AUTHORIZING EXECUTION OF DEVELOPERS AGREEMENT
PORT CARTERET, J.V.
WHEREAS, Port Carteret, J.V. ("Port Carteret"), 300 Middlesex Avenue, Suite
D, Carteret, NJ, has previously submitted certain land development applications
to the Carteret Planning Board ("Planning Board") for approval; and
WHEREAS, the Planning Board has granted Port Carteret approval on said land
development applications, Application No. P-99-8, P-99-11, P-99-12, and P-00-8,
pursuant to Resolutions memorialized on September 29, 1999, February 23, 2000
and May 3, 2000, respectively; and
WHEREAS, the Resolutions approving the above referenced land development
applications contain certain stipulations and conditions with which Port Carteret
must comply; and
WHEREAS, pursuant to said Resolutions, Port Carteret has voluntarily offered to
contribute the sum of ONE HUNDRED FOURTEEN THOUSAND AND
EIGHTY DOLLARS ($114,080.00) to the Borough for certain public
improvements related to the need to upgrade the local infrastructure serving said
development; and
WHEREAS, the Borough and Port Carteret are desirous of formalizing said
agreement and the obligations related thereto.
NOW, THEREFORE, BE 1T RESOLVED by the Mayor and Council of the
Borough of Carteret, County of Middlesex, State of New Jersey, as follows:
1. That the Mayor is hereby authorized to execute the
Developers Agreement with Port Carteret, J.V., a copy of which is
attached hereto and made a part hereof.
2. That the appropriate Borough Officials are hereby
authorized to implement and carry out the terms of the above
agreement.
3. That a copy of this Resolution be forwarded to the
Borough's Finance Department, James F. Clarkin, III, Esq. and the
Borough Attorney.
Adopted this 7th day of November, 2002
and certified as a true copy of the
original on November 8, 2002.
