'SPUD WOODWARD DIRECTOR RE: Revocable License & Federal Consistency —Modification of a Single -Family Private Recreational Dock Facility, Horse Pen Creek, Tybee Island, Chatham County, Georgia (COE - TBA) (GPS -°N 32.009072/°W 80.850893) Dear Mr. Slaughter: This letter is in reference to your application requesting a State Revocable License and authorization pursuant to the Department of the Army Permit to construct a private recreational dock facility. Staff of the Coastal Management Program reviewed the above referenced application pursuant to Section 404 of the Clean Water Act and/or Section 10 of the River and Harbors Act of 1899 for consistency with the Georgia Coastal Management Program (GCMP). The Program concurs with the applicant's consistency certification. This ensures that the proposed project has been designed to comply with the applicable enforceable policies of the GCMP. Your project consists of two 4' x 24.25' walkways, approximately 755 square feet of irregularly shaped fixed deck including approximately 296 square feet of fixed deck and an enclosed 26.2' x 16' dock house. There is a second and separate 7.2' x 5.5' fixed deck on the north side of the property. There is also approximately +/- 90 linear feet of existing rip -rap on this property. The proposed modification is to add a 3' x 18' ramp and a 10' x 16' floating dock. At mean low water (MLW) the proposed project will extend approximately 10' into the waterway at a point where the waterway is approximately 40' wide at MLW. The dock is constructed approximately 1' from the extended property line to the left and will be constructed approximately 40' from the extended property line to the right of the structure. The height of the existing covered area does not exceed 13' from the lowest part of the decking on the facility. The existing enclosed structure located on the fixed deck and the separate 5.5' x 7.2' fixed deck can be maintained as long as they remain in a serviceable condition. The existing enclosed structure and the separate fixed deck may not be improved nor may their footprints be enlarged. Please find enclosed a fully executed Revocable License relative to the construction and maintenance of a private, single-family private recreational dock facility. This license serves as authorization to utilize State owned tidal water bottoms for your dock facility as per the location, dimensions, and configuration depicted in your application for such license. Any incidental impacts associated with this project must be rectified by fully restoring areas to their pre -construction topographic and vegetative states. Any change in the use, location, dimensions, or configuration of the approved facility, without prior notification and approval from this office, could result in the revocation of this license and in required removal of the facility. This dock facility must be constructed precisely to the approved location, dimensions, and configuration as depicted in the drawings provided. If dock corridors exist, please ensure that this dock facility is constructed in such a fashion that the entire structure fits between the extended property lines. The facility, for which these authorizations are issued, shall not be used at any time for business or commercial purposes. Prohibited uses include, but are not limited to, liveaboards, leasing of the permitted dock space; docking a commercial fishing vessel of any type; and utilization of the dock facility in any tour boat or charter fishing boat activities. The use of this facility for other than private, single- family, recreational purposes will result in the immediate revocation of the license and in required removal of the entire facility from state-owned property, and possible criminal and civil penalties as provided by law. This agreement is not transferable with ownership interest in the upland property. These authorizations do not relieve you from obtaining any other required federal, state, or local permits. You must obtain a county or municipal building permit prior to beginning construction of the dock facility. The tidal water bottoms and marshlands of coastal Georgia are public trust lands controlled by the state, except for such lands that a validated Crown Grant or State Grant exists. This license authorizes use of lands assumed to be under the control of the state. You may proceed with construction of this project with the knowledge and understanding that this license agreement could be rendered invalid should another person produce a validated Crown Grant or State Grant. Accordingly, I hereby request that I be granted a revocable license from the State of Georgia. Attached hereto and made a part of this request is a copy of the plans and description of the project that will be the subject of such a license. I certify that all information submitted is true and correct to the best of my knowledge and understand that willful misrepresentation or falsification is punishable by law. I understand that if permission from the State is granted, it will be a revocable license and will not constitute a license coupled with an interest. I acknowledge that this revocable license does not resolve any actual or potential disputes regarding the ownership of, or rights in, or over the property upon which the subject project is proposed, and shall not be construed as recognizing or denying any such rights or interests. 1 acknowledge that such a license would relate only to the property interests of the State and would not obviate the necessity of obtaining any other State license, permit or authorization required by State law. I further acknowledge that 1 will have no liveaboards, nor allow them to occur, at this structure. I recognize that 1 waive my right of expectation of privacy and 1 do not have the permission of the State of Georgia to proceed with such project until the Commissioner of DNR has signed a copy of this request. This covenant by licensee may be enforced by termination of this license, by injunction, and by any other remedy available at law to the Department. The project proposed for this license must be completed within 3 years of the date of issuance of the license and must be maintained in serviceable condition. Otherwise, action will be initiated to revoke this license and all structure must be removed immediately at the licensee's expense.
