The Greencastle Common Council met in Executive Session on Thursdav, April 25, 1996 at 4:00
p.rn. at City Hall. iVlavor Michael called the mce* -im, to order. On the Roil CaIL the foilowing
were found to be present: Councilor Roach, Councilor I lammer, Councilor Green, Councilor
Bavnard and Councilor Masten. Also in attendance was Attornev John Zeiner and Attornev
Larry Wilson.
The subject of discussion was Pending Litigation regarding Res -Care and the Preliminary
Injunction Hearing to be held Fridav, April 26, 1996 at noon in Federal Court in Terre Haute,
Indiana.
Attornev Zeiner told the Council that he has engaged Larry Wilson as the Attornev to respond to
this matter and a contract was approved and signed by the Board of Works on April 24, 1996_
Attorney Wilson explained that the lawsuit tiled by Res -Care mainly deals with the Federal Fair
Housing Act and they are requesting 5250,000.00 in punitive and actual damages. The Cuv is
not liable for punitive damages and Res -Care has delaved as much as anvone else. Attorney:
Wilson told the Council that.fudge McKinnev will be hearing the case.
After much discussion Attorney Zeiner recommended to the Council to continue to oppose the
lawsuit. By consensus. the Council requested that Attorney Wilson and Zeiner report bac'< to
them when they have a ruling by the Judge and the Council will decide how to proceed once
they have a ruling.
Being no further business, Councilor Hammer made a motion to adjourn, seconded by Councilor
Roach. Vote to adjourn was unanimous.
