Orange St. Present: Chair Dan Barker, James Czar, Lisa Frazier, Chris Johnston, Doug Peterson, Alyse Polly, Jenn Sykes and Chris Wehrman Staff: Economic Development Planner Shannan Campbell, Planning Director Margaret Hauth and Town Attorney Bob Hornik Item 1: Call to order and confirmation of a quorum. Chair Dan Barker called the meeting to order at 7 p.m. Planning Director Margaret Hauth confirmed the presence of a quorum. Item 2: Consideration of additions or changes to the agenda Planning Director Margaret Hauth added an item 7a regarding electronic gaming. Item 3: Approval of minutes from May 2018 regular meeting Planning Board Member James Czar requested a correction: Under Item 6, change “depraved” to “underdeveloped.” Motion: Czar moved to approve the minutes as amended. Planning Board Member Doug Peterson seconded. Vote: Unanimous Item 4: Discussion of text amendment to establish a dwelling density for attached dwellings in non- residential districts. Hauth said this is the issue that was raised with the redevelopment of the former nursing home on North Churton Street. The ordinance implies that one would need 10,000 squar e feet for each dwelling, which seems counter to the concept. Regarding Adaptive Reuse board members decided to establish a minimum lot size on the table and to add a footnote that the residential density in special use districts will be established with each special use permit. Board members expressed a preference for the number of units ranging from 10-16. It was decided to discuss this further after the public hearing. Town Attorney Bob Hornik advised that Hauth could notice the public hearing for a range. Hauth suggested advertising the amendment with the range of 10-16. Motion: Czar moved to recommend that the text amendment be sent to public hearing with the number of units per acre between 10 and 16 for Adaptive Reuse only. Planning Board Member Lisa Frazier seconded. Page 2 of 3 Vote: Unanimous Item 5: Discussion of text amendment to create sandwich board alternative for parcels with outdoor seating in the public right of way. Hauth explained that the restaurants are required by the town to build a barrier for outdoor dining and may want to hang one side of their former sandwich board sign on the new barrier. Economic Development Planner Shannan Campbell explained the purpose of the outdoor seating barrier is to maintain an ADA-compliant pedestrian pathway on the sidewalk and to be compliant with state laws regarding alcoholic beverage control by keeping patrons with alcoholic beverages within the establishment where the alcohol was bought. Board members requested that an illustration be added to the text amendment and that the amendment be clarified to state that the height of the sign may not extend more than 4 feet above the ground. Motion: Planning Board Member Chris Johnston moved to send the text amendment to public hearing with the language about the height limitation of the sign and with an illustration. Peterson seconded. Vote: Unanimous Item 6: Discussion of text amendment to prohibit neon in the historic overlay district rather than the central commercial zoning district. Hauth said the intention is to prohibit neon signs only in the historic district. Hauth noted that now people use illuminated tubing more often than neon lights and this amendment would still group illuminated tubing with neon signs. Motion: Czar moved to send to public hearing. Planning Board Member Alyse Polly seconded. Vote: Unanimous Item 7: Discussion of text amendments to adjust permitted uses in non-residential districts, add uses, modify definitions, and consider consolidating districts The board agreed to meet July 18 to continue discussion of the permitted uses table so that members would not have to review the table in its entirety this evening. The board then began reviewing changes to the permitted uses table and Hauth any further changes made during the discussion. The board discussed drive-thru windows; bars in General Commercial District; child care allowed in Neighborhood Business and Office Institutional districts and not in Central Commercial or Light Industrial districts; churches and places of worship not permitted in high-intensity zones (they are permitted with a conditional use permit in residential districts); detention facility required to have a special use permit in Office Institutional and Economic Development District; and removing dry cleaning or laundry plant as a permitted use anywhere. Regarding electronic gaming, Hauth explained the town ordinance speaks only to terminals. There is now electronic gaming in town that is played at a table with eight chairs . Hauth would like the board’s input on whether to count that as one terminal or eight. Page 3 of 3 Item 7a: Added item — electronic gaming Hauth covered this under Item 7. Item 8: Topics for July 18 text amendment work session • Amend residential project review steps to remove Parks and Recreation Board recommendation on proposed recreation unless the facilities are to be public • Modify the tree preservation/tree retention standards • Modify or remove steep slope provisions • Add language to facilitate accessibility modifications • Modify buffers and screening provisions • Light trespass (discussing possible vagueness in the ordinance) and the dark skies model Item 9: Updates Parks and Recreation Board has been working to create a master plan for each park.
