Any statements or words describing explicit
sexual acts, sexual organs, or excrement where such
statements or words have as their purpose or effect
sexual arousal, gratification or affront.
(b) Any picture or illustration of genitals,
pubic heair, perineums, anuses, or anal regions of
any person where such picture or illustration has
as its purpose or effect sexual arousal, gratifi-
cations, or affront,
Section. 4254. DEFINITION OF EXPLICIT SEXUAL ACTS
Explicit sexual act's, as used in this Chapter, means
depictions of sexual intercourse, oral copulation, anal
intercourse, oral -anal copulations, bestiality, sadism,
masochism, or excretory functions in conjunction with
sexual activity, masturbation, or lewd exhibition of the
genitals, whether any of the above conduct is depicted
or described as being performed alone or between members
of the same or opposite sex or between humans and animals,
or other act of sexual arousal involving any physical
contact with a person's genital, pubic region, pubic
hair, perineum, anus or anal region.
SECTION 2, The City Clerk of the City of Temple City shall
certify to the adoption of this Ordinance.

I, Chief Deputy City Clerk, do hereby certify that the foregoing
Ordinance, being Ordinance No 79 -480, was introduced at a regular
meeting of the City Council of the City of Temple City held on the
18th day of September, 1979, and was duly passed, approved and
adopted by said Council, approved and signed by the Mayor and attested
by the City Clerk, at a regular meeting of the said City Council held
on the 2nd day of October , 1979, by the following vote:
AYES: Councilmen - Gillanders, Merritt, Tyrell, Dennis
NOES: Councilmen- None
ABSENT: Councilmen-Atkins
