A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RICHLAND HILLS, TEXAS, ORDERING A GENERAL ELECTION FOR
THE OFFICES OF MAYOR AND CITY COUNCIL PLACES 2 AND 4;
SUCH REGULAR ELECTION TO BE HELD ON SATURDAY, MAY 2,
2020; ESTABLISHING PROCEDURES FOR THE ELECTION; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, May 2, 2020, is designated as a uniform election day; and
WHEREAS, by this resolution, it is the intention of the City Council to call the 2020
General Election as required by the City Charter and by other law, designate a polling place for
the election, and establish and set forth procedures for conducting the election; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF RICHLAND HILLS, TEXAS, THAT:
Section 1. Election Order for General Election
The City Council hereby orders that a general election shall be held in the City of
Richland Hills on Saturday, May 2, 2020, at which the following officials will be elected:

Section 2. Joint Election Administration Contract
The City Secretary is hereby authorized to execute the contract (the "Contract") with
Tarrant County for joint election services. In the event of a conflict between this Resolution and
the Contract, the Contract shall control.
Section 3. Election Day Polling Place
On May 2, 2020, Election Day, the polls shall be open from 7:00 a.m. to 7:00 p.m., and
shall be held at Tarrant County Vote Centers* which includes:

*Vote Centers -City voters may vote at any of the additional Election Day Vote Centers open
under full contract services with the Tarrant County Elections Administration.
Section 4. Filing Dates
In accordance with Section 143.007 of the Texas Election Code, eligible persons wishing
to become candidates must file an application with the City Secretary of the City of Richland
Hills, Texas 76118, and may do so beginning Wednesday, January 15, 2020 and continue
through Friday, February 14, 2020, until 5:00 p.m. Each application shall be on a form meeting
the requirements of Section 141.031 of the Texas Election Code.
Section 5. Ballots and Election Method
Combined ballots may be utilized containing all of the offices and propositions to be
voted on at each polling place, provided that no voter shall be given a ballot or permitted to vote
for any office or proposition on which the voter is ineligible to vote. Early voting by personal
appearance and Election Day shall be conducted on Tarrant County's Hart Intercivic Verity
Voting System v. 2.3.1. All expenditures necessary for the conduct of the election, the purchase
of materials therefore, and the employment of all election officials are hereby authorized, and
shall be conducted in accordance with the Contract and the Code. The order in which the names
of the candidates are to be printed on the ballot shall be determined by a drawing by the City
Secretary pursuant to state law. Notice of the time and place for such drawing shall be given in
accordance with the Code.
Section 6. Early Voting
Early voting by personal appearance. The Tarrant County Elections Administrator is hereby
appointed as the Early Voting Clerk for the election, as so indicated in the Contract. Early
voting by personal appearance shall commence April 20, 2020 and shall continue until April 28,
2020. Early voting by personal appearance shall be held at Tarrant County Vote Centers. The
main early voting location shall be located at the Tarrant County Elections Center, 2700 Premier
Street, Fort Worth, Texas 76111. Specific days, times and locations shall be designated by the
Elections Administrator and included in the Contract and shall be in compliance with state law.
On at least two weekdays during the early voting period, the location for early voting shall be
open for at least twelve (12) hours as mandated by state law.
b. Early voting by mail. Applications for a ballot by mail may be submitted throughout the
calendar year, beginning January 1 and must be received by Tarrant County Elections no later
than the close of business April 21, 2020. All voted ballots that are returned on or before
Election Day will be counted. Voted ballots mailed from outside the United States may be
counted if clearly postmarked on or before Election Day and received by the Elections
Administrator not later than the fifth day after Election Day. Completed applications may be
submitted by mail, contract or common carrier, fax or (Effective September 1, 2015, you may
submit by email a completed, signed with the voter's original signature and scanned application
to the Early Voting Clerk.):

c. Early voting ballot board. Early voting, both by personal appearance and by mail shall
be canvassed by an Early Voting Ballot Board which is hereby created. According to the
Contract, Tarrant County shall appoint the Early Voting Ballot Board to process early voting
results from the election.
Section 7. Notice
Notice of said election shall be given as required by the Texas Election Code.
Section 8. Election Officials
The election judge, alternate election judge, and ballot board will be appointed by the
Tarrant County Elections Administrator, as permitted by law. The presiding judge shall appoint
elections clerks as may be necessary for the proper conduct of the election. The election judge, or
the alternate election judge in the absence of the election judge, and the election clerks shall
constitute the early voting ballot board. The election judge, and alternate election judge, and
election clerks shall be qualified voters of the city.
Section 9. Governing Law
The election shall be held in accordance with the Constitution of the State of Texas and
the Texas Election Code, and all resident qualified voters of the City shall be eligible to vote at
the election.
Section 10. Necessary Actions
The Mayor and the City Secretary, in consultation with the City Attorney, are authorized
and directed to take all actions necessary to comply with the provisions of the Texas Election
Code, the City Charter, and the City Code in carrying out and conducting the election, whether
nor not expressly authorized by this Order.
Section 11. Severability Clause
It is hereby declared to be the intention of the City Council that the sections, paragraphs,
sentences, clauses and phrases of this order are severable and if any phrase, clause, sentence,
paragraph, or section shall be declared invalid or unconstitutional by the valid judgment or
decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not
affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this order,
since the same would have been enacted by the City Council without the incorporation in this
order of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section.
Section 12. Notice and Publication
This Resolution shall serve as the Order of Election (as required by Section 3.001 of the
Code) and as the Notice of Election (as required by Section 4.001 of the Code) for the General
Election. A copy of the resolution shall be posted on the bulletin board used for posting notices
of the meetings of the City Council at least twenty-one (21) days before the election. Notice
shall be published in the newspaper in accordance with state law.
Section 13. Effective Date
This order shall be effective upon its adoption.

POR CUANTO, se establece el 2 de mayo de 2020 como el dfa de la elecci6n uniforme,
POR CUANTO, mediante esta resoluci6n, el Concejo Municipal tiene la intenci6n de
convocar a la Elecci6n General de 2020, segun lo dispuesto por la Carta Organica Municipal y
por otra legislaci6n, designar un centro electoral para la Elecci6n, establecer y exponer los
procedimientos para su realizaci6n, y
AHORA, POR LO TANTO, EL CONCEJO MUNICIPAL DE LA CIUDAD DE
RICHLAND HILLS, TEXAS, RESUELVE QUE:
Secci6n 1. Orden de Elecci6n para la Elecci6n General
Por la presente, el Concejo Municipal ordena la realizaci6n de una Elecci6n General en la
Ciudad de Richland Hills el sabado, 2 de mayo de 2020 para elegir a los siguientes funcionarios:

Secci6n 2. Contrato de Administraci6n de Elecci6n Conjunta.
Por la presente, se autoriza a la Secretaria de la Ciudad a celebrar el contrato ( el
"Contrato") con el Condado de Tarrant para los servicios de la elecci6n conjunta. En caso de
conflicto entre la presente Resoluci6n y el Contrato, este ultimo prevalecera.
Secci6n 3. Ubicaci6n del centro electoral el dia de la elecci6n
El 2 de mayo de 2020, el Dfa de la Elecci6n, las umas estaran abiertas de 7:00 a.ma 7:00
p.m. y la votaci6n se llevara a cabo en los centros de votaci6n* del Condado de Tarrant, entre
otros:

*Centros de votaci6n: los votantes de la ciudad pueden votar en cualquiera de los centros de
votaci6n adicionales para el Dfa de la Elecci6n que esten abiertos bajo un contrato de servicios
integrales con la Administraci6n de Elecciones del Condado de Tarrant.
Secci6n 4. Fechas de Presentaci6n de Solicitudes
De acuerdo con la Secci6n 143.007 del C6digo Electoral de Texas, las personas
calificadas que deseen postularse como candidatos deben presentar una solicitud a la Secretaria
de la Ciudad de Richland Hills, Texas 76118, a partir del miercoles, 15 de enero de 2020 hasta el
viemes, 14 de febrero de 2020, a las 5:00 p.m. Cada solicitud debera cumplir con los requisitos
de formato establecidos en la Secci6n 141.031 del C6digo Electoral de Texas.
Secci6n 5. Boletas y Metodo de Elecci6n
Se pueden utilizar boletas electorales combinadas que contengan todos los cargos y
propuestas que se votaran en cada centro electoral, siempre y cuando ningun elector reciba una
boleta electoral o se le permita votar por un cargo o propuesta para los cuales no tenga derecho a
hacerlo. La votaci6n anticipada en persona y la votaci6n del Dfa de la Elecci6n se llevara a cabo
a traves del sistema de votaci6n Verity version 2.3.1. de Hart Intercivic del Condado de Tarrant.
Por la presente, se autorizan todos los gastos necesarios para la realizaci6n de la elecci6n, la
compra de los materiales a tal efecto y la contrataci6n de todos los funcionarios electorales;
dichos gastos se realizaran conforme al Contrato y al C6digo. El orden en que se imprimiran los
nombres de los candidatos en la boleta electoral se determinara a traves de un sorteo que
realizara la Secretaria de la Ciudad conforme a la legislaci6n del estado. La hora y la fecha del
sorteo se notificaran de acuerdo con lo dispuesto en el C6digo.
Secci6n 6. Votaci6n Anticipada
a. Votaci6n Anticipada en Persona. Por la presente, se designa al Administrador de las
Elecciones en el Condado de Tarrant, como Secretario de Votaci6n Anticipada para las
elecciones, como indicado en el Contrato. La Votaci6n Anticipada en persona comenzara el 20
de abril de 2020 y finalizara el 28 de abril de 2020. La votaci6n anticipada en persona se llevara
a cabo en los centros de votaci6n del Condado de Tarrant. El lugar donde se llevara a cabo la
principal votaci6n anticipada es en el Centro de Elecciones del Condado de Tarrant, 2700
Premier Street, Fort Worth, Texas 76111. La Administraci6n Electoral determinara los lugares,
los dfas y los horarios especificos, que se incluiran en el Contrato y que cumpliran con lo
dispuesto en la legislaci6n del estado. Mientras <lure el perfodo de votaci6n anticipada, el centro
electoral de votaci6n anticipada estara abierto, como mfnimo, doce (12) horas durante al menos
dos dfas de la semana, segun lo dispuesto por la legislaci6n del estado.
b. Votaci6n Anticipada por Correo. Se pueden presentar solicitudes para votaci6n por
correo a lo largo del aiio calendario a partir del 1 de enero. El personal de las Elecciones del
Condado de Tarrant debe recibir estas solicitudes antes del cierre de las actividades laborales el
21 de abril de 2020. Se computaran todos los votos que se envfen antes del Dfa de la Elecci6n, o
ese mismo dfa. Los votos que se envfen por correo desde un lugar fuera de los Estados Unidos se
computaran si muestran claramente un sello postal con la fecha del Dfa de la Elecci6n, o una
fecha anterior, y siempre que el Administrador Electoral los reciba, como maximo, el quinto dfa
posterior al Dfa de la Elecci6n. Las solicitudes completadas se pueden enviar por correo,
mensajerfa contratada o comun, o fax (a partir del 1 de septiembre de 2015, se puede enviar una
solicitud completada con la firma original del elector que debera escanearse y enviarse al
Secretario de Elecci6n Anticipada por correo electr6nico) a las siguientes direcciones:

c. Junta para la Votaci6n Anticipada. Por medio de la presente, se crea una Junta para la
Votaci6n Anticipada, que se ocupara de escudrifiar la votaci6n anticipada que se realice tanto en
persona como por correo. Conforme al Contrato, el Condado de Tarrant nombrara a la Junta
para la Votaci6n Anticipada a fin de que procese los resultados de la votaci6n anticipada de la
elecci6n.
Secci6n 7. Aviso
El aviso de la elecci6n se realizara segun lo dispuesto por el C6digo Electoral de Texas.
Secci6n 8. Funcionarios electorales
La Administraci6n Electoral del Condado de Tarrant designara al juez electoral, al juez
electoral suplente ya la junta para la votaci6n, segun lo permitido por la ley. El juez responsable
nombrara a los secretarios electorales, segun sea necesario, para el correcto desarrollo de la
elecci6n. El juez electoral o, en su ausencia, el juez electoral suplente y los secretarios electorales
constituiran la Junta para la Votaci6n Anticipada. El juez electoral, el juez electoral suplente y
los secretarios electorales seran electores calificados de la ciudad.
Secci6n 9. Legislaci6n aplicable
La elecci6n se realizara de conformidad con la Constituci6n del Estado de Texas y el
C6digo Electoral de Texas, y todos los residentes de la ciudad que sean electores calificados
seran elegibles para votar en la elecci6n.
Secci6n 10. Medidas Necesarias
Se autoriza y ordena al Alcalde y a la Secretaria de la Ciudad, en consulta con la
Procuradora de la Ciudad, a tornar todas las rnedidas necesarias para curnplir con las
disposiciones del C6digo Electoral de Texas, la Carta Organica Municipal y el C6digo Municipal
para llevar a cabo la Elecci6n, independienternente de que esten o no expresarnente autorizados
por esta Orden.
Secci6n 11. Clausula de Divisibilidad
Por la presente, se declara que el Concejo Municipal tiene la intenci6n de que las
secciones, los parrafos, las oraciones, las clausulas y las frases de esta Orden sean divisibles, y
que si alguna sentencia o decreto validos de un tribunal con jurisdicci6n cornpetente declarara la
nulidad o inconstitucionalidad de alguna frase, clausula, oraci6n, parrafo o secci6n, dicha nulidad
o inconstitucionalidad no afectara a ninguna de las frases, clausulas, oraciones, parrafos y
secciones restantes de esta Orden, dado que estos hubieran sido prornulgados por el Concejo
Municipal sin la incorporaci6n en esta Orden de ninguna de dichas frases, clausulas, oraciones,
parrafos o secciones nulos o inconstitucionales.
Secci6n 12. A viso y Publicaci6n
Esta Resoluci6n constituira la Orden de Elecci6n (segun lo dispuesto por la Secci6n
3.001 del C6digo) y el Aviso de Elecci6n (segun lo dispuesto por la Secci6n 4.001 del C6digo)
para la Elecci6n General. Al rnenos veintiun dfas (21) antes de la elecci6n, se publicara una
copia de la Resoluci6n en la pizarra de anuncios que se utiliza para la publicaci6n de los avisos
de las reuniones del Concejo Municipal. El aviso se publicara en el peri6dico, de acuerdo con lo
dispuesto por la legislaci6n del estado.
Secci6n 13. Fecha de Entrada en Vigencia
Esta orden entrara en vigencia a partir del rnornento de su adopci6n.
