The regular meeting of Council way held today, in the Counail Room, and was attended by Mayor Counihan, who presided, and Councilmen Jung, Cary, Schwarz, Hohenstein, Jones, Town Attorney Shea, Supt Heed, Mrs. Margie Solomon, Mrs. Mcgrady and Mrs. Hemieeway. Mrs. Solomon infotmed Council teat Miss Ruby Pound is moving away from Tybee after residing here for 30 years, 20 of which she served UE Chief Operator of the telephone exchange here and requested that in recegnitation of her services to the coemunity that Council honor aa her by disignating Sunday, January 5, 1969, as Ruby Pound Day. 1! Mrs. McCrady and a committee from the Tybee School PTA requested. A that 5th Street be made a one way street, east to west, especially during school hours - Councilman Schwarz moved 5th Street be made one way from east to west - Councilman Jones seconded the motion passed - Councilman Cary will hanale. Councilman hohenstein reported that the ducks have been moved from General George Marshall Park - the fence has been placed around the Cemetary in Memorial Perk and also the the Water Tank. Councilman Jones stated that numbers should be placed on the houses an sugeested that theJeycees or Optimist Club might e'la; take it on as a project. Councilman Schwarz reported that the oleanders have been cleared. Councilman Cary sugeested that a caeck be made with the insurance company to see if the Towns' fire engine is approved - Councilleee Schwarz will check and rdOrt back. Councilman Cary reported thatthe 5/8th water meter now used at the "Wishee Washie" Laundry is too small, a larger meter is needed. 197 Councilman Jung reported that the Committee is still working on the preposed Charter - time is getting short. Councilman Jun s Moved that the C1erkS1 office be closed on December 24th and 3lstfor the holiday season - Councilman Jones seconded and the motion passed. The Mayor reporting for Councilman Daniels - some of the old cars at several locations hvae been moved - =leer D.A.McCutchen resigned from the Police force - recommended that position be left open for the present and apply the savings toward the purchase of a new police car - Councilman Schwarz moved that vacancy on Police Dept not be- filled at this time and savings be applied toward purchase of new police car - Councilman Cary seconded the motion passed. The Mayor taOrted. that stray dogs are being picked up. Mr. Shea staled that there are improvements on the strip of land in FortScreven conveyed to the Town by the FSDevCo., that should not have been conveyed - taxes have been paid on land and improvements - recommended that the owners of the buildingbe permitted to remove it off of the Towns' property - Councilman Schwarz asked if the owners had paid taxes on the property - Mr. Shea stated that it should be taxed - the Mayor asked when would the building be moved - Mr. Shea irformed him that it will be moved now. The Mayor informed Council that a request has beelamade to rent space in the Town Hall - he felt teat this shold not one - the request was denied. The Mayor informed Council that DwdMit Davis requested the Town to quit claim to him any inter4st that the Town has in the property, (a 10 foot strip of land), abutting his property on the north-east co::ner of 3utler Avenue and 10th Street - Mr. Shea will deck on it. Councilman hohenstein stated that he could net see why quarterly reports were to boa-Sent by the Townacovering pollution abatement but mom fkeemother municipalities and moved that 1 pollution abatement program be gdministered bS the County - Councilman Sduarza seconded the motion passed. Councilman Jones moved that the lease of several of tee old forts in Fort Screven owned by the Town to Janka and Harell on for 5 years at 4100.00 per morth, with 2,5 year renewal options, kfectivo 2-1-1969 be approved * :ae - - mm - Councilman Cary seconded, the motion passed. Bills for the various departments were approved for payment. Councilman Schwarz informed Council that he had talked to Supt. Reed regardinF having the DPW maintaining the police cars - Al Williams is good mechanic who could do the work, have Williams salary checked, he is poorly paid, he can save the Town money - the Mayor stated that theDPW will maintain the police cars. Councilman Jones reported that Supt Reed is putting stones at Camp Site area, he suggested using old cars also - he also etated the new collections methods for the 16th street parking lot, should be gone into further _ Councilman Cary said that push buttons are used at Savannah Airport, a_al; this me$6d best for Town. 198 Councilman Schwarz reportin on tne.old fire engine - wantsapproval to buy anotherim4, wont buy it if the pump cant be used ifnhad to buy new pump would have adequate machine. CounciLnan Cary moved that the Ordinance i'egikting the use of water meters, ect., be place on second reading and passed - Councilman Jones seconded and the motion.passed. ORDINANGE. Councilman Jones moved that the Ordinance requiring contractors cleatig lots to haul away the debris,ect., be passed - Councilman Schwarz seconded and the motion pt=nssed. ORDINANCE. Councilman Cary moved when a building permit is issued the Stubbing fee, the the Tapping fee and the fee for the water meter must be paid at the same time. ORDI NANCE. Councilman Cary moved that Surday janw3ry 5th, 1969, be set aside as Ruby Pound Day and a gift be presented to Miss Pound - Councilman Jones seconded and the uiotion passdd. RESOLUTION. Councilman Jung moved some funds be earmarked for future use in the First Federal S. & L. Assn and that the Mayor, M.J.Counihan, the Treasurer, Henry M.Buckley, and the Chairman of the Finance Committee, be authorized to sign checks for the Town - Councilman Johes seconded and the motion passed. RESOLUTION. The minutes of the meeting of November 20th were read and adopted. 1 1 1 1 ORDINANCE AN ORDINANCE TO AMEND AN ORDINANCE ENACTED BY THE MAYOR AND COUNCILMEN OF SAVANNAH BEACH, TYBEE ISLAND, ON SEPTEMBER 16, 1964, IN ACCORDANCE WITH THE PROVISIONS OF AN ACT ADOPTED IN 1922 AND SUBSEQUENT ACTS AMENDING THE SAME, SO AS TO PROVIDE THAT THE APPROPRIATE 'WATER COMMITTEE" OF THE MUNICIPALITY HAVING THE JURISDICTION AND RESPONSIBILITY FOR PROVIDING WATER SERVICE TO CONSUMERS WITHIN THE MUNICIPALITY SHALL BEIELEGATED THE AUTHORITY, AND SHALL BE EMPOWERED, TO ADOPT RULES AND REGULATIONS GOV- ERNING THE FURNISHING OF WATER, WATER METERS, CLASSIFICATION OF CON- SUMERS AND DWELLINGS, AMOUNT AND GALLONAGE, METER AND WATER RATES, BILLING AND PAYMENT AND OTHER RE- LATED MATTERS; TO PROVIDE THE PRO- CEDURE FOR DISCONTINUANCE OF WATER SERVICE TO THE CONSUMERS AND THE METHOD FOR ENFORCING THE DISCONTIN- UANCE OF SUCH SERVICE, THE RENEWAL OF SUCH WATER SERVICE; TO PROVIDE FOR PENALTIES FOR THE VIOLATION OF THE PROVISIONS HEREOF; TO REPEAL ALL CONFLICTING ORDINANCES AND FOR OTHER PURPOSES. BE IT ORDAINED by the Mayor and Councilmen of Savannah Beach, Tybee Island, in council assembled, and it is hereby ordained by the authority thereof: SECTION 1: An ordinance enacted on September 16, 1964, is hereby amended by striking therefrom the present SECTIONS 10 and 11 and by inserting therein the following 1 new sections designated Sections 10, 11, 12 and 13. SECTION 10: The appropriate "Water Committee" of the Council of Savannah Beach, Tybee Island, having the jurisdiction and responsibility pertaining to providing water service to consumers within the municipality, presently designated as "Water- Sewerage Committee", shall be delegated the authority and shall be empowered, to adopt rules and regulations governing the following areas: the furnishing of water to consumers; the installation and cost of water meters, classification of consumers and classification of dwellings, the amount and number of gallons to be supplied, the rates, charges and readings of meters and water furnished and supplied, the method of billing, notice and payment of same, and other applicable and related matters pertaining to furnishing of water and providing for such service. However, any such rules and regulations so adopted should first be approved by the Council of Savannah Beach, Tybee Island, prior to being put into effect. SECTION 11: In the event a consumer fails to pay any bill submitted for water furnished by the municipality within fifteen (15) days after receipt of same, the Mayor and Councilmen, through its designated agents and employees, shall give written notice to such consumer that water service shall be discontinued after five (5) days from the sending of such notice, and should such consumer's water bill con- tinue to remain unpaid, the municipality shall have the right to discontinue the furnishing of water service to such con- sumer by shutting off the flow of water at the meter box, and shall be authorized to place a seal, tag or notification thereon to indicate and enforce the discontinuance of such water supply. The supply of water to such consumer shall not be renewed until after consumer has paid the bill rendered and a $5.00 cut -in -fee for such water service, at which time the municipality shall cause to be removed the seal, tag, or notification from such water box of said consumer. Any con- sumer whose seal, tag or notification has been unlawfully removed, or whose water supply has been illegally turned on, after same has been discontinued for nonpayment of water services hereinabove provided, shall be subjectto the pen- alties hereinafter provided. 2 / 98 -C SECTION 12: Any person violating the provisions of this ordinance shall be cited to appear in the Recorder's Court of the municipality for such violation and, upon conviction thereof, shall be subject to a fine not to ex- ceed ONE HUNDRED ($100.00) DOLLARS, and imprisionment not to exceed THIRTY (30) DAYS, either or both. SECTION 13: All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed. First Reading - 11/20/68 Second Reading - 12/18/68 Passed 12/18/68 3 1 1 /79-C ORDINANCE AN ORDINANCE TO PROVIDE THAT WHERE CONTRACTORS PERFORM WORK WITHIN THE MUNICI.PALITY WHOSE WORK PRODUCES AN ACCUMULATION OR VOLUME OF BRUSH, BRIC- A-BRAC, SCRAP LUMBER, TRASH OR RUBBISH, SUCH CONTRACTORS SHALL BE REQUIRED TO REMOVE AND DISPOSE OF SUCH ITEMS WITHIN A SPECIFIED PERIOD OF TIME AFTER COM- PLETION OF THE JOB OR AFTER WORK STOPPAGE OCCURS; TO PROVIDE THAT THE PUBLIC WORKS SUPERINTENDENT SHALL HAVE THE AUTHORITY TO DIRECT THE REMOVAL OF AND DISPOSITION OF SAME; TO PROVIDE FOR PENALTIES THEREFOR AGAINST THE PERSON HAVING CONTRACTED, AS WELL AS THE PERSON CON- TRACTED WITH, FOR VIOLATION OF THE PROVISIONS OF THIS ORDINANCE; TO PRO- VIDE FOR EXEMPTIONS AND EXCLUSIONS FROM THE PROVISIONS HEREOF; TO REPEAL ALL CONFLICTING ORDINANCES; AND FOR OTHER PURPOSES. BE IT ORDAINED by the Mayor and Councilmen of the Town of Savannah. Beach, Tybee Island, in council regularly assembled, and it is hereby ordained by the authority thereof: SECTION 1: Any individual, person, firm or cor- poration who has contracted with any other individual, person, firm, commercial establishment or corporation within the municipality, either on an hourly rate bast or a job contract price, whose work product produces an accumulation or volume of brush, bric -a -brac, scrap lumber, trash or rubbish shall be required to remove and dispose of such accumulation or volume of brush, bric -a -brac, scrap lumber, trash or rubbish resulting therefrom within ten (10) days after the com- pletion of such contract or job, or if such job or contract be incomplete as a result of work being stopped thereon, /99 -t within ten (10) days after said work stoppage occurs. SECTION 2: The public works superintendent of the municipality than have the authority to direct the removal, placing, disposition and disposal of such accumu- lation or volume of brush, bric -a -brac, scrap lumber, trash or rubbish resulting from such job or contract. SECTION 3: In the event any accumulation or volume of brush, bric -a -brac, scrap lumbe4 trash or rubbish is not removed within ten (10) days after completion of said job or contract, or within ten (10) days after a work stoppage occurs on an incomplete job or contract, the individual, person, firm or corporation having con- tracted, as well as the individual, person, firm, commercial establishment or corporation, within the municipality con- tracted with, either or both, jointly or severally, who violates the provisions of this Ordinance shall be cited to appear in the Recorder's Court of the Municipality for such violation and upon conviction thereof, shall be sub- ject to a fine not to exceed ONE HUNDRED ($100.00) DOLLARS, and imprisionment not to exceed THIRTY (30) days, either or both. SECTION 4: Nothing herein shall be construed to mean that any individual, person, firm, commercial estab- lishments, or corporation within the municipality shall be prohibited from producing an accumulation of brush, bric -a -brac, scrap lumber, trash or rubbish if such ac- cumulation or volume of these items is a result of his, her or its own.labor, work or service performed on his, her or its own property, residence or premises, and the municipality shall continue to remain responsible for the removal, disposal and disposition of same. SECTION 5: All Ordinances and parts of Ordinances in conflict with this Ordinance are hereby repealed.
