Night Deposit Contract
City of McCall (hereinafter called "depositor"), requ.res the use of the night
deposit facilities (the"depository`s of U.S. Bank (hereinafter called "bank") and agrees to comply with the following terms and
conditions.Thisagreementls effective as of the date ofbank's signature below and shall remain in effect until terminated by
eitherpartyas provided herein. ThisNigh tDeposit Contract supplementsthe deposit account agreement(s)between bank and
depositorapplicableto each acco un t for which night deposits are being made. In the event ofa conflict between the terms of the
deposit account agreement and the terms ofthis agreement, the terms of the depositaccount agreernentwill prevail.
i. Each deposit placed In the depository shall be contained in a pouch that has been approved or supplied by the bank. The pouches
shall be removed from the depository in the presence of no less than two employees of the bank. W-th regard to the tact that the
pouch was received by the bank, the joint record of the two employees shall be conclusive.
2. For each deposit, the depositorwill enclose in the pouch an itemized list of cash and checks, and retain a copy of the itemized list for
its own records.
3. The bank reserves the right to charge a fee forth night deposit service and a security deposit for pouches, locks and/or keys;
provided, however, that bank vnll provide depositor at least ton (110)days' notice of such fee.
4. lithe deposited pouches remain unclaimed by depositor afterlhree (3) business days, the bank may forcibly open the pouch in the
presence of two bank employees. The be nk may deposit the contents to the depositors account or hold the contents for safekeeping.
5. No keys shall be used foropening the night depository except those supplied by the bank and any loss of keys orpouches shall be
reported to the bank Immed lately. Also, any defects OF malfunctions of the depository equipment shalt be reported to the bank
Immediately so that corrections can be made.
B. In placing the pouches in the depository, the depositorvrill take the necessary precautions to ensure the pouch leaves the receptacle
and drops down the chute. Bank Is not responsible for personal injury or property damage resulting from deposilor's use of the
depository, except forinjuryordamage caused by bank's gross nagligenceorwillful misoonduct.
7. The bank may withdraw the night depository from use at any time without notice in case of emergency, act of God, or need for repairs
and shall not be held liable for any loss resulting therefrom. The bank shall not be responsible for the operation, safely. or condition of
the night depositoryorof any keys, locks, pouches, or other equipment loanederfumished for use in connection therein.
B. The bank reserves the right to terminate this agreement with written notice at anytime It desires and upon termination, all equipment
furnished under the agreement shall be immediately returned to the bank. Depositormay terminate this agreement at any time upon
written notice to bank.
9. The bank reserves the right to add to, delete from, orallerthe above rules and regulations as it sees fit. The depositorwrll be notified
of such changes.
10. Company representatives orstore employees that intendto pick up receipts, coinlchange orders and empty deposit bags do not need
to sign the contract. However, any limllatlons on employees Involved in these activities, must be noted here within.
11. Deposits with a discrepancy between counted cash and the Itemized list provided will be re-varified by no less than two bank
representatives. The bank reserves the right to adjust the deposit fordlscrepancies of $50 orless without notice to the depositor, and.
in addition to adjusting the deposit, may contact the depositor for discrepancies in excess of $50 forfurther instruction.
12, The depositor chooses one of the following depository service options.,
ea) The Bank Is authorized to open bagalpouches and process the deposit contents.
b) The sank will hold the unprocessed bags until an authorized company representative arrives to collect the bags or
open the bags for processing by the bank. The person(s)whose sign alure(s) appear(s) below are authorized to sign for
and collect the unprocessed pouches removed from the night depository. open the pouch forprocessing by the bark,
and/or plckupbags with negotiable lems inside,
