The regular meeting of Council was held t ay at 3:00 P.M. in the
Council Room and was attended by Mayor Cou ihan, who presided,
Councilmen Daniels, Jung, Cary, Hohenstein, Schwarz, Jones, Town
Attorney Shea, Chief Price, H. K. Ellzey and Mr. Waldeck.
Mr. Waldeck showed a new Dual parking meter, single head, made by
Rockwell Mfg. Company. Cost of $54.50 without trade, delivery
within 30 days. No action taken.
Councilman Cary objected to the minutes of the meetings of December
18, 1968, and January 15, 1969, as written, and made a motion that
Council not accept them and that they be re- written. Councilman
Jones Seconded and the motion passed.
It was suggested that a stenographer be employed to cover the
monthly meeting at $10.00 per meeting. A decision will be reached
at the Wednesday, March 5th meeting.
Councilmen Schwarz reported that the Savannah Beach Volunteer Fire
Department will hold its Annual Awards Dinner, Friday, March 28,
1969. Council is invited. Councilman Cary requested that the
bill for the dinner be presented to the Town for payment.
Councilman Schwarz questioned the status on the burned building
at Butler Avenue and Highway 80. Attorney Shea said a letter had
been written to Mr. Jacobs, asking him to repair the building or
the Town will have to take other action. The building inspector
and Chief of Police should check on it.
Councilman Jones moved that Lovell Avenue north of First Street,
be raised and paved. Councilman Schwarz seconded and the motion
passed.
Councilman Cary requested the holes in the street leading to the
boat ramp at Alley #3, and the holes in Butler Avenue be repaved
at the same time.
Mayor Counihan said the Town will try to accomplish all three
projects at the same time.
Request from Mrs. Louise Sasser, 109 Jones Avenue, for a street
light in her area. The street light was approved by Council.
Councilman Jones will handle. •
Councilman Jones moved that canals in General George Marshall Park
in Fort Screven, be filled and the area made into a playground.
Councilman Schwarz seconded and the motion passed.
Councilman Cary asked about the electric service for the Camp
Site. He was informed by the Mayor that Herb Electric Company
is working on plans for installation.
Councilman Daniels made a motion that three police officers be
sent to Atlanta, expenses paid, to the Police School for'in-
struction on the Intoximeter. Councilman Jung seconded and the
motion passed.
Councilman Jung made a motion that the Municipal Code Corporation'
of Tallahassee, Florida, be awarded the contract to codify all of
the Ordinances and Laws of the Town of Savannah Beach for a price
of $3,000.00. Councilman Cary seconded and the motion passed.
An invoice, from American La France Fire Corporation inthe amount
of $1,000.00 for fire engine cancellation, was referred to Mr.
Shea for handling.
Public Notice from U. S. Engineers, dated 2/17/69, No. SASKS -WW
(6034), to ascertain if Council had any objections to the in-
stalling of fishing reefs in the areas shown. Councilman Jung
moved that no objections be made. Councilman Schwarz seconded
and the motion passed.
Councilman Jung informed Council that the State Highway Depart-
ment has agreed to pave Campbell Avenue from Highway 80 to Van
Horn Street and 500 feet on Second Avenue, from Van Horn Street
to Highway 80; the Strand from 16th to 18th Streets; parts of
Butler Avenue, 17th to 18th. Work is to begin in the Spring.
Councilman Jung read the January financial statement. The Town
shows a surplus at this time.
Councilman Cary moved for adoption of the Water Committee's
policy on one meter for one owner of a duplex or two story
apartment. If there are two separate owners, each will purchase
a meter. Councilman Schwarz seconded and the motion passed.
Councilman Cary reported that the cost to put in the controls at
the 14th Street Pumping Station would be $1,450.00 by the Layne
Atlantic Company. The contract has been signed.
Councilman Cary reported that the pump at #1 Well will be removed
and the well capped and sealed.
Attorney Shea informed Council that the suit of Louis Thompson
vs. the Town of Savannah Beach had been dismissed. The Town
and Mr. Dennis Pierce, Mr. Thompson's attorney, will each pay
half of the Court cots.
Bills for various departments were approved for payment.
Attorney Shea informed Council, he will meet with W. C. Fleetwood's
attorneys regarding the Oceam View Inn.
Councilman Schwarz made a motion that petition of Savannah Electric
& Power Company, dated 2/26/69, to erect a Diesel standby electric
generating plant in the area between Estill Avenue, Polk Street,
old Central of Georgia Right -of -Way- and lot 5, block 10, Bay
Ward, be granted. Councilman Jones seconded and the motion passed.
Councilman Cary moved the adoption of an amendment to the Water
Ordinance adopted 9/16/64, and further amended 12/18/68, to strike
out Section 13, and insert new Sections 13 and 14. Second Reading.
Councilman Schwarz seconded and the motion passed.

There being no further business, Council adjourned subject to the
call of the Mayor.

ORDINANCE
AN ORDINANCE TO AMEND AN ORDINANCE ENACTED
BY THE MAYOR AND COUNCILMEN OF SAVANNAH
BEACH, TYBEE ISLAND, ON SEPTEMBER 16, 1964,
AND FURTHER AMENDED ON DECEMBER 18, 1968,
IN ACCORDANCE WITH THE PROVISIONS OF AN
ACT ADOPTED IN 1922 AND SUBSEQUENT ACTS
AMENDING THE SAME, SO AS TO PROVIDE THAT
THE OWNER OF ANY PROPERTY LOCATED WITHIN
THE MUNICIPALITY WHICH IS FURNISHED WATER
BY THE MUNICIPALITY SHALL BE INDIVIDUALLY
AND PERSONALLY RESPONSBILE FOR ANY AND ALL
COSTS OR CHARGES FOR SAID WATER SERVICE,
NOTWITHSTANDING THAT SAID PROPERTY MAY
LEASED TO ANOTHER BY SUCH OWNER.
BE IT ORDAINED by the Mayor and Councilmen of Savannah
Beach, Tybee Island, in Council assembled, and it is hereby
ordained by the authority thereof:
SECTION 1: An ordinance enacted on December 18, 1968,
is hereby amended by striking therefrom the present SECTION 13,
and by inserting therein the following new sections, designated
as SECCTIONS 13 and 14.
SECTION 13: Effective May 1, 1969, any individual,
person, firm or corporation owning property within the limits
of the municipality, and which is supplied water by the munici-
pality, shall be personally and individually responsible for
the costs and charges of such water so furnished, notwithstanding
that such property so owned may be leased by such individual,
person, firm or corporation to a tenant or other individual,
person, firm or corporation.
SECTION ..14: All ordinances or parts of ordinances in
conflict with this ordinance are hereby repealed.
