A RESOLUTION OF THE VILLAGE OF KEY BISCAYNE,
FLORIDA; AUTHORIZING THE VILLAGE MANAGER TO
EXECUTE THE ATTACHED AGREEMENT WITH COASTAL
SYSTEMS INTERNATIONAL, INC. CORAL GABLES, FLORIDA,
FOR PROFESSIONAL SERVICES IN MONITORING FILL
QUANTITIES AND QUALITY FROM THE CAPE FLORIDA
WETLAND RESTORATION PROJECT FOR THE PURPOSES OF
ELEVATING THE VILLAGE BEACH PARK AND PERFORMING
A MINOR BEACH FILL OPERATION; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Village Council has supported beach preservation through dedicated
funding, resolutions, and preparation for the pending beach nourishment; and
WHEREAS, the Village Manager and the Beach Resources and Management (BRM) Task
Force have negotiated for Cape Florida beach sand since June 10, 1996; and
WHEREAS, the Village Council adopted Resolution 97-51, dated October 28, 1997,
authorizing the receipt of funds in the amount of approximately $100,000.00 from the Ocean Club
Development, Inc., for the cost of the excavation and transportation of Cape Florida Wetland
Restoration Fill in agreement with the terms and conditions of an executed agreement with Miami -
Dade County Department of Environment Resources Management (DERM); and
WHEREAS, the Village Council adopted Resolution 97-52, dated October 28, 1997,
authorizing the execution of an Interlocal Agreement with Miami -Dade County for the excavation
and receipt of Cape Florida Wetland Restoration Fill, including 10,000 cubic yards of beach quality
sand; and
WHEREAS, monitoring of fill material will ensure delivery of the correct quantities and
qualities required for the contract and the completion of the project; and
WHEREAS, monitoring will ensure quality control and placement of fill types essential for
State of Florida Department of Environmental Protection (DEP) permit compliance, and general
environmental protection;
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF KEY
BISCAYNE AS FOLLOWS:
Section 1. The Village Manager is hereby authorized to execute the attached agreement
for the monitoring of Cape Florida Wetland Restoration fill, on behalf of the Village, with Coastal
Systems International, INC.
Section 2. This resolution shall take effect immediately upon adoption.

RE: THE VILLAGE BEACH/UPLAND FILL RELATIVE To ADDITIVE A (PARTIAL) CAPE
FLORIDA WETLAND RESTORATION PROJECT IN KEY BISCAYNE, DADE COUNTY.
Dear Mr. Kissinger:
Pursuant to our discussion with James DeCocq, this is to submit a proposal to provide
construction supervision and weight ticket collection services for the Village of Key Biscayne
relative to the above referenced project. The following are the proposed terms of agreement for
engineering services to be provided by Coastal Systems International, Inc. (Coastal Systems) for
the Village of Key Biscayne (Village):
PART I - CONSTRUCTION SUPERVISION
A Coastal Systems engineer (Engineer) will be onsite during the construction to observe
excavation, separation and trucking of the material that will be excavated in Bill Baggs State
Park and transported to the designated sites at the Village of Key Biscayne. The Engineer will be
onsite 50% of the time over an estimated 25 working days (8 hours a day) construction period.
The Contractor and the County will ultimately be responsible for properly separating the
excavated material before trucking to the Village. The Engineer will observe the operations
during the construction to ensure the excavated material be properly separated by the Contractor
and transported to the designated locations in the Village for beach and upland fill.
During the construction, a progress report will be prepared and submitted to the Village on a
weekly basis. This weekly progress report will identify the quantity of beach quality and non -
beach quality material that has been excavated and transported to the designated staging sites in
the Village of Key Biscayne. The Village will identify the temporary staging areas during the
construction and designate the fill areas for various types of materials. The Engineer will inform
the Village representative regarding the progress of the project and any discrepancies that may be
observed during the construction supervision.
Fees for Part I services are $7,800

PART II - WEIGHT TICKET COLLECTION
A Coastal Systems staff member will be onsite full-time during the construction to collect the
weight tickets and forward the tickets to Dade County. The County is responsible for the
quantity of beach -quality and non -beach quality materials being excavated and delivered to the
Village. The Coastal Systems engineer will check the collected weight tickets to verify the
quantity of material delivered.
Fees for Part II services are $8,000
PART III - VILLAGE DIRECTED MEETINGS
This phase of services provides for all meetings with the Village, County, State and/or other
developers. Specifically, Coastal Systems will attend meetings, as required by the Village, prior
to, during and after the project implementation.
Fees for Part III services are Hourly
GENERAL
Coastal Systems will invoice the Village for Parts I and II services upon completion of the above
identified works. Fees for Part III services will be invoiced on an Hourly basis pursuant to the
attached rate schedule. Expenses will be invoiced separately pursuant to the above mentioned
rate schedule. In the event that the duration of the construction exceeds the estimated 25
working days, Coastal Systems will continue to perform the above identified tasks and invoice
the Village for the fees on an hourly basis, pursuant to the attached rate schedule.
The Village shall make payments to Coastal Systems upon receipt of an invoice. Invoices not
paid within 30 days and not in dispute shall incur interest at the rate of 1.5% per month. The
Village agrees to pay any cost of collection including reasonable attorney's fees incurred whether
or not a suit is commenced or an appeal is taken.
