AN ORDINANCE REPEALING SECTION 8-76: HEAVY VEHICLES PROHIBITED
ON DESIGNATED STREETS,AND REPLACING IT WITH SECTION 8-76: TRUCK
ROUTES
WHEREAS, I.C.9-20-1-3 permits a public agency to prohibit the operation of trucks and
commercial vehicles,and to impose limitations on the weight,size or use of vehicles on city streets;
WHEREAS, there have been numerous complaints of heavy truck traffic on Shadowlawn,
Washington Street and Franklin Street; heavy truck traffic on city streets that are not built for heavy
weights, can cause deterioration of the street,be disruptive to traffic flow, and result in excessive
noise.
WHEREAS,the Greencastle City Code currently restricts truck traffic on a limited number of
streets; and
WHEREAS, due to traffic and safety concerns, and wear and tear on city streets, additional
restrictions are necessary.
NOW THEREFORE be it ordained by the Common Council of the City of Greencastle that it
� hereby repeals Section 8-76 Heavy Vehicles Prohibited on Designated Streets and Replacing it with
Section 8-76 Truck Routes, as follows:
Section 8-76. Truck Routes.
a. Definition. For purposes of this section, "truck" shall mean any vehicle that:
1. has more than six wheels total;
2. has more than one rear axle;
3. has a combined body and load vehicle weight or gross weight of more than 14,000
pounds, whether loaded or empty.
4. has a combined gross vehicle weight of more than 14,000 pounds as indicated by
registration with the state agency licensing the vehicle, whether loaded or empty;
5. is a semi-tractor with a single or dual rear axle without a semi-trailer
6. is a semi-tractor with a single or dual rear axle and one or more semi-trailers
whether or not the trailer(s) is loaded or empty; or
7. is a semi-tractor with an international shipping container chassis with or without a
container.
The above definition includes the vehicle combined with any trailer or combination
of trailers or other attachments to the vehicle.

b. All trucks within the city limits shall be operated only on the truck routes listed below:

*�`the State of Indiana has jurisdiction to restrict truck traffic on its highways.
c. Exemptions. The above restrictions shall not apply to the following:
1. Trucks upon any street where travel is necessary to conduct business at a
destination point, provided the truck travels on truck routes until reaching the
intersection nearest the destination point;
2. Emergency vehicles and trucks owned or operated by the city, county, state, or
. public utilities;
3. Any construction equipment while engaged in the repair, maintenance or
� construction of streets,street improvements,buildings,utilities or other construction
projects within the city;
4. Local service vehicles including, school buses, and refuse removal vehicles;
5. Travel pursuant to an officially established detour; or
6. Vehicles belonging to the United State Postal Service,UPS,FedEx,DHL or other
package deliver services so long as such vehicles do not have more than six wheels.
d. Fines. Any person, firm, corporation or business entity violating any provisions of this
Ordinance shall be fined a sum of$100.00 for each violation.
This Ordinance shall have full force and effect upon passage of the Greencastle Common
Council, approval by the Mayor and proper publication, and shall replace all other ordinances and
policies that are inconsistent herewith.
