IONA CITY HALL
NOVEMBER 17, 2020 — 7:00 P.M.
PRESENT: Mayor Dan Gubler, Council President Rob Geray, Council Member Michael
Thompson, Council Member Peter Wadsworth, Council Member Kathy McNamara, City
Attorney Andrew Rawlings, Public Works Director Zech Prouse (via teleconference) and City
Clerk/Treasurer Keri West.
ABSENT: None.
VISITORS: Bill Koester, Kathy Koester, Curtis Johnson, Kurt Roland and Bryan Shumway.
Mayor Gubler welcomed everyone and Council Member Wadsworth led the Pledge of
Allegiance. A roll call was taken by Clerk West to open the meeting.
CONSENT AGENDA: City Council Work Meeting and Regular Meeting Minutes of October
20, 2020 were reviewed. Council reviewed the finance reports for the period ending October 31,
2020 (100% of the fiscal year elapsed). The City had $1,202,605.65 in the bank and routine bills
had been paid, "Exhibit A".
Mayor Gubler entertained a motion. Council Member Thompson made a motion to approve the
consent agenda as presented. Council Member Wadsworth seconded the motion. All in favor.
Motion carried.
ITEMS OF BUSINESS:
Ordinance to Amend and Enact New Sections of the Iona City Code Title 8, Chapter 1 —
Parks (Ord. 247-11-20) — Attorney Rawlings stated this was tabled previously and the requested
corrections have been addressed. He continued and stated there was a typo that was corrected
and additional clarification regarding only City vehicles allowed in the park. Attorney Rawlings
informed the public this amendment is an attempt to update the rules and signs for the City parks.
Mayor Gubler entertained a motion. Council President Geray made a motion to approve
Ordinance 247-11-20, an Ordinance of the City of Iona, Idaho; repealing and reenacting Chapter
1 in Title 8 of the Iona City Code, relating to regulation of City Parks; preserving prior
Ordinances in each instance; providing for severability; and establishing an effective date.
Council President Geray also moved to dispense with the rule of reading the proposed Ordinance
in full and on three separate occasions. Council Member Thompson seconded the motion. A roll
call vote was taken:

General Water System Discussion— Mayor Gubler stated this item was addressed at the Work
Meeting previously. He updated the public and stated the tank is finished and the manway is
installed. They are currently winterizing the rest of the project and putting a hold on construction

until March. Mayor Gubler continued and stated the project is taking a lot longer than expected,
but he is very happy with the product. He also stated the system was designed to pump 1,375
gallons of water per minute and it currently is capable of pumping 2,500 gallons of water per
minute. Mayor Gubler continued and stated it will take 24 hours to fill the tank to 1 million
gallons. Mayor Gubler also stated the City has written a letter to Congressman Simpson's office
to patent the land next to the new water tank and we were told it would take 10-15 years to
complete that request. He said he has been advised that it would be better for the City to get on
the Bureau of Land Management's travel plan to lease the property to be able to move forward
with the bike park that has been previously discussed. He has now instructed the City Engineer
to begin the paperwork for this process. Mayor Gubler also stated he has spoken with the
Bonneville County Commissioners for approval to change the private road the City uses to
access the new water tank into a public road. Bonneville County has denied this request. Mayor
Gubler said the other option to access this area would be from the Panorama Hills extending the
Kolob Road. He has instructed the City Engineer to modify the project design to accommodate
this change.
Public Hearing for Preliminary Plat Application, Eagle Rock Engineering, Sunrise Acres —
Kurt Roland with Eagle Rock Engineering approached the podium and stated they are proposing
a new subdivision that would include 33 one -acre residential lots, an open lot of 1.25 acres with
green space and an indoor basketball court. Mr. Roland continued and stated they are still
working on getting the sewer to meet the requests of Iona Bonneville Sewer District (IBSD), but
they are in that process. Mayor Gubler stated he was concerned about the sewer access, but he is
aware that the applicant is working to rectify those concerns with IBSD. Mayor Gubler stated the
water line needs to be taken along the frontage of the property to the West and then terminated.
He also stated the City will bear the cost difference to upsize the water line along the frontage to
a 16 inch line, because that will benefit the City and its residents. Mr. Roland agreed and stated
he had nothing else to report. Council Members had no questions for Mr. Roland.
Mayor Gubler stated this is a Public Hearing and asked if anyone from the audience had any
questions or comments, for or against this application.
Bryan Shumway of 4840 N. 45th E. approached the podium and stated he lives adjacent to the
proposed subdivision and is not completely against the development, but does have concerns of
how it will affect himself and his neighbors. Mr. Shumway stated he has 10 acres and at one time
could have a couple hundred sheep on his property. He is concerned that new neighbors will
complain about the noise and smell of his animals and possibly retaliate against him personally.
Mayor Gubler stated he is not in the City and does not need to abide by the rules set forth in the
City for animals. He also stated there are state laws that protect Mr. Shumway's livestock.
Council Member Thompson added the proposed subdivision has 1 acre lots and the demographic
of those buyers should not be concerned with nearby livestock, compared to a denser
neighborhood. Council President Geray recommended Mr. Shumway research laws and
ordinances that he is required to follow as a resident of Bonneville County. Mr. Shumway agreed
and also expressed concerned about irrigation. Mayor Gubler said the development would not
affect his irrigation access. Council President Geray asked the developer's engineer, Kurt
Roland, if irrigation access is included on the Preliminary Plat. Mr. Roland confirmed they are
required to leave 16' on both sides of the irrigation ditch and that was included on the
Preliminary Plat. Mr. Shumway continued and stated he is concerned about traffic and is worried

about increased accidents and losing part of his property to widen the road in the future. Mayor
Gubler stated he is a member of the Bonneville Metropolitan Planning Organization (BMPO)
board and he can look into their future plan for roadways. However, those roads are arterial roads
and are not a valid reason to stop a development. Council President Geray added this area is
rapidly growing and development is inevitable. Mr. Shumway also expressed concern that a
member of the Planning & Zoning Commission (P&Z) stated he had already bought a lot and
then continued with the discussion and vote. Mayor Gubler stated he was not required by law to
recuse himself. He was legally required to identify his interest and give the other P&Z members
and audience members an opportunity to voice their concern with his involvement. Mayor
Gubler also stated the P&Z is a volunteer, appointed commission that only makes
recommendations to the City Council based on the Iona City Code. He continued and stated they
do not make any final decisions.
Mayor Gubler asked if anyone else from the public would like to speak for or against this
application. No comments made. Mayor Gubler then closed the Public Hearing portion of this
agenda item.
Clerk West stated she has spoken with the developers regarding the comment letter provided by
the City Engineer. P&Z approved the Preliminary Plat contingent upon all of the corrections on
the comment letter to be completed on the Final Plat submission. Therefore, the developers were
not required to resubmit another Preliminary Plat with those corrections addressed. Council
President Geray asked the developers if there is anything on the City Engineer's review that
would cause a problem for them to correct on the Final Plat. The developers agreed they have
reviewed the needed corrections and are good to move forward with those changes.
Mayor Gubler entertained a motion. Council Member Thompson made a motion to approve the
Preliminary Plat Application submitted by Eagle Rock Engineering for Sunrise Acres
Subdivision located on the South side of 49m North, between 45th East and 55th East. Council
Member Wadsworth seconded the motion. A roll call vote was taken:

STAFF REPORTS: Clerk West stated the City put together 300 treat bags for the Trunk or
Treat. Local volunteers and Bonneville County Sheriff's Office (BCSO) helped deliver the bags
to 94 families in the City of Iona. She continued and stated Assistant Farrens, Assistant Marley
and she put together 34 gift bags for Iona veterans and delivered them to their homes. She also
stated they have received good feedback and appreciation from residents on both activities. Clerk
West continued and stated the City will not be doing a Christmas dinner for the Council and City
employees due to COVID. She also asked the Council if anyone is interested in doing anything
as a City for Christmas, in addition to the annual Angel Tree. Mayor Gubler stated the Angel
Tree is sufficient and residents are still encouraged to display Christmas lights at their homes.
Clerk West also reported the City has received many reimbursements from the CARES Act,
including $5,000 to update the bathrooms in the City Building to touchless sinks. She also stated
the P&Z recommended looking into CARES Act funds to install a projector screen in the
Council Room for public meetings. Council Member Thompson made a recommendation to look
into a telephone conference unit.

Director Prouse stated the water and sewer infrastructure has been installed in the Pam Addition
and is awaiting inspection. He also stated in the Sunrise Acres Subdivision, the green space and
indoor basketball court would be considered a Conditional Use in the R-1 Zone. He also stated
the City needs to take over the payments for the water assessments for the surface water rights on
the Sunrise Acres Subdivision. Mayor Gubler stated that would need to be done between the City
and Progressive Irrigation. He instructed Director Prouse to contact Progressive Irrigation to set
up a meeting to discuss and move forward with that process.
Council President Geray stated his appreciation for Clerk West and her assistants for their efforts
with the Trunk or Treat and the Veterans Day gift bags. He continued and stated he would like to
have a future discussion to possibly organize a "Heritage Committee" in Iona. Council President
Geray stated this committee would include protecting the history of the City and also other
activities throughout the City including placing flags for holidays, etc.
Mayor Gubler stated he has been approached by a resident requesting the City sponsor an Iona
Troop of the Boy Scouts of America. The meetings would be held at the City Building and
anyone would be welcome to join regardless of faith. Kathy Koester from the audience stood and
stated she supported this idea.
Council Member Thompson also expressed appreciation to Clerk West and her assistants for the
job they have done for the City. He also recommended implementing a food drive during the
month of December. He has spoken with the Community Food Basket and they are not as full as
previous years and could use the help. Clerk West stated she will look into that and get it
organized. Mayor Gubler stated the food pantry was closed due to COVID, so a food drive
would be a great idea to do in December with the Mayor's Youth Advisory Council (MYAC).
Council Member McNamara also expressed her appreciation to Clerk West for the Veterans Day
gifts. Clerk West acknowledged Assistant Farren's efforts in gathering the gifts for the Veterans.
Clerk West also expressed gratitude to Mayor Gubler and the City Council for their support on
those activities.
Deputy Chris Williams of BCSO stated he has been consistently monitoring the traffic on 55th
East. He also said any other problems he has had, residents have been quick to address them.
Deputy Williams said they are currently setting up an email for law enforcement concerns.
SUGGESTED AGENDA ITEMS: Council President Geray suggested adding a discussion of a
Heritage Committee to next month's Work Meeting agenda. He also stated this discussion could
include sponsoring the Iona Troop of the Boy Scouts of America.
